In that case, the Court held that: In order to recovcr damages lor allcgcdly unconstitutional conviction or conviction or imprisonment, 01' lor othcr harm caused by actions whose unlawfulness would render a conviction or scntence invalid, a * 1983 plaintifT must prove that the conviction or sentence Ims been revcrsed on direct appeal, expunged by executive order, declared invalid by a state tribunal authorized to make such determination or called into question by a federal court's issuance ofa writ oflJabcas corpus, 28 V.S.C. * 2254, A claim for damages bearing that relationship to conviction or sentence that has not been so invalidated is not cognizable under S 1983... Hecht, 512 U.S. at 486,487,114 S.Ct. at 2367,129 L.Ed, 2d at 394. See also, Zolicoffer v. FBI, F,Supp. 173 (M.D.Pa, 1995). If the allegations contained in litigation asserted by a state prisoner under * 1983 would necessarily imply the invalidity of a conviction, the complaint must be dismissed unless the plaintiff can demonstrate that the conviction has already been invalidated, The defendant, here, is clearly raising issues that implicate the validity of his conviction. However, he remains in custody as a result of the criminal prosecution that underlies his civil complaint. The criminal conviction has not been reversed, expunged or declared invalid, Rather, the damages sought by plaintiff are the damages arising out of his current incarceration. To the extent that the allegations contained in the complaint purport to assert a cause of action based on actions whose unlawfulness would render the underlying conviction invalid, such a collateral attack on the criminal conviction is insufficient, as a matter of law, to state a claim under 42 U,S,C. S 1983. Accordingly, even if the allegations of the complaint are accepted as true, the plaintiff's cOlllplaint fails to set forth a cause of action upon which relief can be granted.
