IN RE: PRETRIAL CONFERENCE
A pretrial conference in the above-captioned cases was
held in the chambers of Judge Oler on Tuesday, December 21, 2004.
Present on behalf of Additional Defendant Carlisle County Club was
Guy H. Brooks, Esquire, present on behalf of Defendant Jeremy Bull
and Intervenor General Accident InsuranCe Company was Donald B.
Hoyt, Esquire.
At this time the action being 1-~_tigated is a claim for
contribution on the part of the Defendant, third-party tortfeasor,
from Additional Defendant Carlisle Country Club, with liability
being predicated on a violation of the Dram Shop Act. Defenses
include the contention that the Dram Shop Act was not violated by
the Additional Defendant, and the contention that the settlement
agreement between the Plaintiffs and Defendant Jeremy Bull and
Intervenor General Accident Insurance Company was not a reasonable
one.
This will be a jury trial in which, pursuant to an
agreement of counsel, each side will have four peremptory
challenges for a total of eight. The estimated duration of trial
is five days.
By separate order of Court of even date herewith a
Motion To Bifurcate filed on behalf of Additional Defendant
Carlisle Country Club will be ~denied.
In addition, by separate order of Court, a motion
filed by the Additional Defendant to preclude Attorney Hoyt from
trying the case will be denied. In the latter respect, it is noted
that neither counsel desired to present evidentiary material on
this issue and both were satisfied to rely on the motion and answer
for purposes of disposition by the Court.
With respect to settlement negotiations, it does not
appear to the Court that it is likely that this matter will be
settled without a trial.

trying the case will be denied. In the latter respect, it is noted
that neither ceunsel desired te present evidentiary material en
this issue and both were satisfied te rely on the metien and answer
for purposes ef dispesition by the Ceurt.
With respect te settlement negotiatiens, it dees not
appear to the Court that it is likely that this matter will be
settled without a trial.

IN RE: PRETRIAL CONFERENCE
A pretrial conference in the above-captioned cases was
held in the chambers of Judge Oler on Tuesday, December 21, 2004.
Present on behalf of Additional Defendant Carlisle County Club was
Guy H. Brooks, Esquire, present on behalf of Defendant Jeremy Bull
and Intervenor General Accident InsuranCe Company was Donald B.
Hoyt, Esquire.
At this time the action being litigated is a claim for
contribution on the part of the Defendant, tlhird-party tortfeasor,
from Additional Defendant Carlisle Country Club, with liability
being predicated on a violation of the Dram Shop Act. Defenses
include the contention that the Dram Shop Ac~: was not violated by
the Additional Defendant, and the contention that the settlement
agreement between the Plaintiffs and Defendant Jeremy Bull and
Intervenor General Accident Insurance Company was not a reasonable
one.
This will be a jury trial in which, pursuant to an
agreement of counsel, each side will have four peremptory
challenges for a total of eight. The estimated duration of trial
is five days.
By separate order of Court of even date herewith a
Motion To Bifurcate filed on behalf of Additional Defendant
Carlisle Country Club will be denied.
In addition, by separate order of Court, a motion
filed by the Additional Defendant to preclude Attorney Hoyt from
trying the case will be denied. In the latter respect, it is noted
that neither counsel desired to present evidentiary material on
this issue and both were satisfied to rely on the motion and answer
for purposes of disposition by the Court.
With respect to settlement negotiations, it does not
appear to the Court that it is likely that this matter will be
settled without a trial.
