1. Plaintiff is a non-profit corporation located at the address indicated in the caption hereof.
2. Defendant is an individual who resides at the address indicated in the caption hereof.
3. As the result of a certain medical condition, defendant was treated at the plaintiff hospital on
August 30, 1994 through September 6, 1994.
4. The amounts, quantitie~ and nature of said medical care, the dates on which said medical care
was rendered, and the charges therefore are set forth in Exhibit "A" which is incorporated herein as if
set forth at length.
5. Said medical care was commensurate with the condition of defendant and was necessary for
the health and welfare of defendant.
6. At or about the time of defendant's admission to plaintiff hospital, implied, constructive and
oral contracts arose between defendant and plaintiff by the terms of which defendant became obligated
to pay plaintiff the charges for the medical care rendered by plaintiff to defendant.
7. Defendant refuses to pay the balance due although plaintiff has made demand that defendant
do so.
8. As a result of the foregoing, there is due and owing from defendant to plaintiff the sum
indicated in Exhibit "A".
WHEREFORE, plaintiff demands judgment against defendant for the sum of $25,479.35 plus six
percent (6%) interest per annum from the date of discharge to the date of judgmant, record costs and non-
record costs.

11. At all times material hereto, defendant wes the natural parent of Benjamin Cohen.
12. As a result of a certain medical condition, Benjamin Cohen was admitted to the plaintiff
hospital from August 30, 1994 through September 6, 1994.
13. The amounts, quantities and nature of the medical care rendered, the dates on which said
medical care was rendered, and the charges therefore are set forth in Exhibit "A" which is incorporated
herein as if set forth at length.
14. Said medical care was commensurate with the condition of defendant's child and was
necessary for the health and welfare of defendant's child.
15. At or about the time of defendant's child's admission to the plaintiff hospital, implied,

16. Defendant's child is indigent.
17. Defendant is financially able to pay for the medical care of the child.
18. By virtue of the Act of 1937, June 24, P.L. 2045, §3, as amended, 62 Pa. Cons. Stat. Ann.
§1973 and all other applicable statutes, laws, and ordinances, defendant has a duty to support defendant's
child.
19. Defendant has been unjustly enriched by plaintiff's discharge of defendant's duty to support
defendant's child, which duty, defendant failed to perform.

AND NOW comes the Defendant, Donald Cohen, by and through
his attorneys, Friedman & Friedman, P. C., and avers as follows:
1. Admitted.
2. Defendant, Donald Cohen, is unaware of the address of
Benjamin Cohen.
3. Admitted.
4. Defendant, Donald Cohen, is uncertain as to the fair
value of the services rendered as set forth in Exhibit A, and
proof thereof is therefore demanded at trial.
5. It is denied that said medical care was commensurate
with the condition of Defendant and was necessary for the health
and welfare of Defendant. Moreover, it is averred that medical
care was cosmetic and was not necessary for Defendant, Benjamin
Cohen's, health or welfare.
6. Denied as a conclusion of law. To the extent an answer
is required, Defendant, Donald Cohen, never agreed to be
responsible for the charges of Defendant, Benjamin Cohen.
Moreover, verbal guarantees are not enforceable as being
violative of the statute of frauds.

favor and against Plaintiff.

care was cosmetic and was not necessary for Defendant, Benjamin
Cohen's, health or welfare.
15. It is denied that Defendant, Donald Cohen, agreed to or
became obligated to pay Plaintiff's charges. It is further
averred that a verbal agreement to guarantee payment would be
violative of the statute of frauds.
16. It is denied that Defendant's child is indigent.
Moreover, it is denied that Defendant's child was indigent at the
time services were performed. Moreover, it is averred that
Benjamin Cohen was a student at the University of Delaware and
was working for Student Services at all times material to the
complaint.
17. Denied. Moreover, it is averred that it is irrelevant
as to whether or not Defendant, Donald Cohen, is financially able
to pay for the medical care of his child.
18. Denied as a conclusion of law. To the extent an answer
is required, it is denied that Defendant had a duty to support
his child, who at the time of surgery was 19 years of age, was a
student at the University of Delaware, and was working in Student
Services.
19. Denied as a conclusion of law. Moreover, it is averred
that Defendant Cohen had no duty to support his child, who was
emancipated at the time the surgery was performed.
20. Admitted.
21. Denied. Moreover, it is averred that there is no duty
from Defendant, Donald Cohen, to Plaintiff.
WHEREFORE, Defendant, Donald Cohen, demands judgment in his
favor and against Plaintiff.
22. The averments contained in paragraphs 1 through 21 of
the New Matter are incorporated herein by reference.
23. Prior to services being rendered by Plaintiff,
admissions personnel who were agents, servants and employees of
Plaintiff received verbal approval from Prudential Insurance
Company of America, Defendant, Donald Cohen's, insurance carrier,
to perform said surgery, and were advised that payment for
services would be fully covered by insurance.
24. Defendants relied upon the assurances of Plaintiff's
personnel, prior to performance of services, that Defendants
would not be individually billed. Therefore, Plaintiff is
equitably estopped from a claim against either Defendant.
WHEREFORE, Defendant, Donald Cohen, demands judgment in his
favor and against Plaintiff.

servants, employees, received verbal approval from Prudential Insurance Company before the
services were performed on Benjamin Cohen.
24. Denied. It is specifically denied that the defendants relied upon assurances from
plaintiff's personnel that the services would be paid by alleged insurance company and that the
defendants would not be billed for these services. It is further denied that plaintiff is equitably

came to plaintiff's facility for treatment. Those services were provided. Plaintiff is entitled to

2. A copy ofthe Notice oflntention to Take Default Judgment was mailed to defendant
Benjamin Cohen at 25-26 18~ Street, #2R, Astoria, NY 11102, via regular mail and certified mail,
first-class, postage prepaid, on March 31, 2000. The regular mail was not returned. The certified
mail was returned "Unclaimed" and marked with the address of 39-47 59~ Street, Woodside, NY
11377. Copies of the Notice and the returned mail are attached and marked as Exhibit "B."

3. A copy of the Notice of Intention to Take Default was then mailed to defendant
Benjamin Cohen at 39-47 59~ Street, Woodside, NY 11377, via regular mail and certified mail,

therefore demands specific proof thereof.

determined to be factual, Defendant demands specific proof thereof.
