The Plaintiff-Mortgagee, PNC Bank, National Association, is a corporation organized under the laws of the United States of America, having an office and place of business at 1631 South Atherton Street, State College, Centre County, Pennsylvania. 2. The Defendants-Mortgagors are Christopher Nester and Antonella M. Nester, whose last known address was 2115 Wentworth Drive, Camp Hill, Cumberland County, Pennsylvania (17011). 3. At all times material to the Plaintiff's cause of action, the Defendants have been the owners of a tract of land and the building thereon erected, herein called "land", located in the Township of Lower Allen, County of Cumberland and State of pennsylvania. 4. On or about AUgUBt 13, 1996, in consideration of the loan of $20,010.00, made by Plaintiff to the DefendantB, the Defendants executed and delivered to Plaintiff an Installment Loan Note and Security Agreement secured by a Mortgage on the land obligating Defendants to pay Plaintiff $20,010.00 with payment of $255.04 to be made monthly until this loan, additional advances, interest and other charges covenanted were paid in full, with interest at the rate of 9.15% per annum. The Mortgage is recorded in Cumberland County Record Book 1338, Page 308. A copy of this Mortgage is set forth as Exhibit "A". 6. The Defendants are in default with respect to the said Mortgage because of their failure to make the payments due for the months of November, and December, 1997 and January, February, March, April, May, June and July, 1998. 7. Under the terms of the Note set forth as Exhibit "B", Defendants are obligated to Plaintiff as follows: Unpaid Principal Balance Interest through July 10, 1998 Late Charge Real Debt $19,002.83 500.19 30.00 $19,533.02 with costs, attol'ney'u feeD and expenses to be added. 8. The Defendants are the present owners of the land. 9. Plaintiff has complied with the requirements of Act No. 6 of January 30, 1974, by forwarding a notice of intention to foreclose to Defendants on February 11, 1998, a copy of which is attached hereto as Exhibit "C". 10. Plaintiff has complied with the requirements of Act 91 of 1984 by forwarding the notice attached hereto as Exhibit "D" and has been denied Homeowners Emergency Mortgage Assistance by the Pennsylvania Housing Finance Agency. WHEREFORE, Plaintiff, requests the entry of judgment for foreclosure and sale of the mortgaged premises and for the amount of $19,533.02, together with all interest, expenses, unpaid taxes and costs of this suit.
