PETITION FOR RULE FOR JUDICIAL SALE
AND NOW, comes the Cumberland County Tax Claim Bureau, by its attorney,
Stephen D. Tiley, Esquire, Assistant Cumberland County Solicitor, and files this
Petition for Rule for Judicial Sale, of which the following is a statement:
1. Your Petitioner is the County of Cumberland through its Tax Claim Bureau,
a Bureau created by the Real Estate Tax Sale Law. 72 P.S. 95860.101, et sic.

follows:
Pursuant to 72 P.S. 95860.610, your Petitioner respectfully represents as
a.
Tax claim upon which the property was exposed for sale: 1987
through and including 1996 Cumberland County, Cumberland
County Library, and Mount Holly Springs Borough real estate taxes.
1987-88 through and including 1996-97 Carlisle Area School
District real estate taxes. Total amount of claim, including penalty
and interest as of date of tax sale: $7,894.78.
b.
Neither the owner, his, her, their, or its heirs, successors,
assigns, or legal representatives, or any lien creditor, or his, her,
their or its heirs, successors or legal representatives, or any other
person interested, has caused stay of sale, discharge of tax claim or
removal from tax sale.
c.
The property was exposed to public sale pursuant to 72 P .S.
95860.601 on: September 25, 1997.
d.
Before exposing the property to public sale the Bureau fixed the
upset sale price, pursuant to 72 P.S. 95860.605, which upset price
was $8,504.29.

e. Your Petitioner, the Bureau, was unable to obtain a bid at the
public sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by reference
as if fully set forth herein, is a copy of a title report received from a title searcher
retained by the Bureau together with a reduced copy of the most recent deed for the
subject premises, as of the date of the search. The tax parcel number of the property is
23-32-2338-123. The property is situate in the Borough of Mount Holly Springs,
Cumberland County, Pennsylvania.
4. The names and addresses of all parties holding tax and municipal claims,
liens, mortgages, ground rents, charges and estates against the property are as
follows:
a. Cumberland County Tax Claim Bureau
Cumberland County Courthouse
Carlisle, Pennsylvania 17013
Delinquent taxes payable through June 30, 1998: $8,898.21.
(Includes taxes through 1997 County, Library and Borough and
1997-98 School real estate taxes now returned to Tax Claim
Bureau.)

1998 County, Library and Borough taxes payable at penalty in the

5. The last known address of the owner of the property as set forth in the

known address of the owner of the property: Mr, Daniel Garonzik, 342 Mull Boulevard,

MOTION FOR REVISED RULE TO SHOW CAUSE
AND NOW, this o?'9'/JJ.. day of November, 1998, comes the Cumberland
County Tax Claim Bureau, by its attorney, Stephen D. Tiley, Esquire, Assistant
Cumberland County Solicitor, and files this Motion for Revised Rule to Show Cause,
as follows:
1. On August 6, 1998 the Cumberland County Tax Claim Bureau filed a
Petition for Rule for Judicial Sale of the real estate known as Cumberland County Tax
Parcel No. 23-32-2338-123 which is owned, or purported to be owned by Daniel A,
Garonzik,
2. On August 12, 1998 the Court entered a Rule to Show Cause with the
rule -returnable on December 3, 1998 at 9: 15 a,m, in Courtroom Number 2,
3, Section 611 of the Real Estate Tax Sale Law (72 P,S, ~5860,611
provides for service by the Sheriff at least fifteen days prior to the return day of the rule,
4, The Sheriffs of Cumberland County and Allegheny County Pennsylvania
have been unable to locate Daniel A, Garonzik.
5, On or about November 18, 1998 the law office of Frey and Tiley, of which
Stephen D. Tiley is a partner, was advised that Daniel A, Garonzik had been found at
Parcel No, 23-32.2338-123

3. On August 12, 1998 your Honor issued Rule to Show Cause returnable
December 3, 1998.
4. At that time it was believed that Daniel A. Garonzik was living in
Pittsburgh, Pennsylvania as sometime before that movant, Stephen D. Tiley had a
telephone conversation with Daniel A. Garonzik and received a post office box
address in Dauphin County.
5. Service of the Rule to Show Cause was not able to be made upon Daniel
A. Garonzik and on November 24, 1998 movant filed a Motion for Revised Rule to
Show Cause believing that Daniel A. Garonzik had been found at 85 Broad Street,
New York, New York, Pursuant to said Motion a Order and Rule to Show Cause was
issued by your Honor on November 30, 1998 setting a Rule returnable date of
December 31, 1998.
6. ,As Sheriff's returns filed to the within action disclose, service of process
was not able to be made upon Daniel A. Garonzik at the 85 Broad Street, New York,
New York address.
7. Movant continued efforts to locate Daniel A. Garonzik and attached
hereto, marked Exhibit "An, and incorporated herein by reference thereto as if fully set
forth herein is a Affidavit of Movant, Stephen D. Tiley, indicating the efforts of the
Cumberland County Tax Claim Bureau to locate Daniel A. Garonzik.
8. Attached hereto as Exhibit "B" is an affidavit of Robert M. Frey, Esquire,
indicating that Daniel A. Garonzik can be reached through his brother, Jeffrey A.

Garonzik, at 8174 Buena Vista Drive, Warrenton, Virginia 20186.
9. The affidavit of Movant attached hereto as Exhibit "A" indicates that
Daniel A. Garonzik was the executor of his father's estate and that the attorney of
recorded in that estate is Richard C. Rupp, Esquire of Rupp and Meikle, 355 North 21st
Street, Camp Hill, PA 17011.
10. Pa. R.C.P. 403 and 404 provide that any competent adult can serve a
party outside the Commonwealth of Pennsylvania by return receipt mail and if the
defendant refused to accept the mail then by ordinary mail. Daniel A. Garonzik will not
be at either the address of his attorney in connection with the estate of his father nor at
the address of his brother Jeffrey, which he uses to receive rnail.
11. Movant requests your Honorable Court to enter an Order for Service by
ordinary mail upon Daniel A. Garonzik c/o Richard C. Rupp at his address and c/o
Jeffrey A. Garonzik at his address,
12. Movant also requests a Order for Service by publication pursuant to Pa.
R,C,P. 430 pursuant to the advertisement attached hereto as Exhibit "C," the said
advertisement being a consolidated advertisement for both the within action and the
companion case described on paragraph 2 of this Motion.
WHEREFORE, Movant prays your Honorable Court as follows:
(i) That the Order and Rule to Show Cause dated December
31, 1998 is vacated and the returnable date of February 10, 1999 is

I, STEPHEN D. TilEY, ESQUIRE, of 5 South Hanover Street, Carlisle,
Cumberland County, Pennsylvania, do hereby swear and affirm as follows;
1. Sometime prior to the August 6, 1998 filing of the Petitions for Judicial
Sale of Cumberland County tax parcel number 23-32-2338-012B and Cumberland
County tax parcel number 23-32-2338-123 (filed to Cumberland County numbers
1998-4546 and 1998-4547, Civil Term) I had a telephone conversation with Daniel
Garonzik. That telephone conversation was in response to prior efforts to reach him in
connection with an upset tax sale of his real estate. In that conversation he indicated
that he worked for a liquidation company traveling throughout the United States from
one store site to another, as those store were being closed and their inventory
liquidated. At that time he indicated a post office box address in Pittsburgh,
Pennsylvania. During that conversation I advised him that I believed the two parcels of
real estate had value in excess of their taxes as potential third party bidders had been
in contact with the Tax Claim Bureau. Notwithstanding that advise, Daniel Garonzik
indicated that he had no interest in the said real estate.
2. Through my law firm's involvement with the administration of the trust of
Arnold Garonzik, Daniel Garonzik's grandfather (see affidavit of Robert M. Frey
attached), I thereafter came to believe that Daniel Garonzik had been located at 85
Broad Street, New York, New York. At that time I mailed a letter dated November 24,
1998 to him. A copy of that letter is attached hereto as Attachment 1. While that letter
was never returned undeliverable, the return filed by the Cumberland County Sheriff's
Office in the aforementioned Judicial Sale cases indicates that 85 Broad Street is an
address of Goldman Sachs & Company and that the documents which the Sheriff had
been attempting to serve were returned by a Rick Garonzik at Goldman Sachs &
Company to the Cumberland County Sheriff's Office,
3. Attached hereto as Attachment 2 is a copy of notes of Julie Kurtz, an
employee of the Cumberland County Tax Claim Bureau and a memo to file by Jacob
Heisey, Director of the Cumberland County Tax Claim Bureau, describing some, but
not all, of their efforts to locate Daniel Garonzik.
4. On more than one ocassion Barbara Garonzik, mother of Daniel A.
Garonzik, has called me in connection with another matter unrelated to either these tax
sales or the Arnold Garonzik trust in which I represent a partnership which entered into
an installment seller of land, One of those partners was Samuel Garonzik, deceased;
father of Daniel A. Garonzik, In those conversations I have asked Barbara Garcinzik if

she knows where her son, Daniel A. Garonzik, is and she has told me that
unfortunately she does not know where he is and that evidently he desires to keep his
whereabouts secret from her. She believes that one of the reasons Daniel Garonzik
may be unwilling to provide his address for other purposes is that he does not want his
mother to be able to obtain it.
5. In connection with the aforementioned installment sales agreement I
have had some contacts with the attorney for the estate of Samuel C. Garonzik, a/k/a/
Samuel Garonzik, father of Daniel A. Garonzik. After the renunciation by Jeffrey A.
Garonzil< of his right to administer the estate of his father Samuel Garonzik his brother,
Daniel A. Garonzik was duly qualified and Letters Testamentary were issued to him.
At that time his address was 213 Forge Road, Boiling Springs, PA 17007 and later on
those estate records indicate an address at 2852 Oakland Road, Dover, PA 17315,
however, to the best of deponent's knowledge Daniel A. Garonzik has not resided at
either of those addresses for some years. The attorney of record for the estate of
Samuel Garonzik, as disclosed by the records filed to Cumberland County estate
number 21-90-911, is Richard C. Rupp, Esquire whose current address is Rupp and
Meikle, 355 North 21st Street, Camp Hill, PA 17011.
6. I have no further knowledge as to the whereabouts of Daniel A. Garonzik,
except that which is disclosed by the affidavit of Robert M. Frey, Esquire, executed
contemporaneously herewith.
I verify that the statements made herein are true and correct to the best of my
knowledge, information and belief, and understand that false statements herein are
made subject to the penalties of 18 Pa. C. S. A, S 4904 relating to unsworn falsification
to authorities.

Morning of 1-21-99, Barbara Garonzik, Mother of Daniel A. Garonzik, called to furnish
me with addresses and phone numbers where Daniel might be reached. Daniel's last
place of work was at Celleni "on-snap", I called the number-718-241-7715 _ given to
me by Mrs, Garonzik and was told that "the job was finished and they left". I then called
the company Mr. Garonzik works for - Gene Rosenberg, GRA, in Connecticut, 800-
GRA-5242 and was told "didn't know until today that job at Celleni was finished, I
asked where I might reach Mr. Garonzik and was told "I have not idea, maybe they went
home". I then called the home number given to me by Mrs. Garonzik -718-891-4555-
and reached an answering machine that was answered "Dan here -leave message". I left
a detailed message explaining the purpose of my call and left my name and phone
number and tried to make the point that this call was very important. No return call
received.
On 1-22-99, I called Sheriff Kline to see if he could have someone back into an address
with home phone number given by Mrs, Garonzik, Mr. Kline call back on 1-28-99 to tell
me that the phone company would not give and address, only that it is a residential
listing, On 1-28-99, I call directory assistance and asked for listing at 85 Broad Street,
New York, NY (address developed by Dauphin Deposit Bank) and in the nan1e of Daniel
A. Garonzik or Dan Garonzik, No listing at that address for a Garonzik.
I have since, on several occasions, tried to reach Mrs, Garonzik but no answer. Mrs.
Garonzik had iold me that she had called Daniel and left a message to her, Steve Tiley or
me.

1. I am the attorney for the Trust under the Will of Arnold Garonzik,
deceased, and in such capacity I have had occasion to be in contact with Daniel A.
Garonzik.
2. Arnold Garonzik died on February 24, 1988. His estate is filed to
Dauphin County, Pennsylvania, estate file number 212-1988, The Last Will and
Testament of Arnold Garonzik created a Trust whereby Dauphin Deposit Bank and
Trust Company held the assets of Arnold Garonzik in trust with the income payable to
his widow, Thelma Garonzik and upon her death the principal of the trust was to be
divided equally between the three children of Arnold Garonzik, to wit: his daughter
Ann G, Iselin, his son Harry L. Garonzik, and his son Samuel Garonzik, and in the
event that any of his children should predecease his widow their share to pass to their
issue per stirpes.
3. Samuel Garonzik'a/k/a Samuel C. Garonzik died on August 20, 1989.
His estate is filed to Cumberland County, Pennsylvania, estate file number 21-90-911,
4, Thelma I. Garonzik, widow of Arnold Garonzik, died on September 27,
1998. Her estate is filed to Cumberland County, Pennsylvania estate file number 21-
98.1024.
5. Samuel Garonzik having predeceased his mother, his share passed to
his issue, to wit: Jeffrey A. Garonzik, Daniel A. Garonzik and Eric A. Garonzik. Jeffrey
A. Garonzik resides at 8174 Buena Vista Drive, Warrenton, Virginia 20186. Eric A.
Garonzik currently resides at 110 "C", West Vines Street, Shirenenstown, PA 17011,
6. Daniel Garonzik, a/k/a Daniel A. Garonzik is a son of Samuel Garonzik
and I have communicated with him at his brother's residence in Warrenton, Virginia.
Daniel Garonzik has advised me that his own residence is unsettled and that all

MOTION FOR CORRECTED PETITION,
ORDER, CAPTION AND NOTICE
AND NOW comes Stephen D. Tiley, Assistant Cumberland County Solicitor,
on behalf of the Cumberland County Tax Claim Bureau, and files this Motion for
Corrective Petition, Order, Caption and Notice of which the following is a statement:
1, The original Petition for Rule for Judicial Sale which was filed on August
6,1998 initiated this action, The body of that Petition and the caption incorrectly
referred to the parcel number of the subject real estate as 23-32-2338-123, Instead, it
has now been diseovered that the correct parcel number is 23-32-2332-123. All
pleadings and notices heretofore have set forth the incorrect tax parcel number,
2. Following various Motions and Orders, and the inability to effect service
upon Daniel A, Garonzik, on or about June 9, 1999 the undersigned, Stephen D, Tiley,
filed a Motion for Second Revised Rule to Show Cause and Motion for Service
Pursuant to Special Order of Court by Publication and Regular Mail Pursuant to Pa.
R.C,P.430,
3. Pursuant to said to Motion, on June 15, 1999 the Court entered a Rule to
Show Cause why the property should not be sold freed and cleared of liens and
returnable on August 12, 1999,
4, Also on June 15, 1999 the Court entered an Order for Service of the Rule
to Show Cause by mail to Daniel A. Garonzik, c/o Richard C. Rupp, Esquire and to
Daniel A. Garonzik, c/o Jeffrey A, Garonzik and for service by publication.
5. On June 21, 1999 the undersigned, Stephen D. Tiley, filed a Certificate of
Service showing notice by United States Mail as required by the June 15, 1999 Order.
6. On August 18, 1999 Jacob L. Heisey, Director of the Cumberland County
Tax Claim Bureau filed his certificate of service showing notice by publication as
required by the June 15, 1999 Order.
7. At the Rule Returnable hearing on August 12,1999 neither Daniel A.
Garonzik, nor anyone representing him, appeared and the Court entered its Order
directing sale to be held on September 24, 1999 with notice of the sale to be
published once in two newspapers of general circulation and once in the Cumberland
Law Journal at least 30 days prior to the sale pursuant to 72 P.S.s5860.612(b).
8. As indicated in paragraph one (1) of this Motion the original Petition and
all pleadings and Notices heretofore set forth an incorrect tax parcel number.
However, the portion of Exhibit "A" attached to the original Petition which set forth the
title report mentioned at paragraph three (3) of the Petition and did correctly indicate a
tax lien for the correct tax parcel number and did correctly set forth the Deed Book and
Page as 32-F-416 and did indicate that tract one in that deed was 35.50 acres in the
Borough of Mt. Holly Springs although it also mentioned two other tracts from that
deed which are not the subject of this proceeding.
9. The original Petition also failed to have attached thereto a reduced copy
of the most recent deed for the subject premises, as stated at paragraph three (3) of
the Petition. A copy of that most recent deed for the subject premises, which is known
as Deed Book "F", Volume 32, Page 416, is attached hereto, marked Exhibit "A" and
incorporated herein by reference thereto.
1 O. The Notice of the Rule to Show Cause which was published pursuant to
the Court's Order of June 15, 1999 and the Notice of the September 24, 1999 sale
which was published pursuant to the Court's Order of August 12, 1999, while
containing the incorrect tax parcel number, did correctly indicate that the property was

35.50 acres, more or less, in Mt. Holly Springs, Pennsylvania and that it was tract
number one of Deed Book "F", Volume 32, Page 417.
11. The Tax Claim Bureau, the County and Stephen D, Tiley have not
received any return of the mailed envelopes nor have they received any contact from
Richard C. Rupp, Esquire, Jeffrey A. Garonzik or Daniel A. Garonzik or any other party
indicating that they act for Daniel A. Garonzik.
12. The incorrectly listed tax parcel number of 23-32-2338-123 does not exist
in Cumberland County.
13. The undersigned believes and therefore avers, that the error in the prior
caption and proceedings giving the incorrect parcel number has not impaired Daniel
A. Garonzik's notice that he has real estate which is subject to tax sale.

or reputedly owned prior to the Judicial Sale, by Daniel A. Garonzik, and consisting of
a tract of land containing approximately 35.5 acres, more or less, situate in the
Borough of Mount Holly Springs, Cumberland County, Pennsylvania. The property
was sold on December 7, 1999 by the Cumberland County Tax Claim Bureau
pursuant to the Court's Order of September 23, 1999 ordering and directing that the
property be sold to the highest bidder freed and cleared of all tax and municipal
claims, liens, mortgages, charges and estates, except separately taxed ground rents.
3. The said Order of September 23, 1999 directed that advertisement of
such sale be made by one insertion in two newspapers of general circulation in

Cumberland County and one insertion in the Cumberland Law Journal, all of which at
least thirty (30) days prior to the sale dale.
4. On September 24, 1999 Stephen D. Tiley filed a Certificate of Service
concerning service by mail upon Mabel R. Stetson and Daniel A. Garonzik. On
November 23, 1999 the Tax Claim Bureau filed a Certificate of Service showing that
publication of the sale was duly made at least 30 days prior to the sale date.
5. At the said Judicial Sale on December 7, 1999 the property of Daniel A.
Garonzik known as tax parcel number 23-32-2336-123 was sold for $16,953.18,
(including transfer tax and recording fees), a price in excess of the minimum bid
acceptable to the Tax Claim Bureau, to Suzanne G. White, of 319 Chestnut Street, Mt.
Holly Springs, PA 17065 and Stephen T. Blair of 775 Old Silver Spring Road,
Mechanicsburg, PA 17055, who paid said purchase price to the Tax Claim Bureau at
the time of sale,
6. After the sale, on December 21, 1999, Daniel A. Garonzik was mailed a
notice that the property had been sold, to the two addresses which the Bureau has for
Daniel A. Garonzik by restricted delivery mail, neither of which is expected to be
delivered and on January 5, 2000 Daniel A. Garonzik was mailed the same motions by
regular mail to him at the two addresses which the Bureau has for him, that being in
care of Attorney Richard C. Rupp in Camp Hill, Pennsyivania, and in care of Jeffrey A.
Garonzik in Warrenton, Virginia, as evidenced by the copies of Notice and receipts for
mailing attached hereto, marked Exhibit "A" incorporated herein by reference hereto.
The envelopes were sent by United States mail.

except for the following portion of 612(a) of the Real Estate Tax Sale Law:
Out of the proceeds of such sale shall be paid the costs set forth in the
upset price at the prior sale, and the additional costs incurred relative to this sale,
including the fee for title search.... The remainder of said proceeds shall be distributed
by the office designated by the county commissioners under section 205. After the
purchaser shall have paid over the purchase price, the bureau shall make and deliver
a deed in the manner herein-before provided.
72, P.S. 95860.612(a)(footnote omitted). The reference to Section 205 is, of course,
72, P.S. 95860.205. Your Petitioner, however, desires to proceed by a procedure
analogous to the Consolidated Return to Court Procedure set forth in 9607 or the Real
Estate Tax Sale Law (72 P.S. 95860.607), however the requirement of certified mail,
restricted delivery, return receipt requested for the post-sale notice to the prior owner,

published once in the Cumberland Law Journal, The Harrisburg Patriot News, and

that Petitioner further send a copy of this Petition and the Court's Confirmation Nisi to
Daniel A. Garonzik c/o Attorney Richard C. Rupp and c/o Jeffrey A. Garonzik, at their
addresses as shown in these proceedings, by United States mail, complete upon
mailing, irrespective of any return as undeliverable.
9. The Tax Claim Bureau, pursuant to other orders of Court also conducted
a JLldicial Sale on September 24, 1999 for which other Petitions for Confirmation Nisi
are now being fiied and the Tax Claim Bureau respectfully requests that any notice
required pursuant to this Petition be consolidated with the notice for the property sold
on September 24, 1999.

10. Attached as Exhibit "B" and incorporated herein by reference thereto is a
post-sale title bring down indicating no mortgages or liens on the subject property
except for tax liens.
11. Attached hereto as Exhibit "C" is a Schedule of Distribution of Sale
Proceeds showing the purchase price of $16,000 (net of transfer tax and recording
fees), the distribution of the consideration paid for the various taxes and the net
$4,028.82 due Daniel A. Garonzik.
12. Pursuant to 72 P .S. 95860,205(e) the Bureau requests that the Court
confirm the Schedule of Distribution attached hereto as Exhibit "C."
WHEREFORE the Bureau respectfully requests your Honorable Court to enter
a Order Confirmation Nisi in accordance with this Petition and requests your
Honorable Court to enter a Rule to Show Cause why the Schedule of Distribution
attached hereto as Exhibit "C" should not be confirmed.
