In the Court of Common Pleas County of Cumberland Pennsylvania Number03--//~ Term, 2003 Barlup and Andrea L. Barlup, his wife, of Cumberland County, Pennsylvania is about to execute contemporaneously herewith, a contract, with Haubert Homes Inc., of 15 CENTRAL BLVD, CAMP HILL, PA 17011 for the erection of a two story colonial frame dwelling upon a lot of land situate at 607 A. Street, Summerdale, PA 17093, bounded and described as follows, to wit: Being Lot No. 3 on the Final Subdivision Plan recorded in Plan Book 85, Page 18 in the Office of the Recorder of Deeds, Cumberland County. BEING the same property which Paul E. Lynes and Sara J. Lynes, his wife, by their deed dated May 29, 2002, and recorded in the Cumberland County Recorder of Deeds office in Book 251, Page 4648, have granted and conveyed to Jeffery A. Barlup and Andrea L. Barlup, his wife. NOW, March ~ ~, 2003 at the time of and immediately before the execution of the principal contract, and before any authority has been given bY the said OWNER to the said CONTRACTOR to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with OWNER and the further consideration of One Dollar, to CONTRACTOR paid by OWNER it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
