The Commonwealth of Pennsylvania, Department of Transportation, Bureau of Driver
Licensing (Department), by and through its attorney, George H. Kabusk, Esquire, respectfully
represents as follows:
I, By official notice dated August 26, 1998, the Department of Transportation, Bureau of
Driver Licensing, notified Adoracion Barrios, that her operating privilege was being
recalled indefinitely pursuant to Section 1519( c) of the Vehicle Code as a result of the
Department having received medical information that indicated that she had a medical
condition which prevented her from safely operating a motor vehicle. Additionally, the
notice informed the petitioner that the recall was indefinite and that the action would
remain in effect until the Department received medical information that indicated that her
condition has improved and that she could safely operate a motor vehicle.
2. The petitioner, Adoracion Barrios, Pro Se, filed an appeal of the above-mentioned recall
on or about September 22, 1998, in the Court of Common Pleas of Cumberland County.
3, No supersedeas was issued in this matter,
4. A hearing in this matter was scheduled for December 7,1998.
5. At the hearing, the petitioner submitted medical documentation,
6, The Court allowed the Department's medical unit to review the submitted documentation.
7. The Department by letter dated February I, 1999, provided the petitioner with an
authorization letter to take a driving examination. See exhibit number I.
8. By Order dated February 3, 1999, the matter was continued generally.
9. The petitioner took and successfully passed the requested driving examination.
10, As a result of the petitioner submitting medical documentation and successfully passing
the driving examination, the Department restored the petitioner's operating privilege on
May 6, 1999. See exhibit number 2,
WHEREFORE, the Department respectfully requests that the matter be dismissed as
Moot as the petitioner has compiled with the Department's requirements which were imposed as
a result of the medical recall at issue in this appeal.

Dear Mrs. Barrios:
I am writing to you in regard to the Department's recall of your operating privilege. The
Department, by notice dated and mailed August 26, 1998, recalled your operating privilege
indefinitely effective September 30, 1998, as a result of the Department receiving medical
information indicating that you have a Neuropsychiatric condition preventing you from safely
operating a motor vehicle, The Department's recall pursuant to section 1519 of the Vehicle Code
is indefinite until the Department receives medical information indicating that you successfully
complied with the Department's medical standards.
After the notice of recall, you contacted the Department requesting what you must do to
have your driving privilege restored. The Department sent you a letter along with the General
Psychlatric Form to be completed by your physician and returned to the Bureau. You had the
form completed and enclosed a copy with your appeal. The Department did not indicate to
whether the completed form was acceptable,
You appealed that notice of recall to the Court of Common Pleas of Cumberland County.
A hearing was held on December 7, 1998. The Judge reserved his ruling until the Department
reviewed the General Psychiatric Form.
The form you submitted by Dr. Robin Miller indicates that you have been treated for
vascular dementia. The Department has concerns about equivocal and contradictory nature of the
information submitted by Dr. Miller. The condition which you have does affect a person's ability
to safely operate a motor vehicle although your physician indicates on the form that he considers
you physically and/or mentally competent to operate a motor vehicle although he qualifies it by
stating that you do not drive on the freeway, do not drive long distances, and travel only to
church and shopping. Moreover, the drugs which you are being treated with carry precautions

that the drugs may interfere with the safe operation of an automobile. The Medical Unit of the
Bureau of Driver Licensing made numerous attempts to contact Dr. Miller, the physician who
completed the General Psychiatric Form. Dr. Miller has not replied or nor cooperated with the
Department.
The Department does not issue conditional licenses, Either a person is competent to drive
or not competent to drive. You must meet the minimum driver qualifications even if you do not
drive on "freeways."
The pepartment will accept the medical report as satisfactory after you take and
successfully complete a driver's test. I am supplying you with a letter for you to take such a test.
If you can successfully pass the test, then the Department will restore your operating privilege.
In regard to your appeal in the Court of Common Pleas, if your appeal of the recall would
be sustained then the Department's recall of your operating privilege would be reversed and the
Department would then reinstate your operating privilege. If your appeal of the recall would be
dismissed then the Department's recall of your operating privilege would be sustained and the
Department would continue to recall your operating privilege. Any appeal from the Court of
Common Pleas would be with the Commonwealth Court. A third possibility is that the court
may issue an order that you be re-examined and re-tested pursuant to 75 Pa. C.S. l5l4(c).
If your appeal is dismissed and the Department's recall is sustained, then the recall of
your operating privilege remains in effect indefinitely until the Department's receives
unequivocal medical information that your condition has improved and that you are able to safely
operate a motor vehicle. While your operating privilege is recalled you may have your physician
submit medical information indicating that you are competent to operate a motor vehicle. The
Department will then send you correspondence indicating whether the medical information
indicates you are competent to operate a motor vehicle. You may have your physician submit the
information as often as you like. If your physician submits medical information which you
believe complies with the Department's medical requirements but the Department does not
rescind the recall, then you may appeal that determination. Such an appeal would not be to the
Court of Common Pleas but would be with the Department in the Administrative Hearing
process. The hearing would be ill front of the Department Hearing Officer. From the
detennination made by the Department Hearing Officer, a party could file exceptions to the
Secretary of Transportation and from that a party may appeal to the Commonwealth Court.

Dear Ms. ADORAClON BARRIOS:
Information submitted to the Department indicates that you may have a Neuropsychiatric
condition that could affectllimit your ability to drive. In order to determine if you meet the
Department's medical standards for driving, it is necessary that you take a driving examination.
This examination must be conducted by a Driver License Examiner at any Driver License Center.
You may obtain a copy of the Pennsylvania Driver's Manual at any Driver License Center.
Please be aware of the following:
I. You must schedule an appointment to take the test. If you want to take the test at any of the
Driver License Centers located in the greater Philadelphia area, you should call 1-800-932-4600.
If you want to take it at any other center, you should contact that center for an appointment.
Check the blue pages of your telephone directory under Transportation for the telephone number.
2. When you take the test, please bring this notice and a valid insurance card and registration
card for the car you will be using for the test.
3. Your exam will include a vision screening, a test of your knowledge of rules of the road, and
on-road driving.
4. This letter will allow you three opportunities to take the test. If you take the test and fail, you
will not be retested on the same day.
5. If your driving privilege is suspended, recalled, or expired, this letter authorizes you to drive
only during the course of the test. When reporting for the exam, you must be accompanied by a
licensed driver.

If you fail to comply with this request within 30 days from the date of this letter, your driving
privilege will be suspended.
