AND NOW comes the Defendant, Loren K. Stare, by and through her attorney, Jeanne B.
Costopoulos, Esquire, and pursuant to Pa. R.c.P. 91915.8 avers as follows:
1. Petitioner is Loren K. Stare, Defendant above, hereinafter referred to as Mother,
2. Respondent is David A. Parkhill, Plaintiff above, hereinafter referred to as Father.
3. The parties are divorced from each other and are the parents oftwo children,
namely David Max Parkhill, born September 27, 1991 and Madison Rose
Parkhill, born September 14,1992.
4. The parties had been subject to prior Orders of Court dated August 22, 2000 and
May 22, 2001. On June 22, 2004 at custody conciliation conference was held before
Dawn Sunday, Esquire, at which time Mother agreed on a trial basis to transfer
custody of David Max Parkhill to Father. Custody of Madison Rose Parkhill
remained with Mother. The parties also agreed to re-conciliate before Dawn Sunday
on January 18, 2005 to review the schedule and address holidays and summer for
2005, The agreed upon order is dated July 6, 2004 and is attached hereto as Exhibit
A.
5. Soon after the July 6, 2004 Order was entered, Mother realized that she had made a
mistake by agreeing to transfer custody of her son to Father. The child immediately
began to have behavioral problems, Father often left the child unsupervised, Father
neglected to obtain medical attention for the child when needed and ignored the
medical advice of the child's doctors when given.
6. The case was not resolved through the conciliation process and will soon be
scheduled for a full custody hearing.
7. Mother avers that a court-ordered psychological custody evaluation would assist the
court in determining custody arrangements providing for the best interest of David
Max Parkhill.
8. Mother requested an evaluation at the January 18, 2005 custody conference, but
Father adamantly opposed the evaluation.
9. Mother avers that Father is only opposing the evaluation because he fears the
outcome of the evaluation would result in him not only losing primary custody of
his son but could also result in a recommendation that he personally seek counseling
or that he attend co-parenting counseling with Mother.
WHEREFORE, Mother respectfully requests that, pursuant to Pa. R.C.P. 1915.8, this Court
enter an order directing the parties to submit to a custody evaluation to be conducted by Arnold T.
Shienvold, Ph.D, or whomever the Court deems appropriate, and directing same to deliver to the
court and to the attorneys of record copies of a detailed written report setting forth the findings,
results of all tests made, diagnosis and conclusions. Mother further requests the costs of said
evaluation to be equally divided between the parties.

custody of David Max Parkhill, born September 27,1991, and of Madison Rose Parkhill, born
September 14, 1992. Each parent shall have an equal right, to be exercised jointly with the other
parent, to make all major non-emergency decisions affecting the Children's general well-being
including, but not limited to, all decisions regarding their health, education and religion. Pursuant to
the terms ofthisparagraph each parent shall be entitled to all records and information pertaining to the
Children including, but not limited to, school and medical records and information. Both parties shall
cooperate in exchanging all medical and school related information and schedules concerning the
Child in his or her primary custody. The parties shall sign any authorizations or releases necessary to
enable the other parent to obtain information regarding the Children. Both parties shall have access to
all the Children's school activities or sporting events. The parties agree to cooperate generally in
ensuring that the other parent is informed of all significant information concerning the Children's
school, medical, social and emotional development.
3. During the summer school vacation in 2004, the parties shall share having physical custody
of the Children on an alternating biweekly schedule, The Mother shall have custody of the Children
for the first two week period and the Father's first two week period shall begin at noon on the third
Sunday after the school year ends and end at noon two weeks later.
4. During each school year, beginning with the 2004-2005 school year, the parties shall have
physical custody ofthe Children as follows:
A. The Mother shall have primary physical custody of Madison and custody of both Children
for three weekends out of every four weekends from Friday through Sunday.

B. The Father shall have primary physical custody of Max and physical custody of both
Children for one weekend out of every four weekends from Friday through Sunday. During the
Mother's weekends when the Father is transporting Max to the Mother's residence, the Father
shall have custody of both Children for two hours over dinnertime. In addition, the Father shall
have custody of Madison for one evening per week, during which time the Mother shall have
custody of Max, for which the Father shall transport Max to the Mother's residence,
C, The transfer of primary custody of Max to the Father shall take place at the beginning of the
2004-2005 school year and the weekend custody schedule shall begin with the Mother having
custody of both Children on the first weekend after the first day of school.
5. The parties shall have custody ofthe children for holidays in 2004 as follows:
A. Christmas: The Mother shall have custody of both Children from the end of school prior to
the holiday through Christmas Day at 2:00 p.m., the Father shall have custody ofboth Children
from Christmas Day at 2:00 p.m. through December 29th at 6:00 f.m., and the Mother shall
have custody from December 29 at 6:00 p.m. through January 2" at 5:00 p.m., when the Father
shall obtain custody of Max for resumption of the school year schedule.
B. Thanksgiving: The Father shall have custody of both Children from the Wednesday before
Thanksgiving at 6:00 p.m. through the following Friday at 5:00 p.m.
C. The holiday custody schedule shall supercede and take precedence over the regular custody
schedule.
6. Unlesslotherwise agreed between the parties, the Father shall provide all transportation for
exchanges of custody.
7. During both parties' periods of custody, both Children shall have separate sleeping
accommodations in separafe rooms from other individuals.
8. The parties and counsel shall attend an additional custody conciliation conference in the
office of the conciliator, Dawn S. Sunday, on Tuesday, January 18, 2005 at 8:30 a.m. for the purpose
of reviewing the regular custody schedule and establishing arrangements for custody during holidays
and the summer school break in 2005.
9. This Order is entered pursuant to an agreement of the parties at a custody conciliation
conference. The parties may modify the provisions of this Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.

AND NOW comes the Defendant, Loren K. Stare, by and through her attorney, Jeanne B.
Costopoulos, Esquire, and files the following Motion to Make Rule Absolute, respectfully
representing as follows;
1, Petitioner, hereinafter referred to as Mother, is the Defendant in the above-
captioned divorce action.
2. Respondent, hereinafter referred to as Father, is the Plaintiff in the above-
captioned divorce action.
3. Mother filed Defendant's Petition for Custody Evaluation Pursuant to PaR.C.P,
~1915.8 on February 3, 2005, Said Petition is incorporated herein by reference as
though fully set forth.
4. On February 11,2005, the Honorable Edgar B. Bayley issued a rule against Father
to show cause why Mother's petition for a custody evaluation should not be
granted. The rule was returnable seven (7) days from service. See Exhibit A.
5. Undersigned counsel served said rule on Scott A. Stein, Esquire, counsel for
Father, via certified mail no. 7000 15300001 60020520 on February 17,2005,
See Exhibit B - Affidavit of Service with original return receipt.

6. Father has failed to file a response to the Rule to Show Cause and more than
seven (7) days have elapsed since service thereof on Father's attorney of record.
WHEREFORE, Mother respectfully requests as indicated in her petition filed previously
that, pursuant to Pa. R.C.P. 1915.8, this Court enter an order directing the parties to submit to a
custody evaluation, the costs divided equally between the parties, to be conducted by Arnold T.
Shienvold, Ph.D., and directing same to deliver to the court and to the attorneys of record copies
of a detailed written report setting forth the findings, results of all tests made, diagnosis and
conclusions.
