consideration of the attached Custody Conciliation Repot it is ordered and directed as follows:
1. The parties shall make arrangements to engage in therapeutic family counseling to address
the conflicts which have arisen within the family that are adversely affecting the Children. The parties
shall select the counselor by communicating directly between themselves and contact the counselor's
office within 10 days of the custody conciliation conference to schedule the initial session. The parties
shall follow the recommendations of the counselor with respect to the timing of involvement of the
Children in counseling and the participants in each counseling session. All unreimbursed costs of
counseling shall be shared equally between the parties.
2. Temporarily pending the parties' participation in counseling and a follow-up conciliation
conference scheduled pursuant to this Order or further agreement of the parties, the parties shall share
having physical custody of the Children on an alternating weekly basis beginning with the Mother
having custody on Sunday, September 12, 2010 at 7:00 p.m. Thereafter, the exchanges shall take place
every Sunday at 7:00 p.m. with the Father transporting the Children to the Mother's residence at the
beginning of her periods of custody and the Mother transporting the Children to the Father's residence
at the beginning of his periods of custody. The Father shall have custody of the Children from October
15 through the following week which is his regular period of custody as the Mother will be unavailable
on October 15 and 16.
3. After the parties have participated in a minimum of four joint counseling sessions, either
party may contact the conciliator to schedule a follow-up custody conciliation conference if necessary
to address the custodial schedule.
4. In all other respects, the prior Order of this Court dated March 15, 2000 shall continue in
effect.
5. This Order is entered pursuant to an agreement of the parties at a custody conciliation
conference. The provisions of this Order may be modified by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.

Mother filed a Petition for Contempt as the Father had assumed custody of the Children contrary to the
March 15, 2000 Order providing for the Mother to have primary custody. Both petitions were
addressed at the conciliation conference.

1. A hearing is scheduled in Courtroom Number 5 of the Cumberland County Courthouse on

2. A follow-up custody conciliation conference was held on November 15, 2010, at the
request of the Father following the counseling to which the parties agreed at the last conciliation
conference. The following individuals were in attendance: the Father, Scott Weidman, and the Mother,
Christine Markley. Neither party is represented by counsel in this matter.
3. The Father initially filed this Petition to Modify seeking primary physical custody of the
Children. At the conciliation conference on September 7, 2010, the parties agreed to attempt to resolve
the conflicts through counseling rather than court at that time. Since the September conciliation
conference, the parties participated in four counseling sessions with Edward Horan and the Children
participated in one session with the counselor. Despite the information and guidance received through
counseling, the parties were unable to reach an agreement as to ongoing custodial arrangements for the
Children and it will be necessary to schedule a hearing.
4. The Father's position on custody is as follows: The Father stated that both Children have
asked to live primarily with the Father and that the Children's reasons vary. The Father noted that the
Mother has had primary physical custody of the Children for a substantial period of time and believes
that the Children have reached the age where they prefer to be with their Father. The Father believes

that the Children are mature enough to make the custodial decision for themselves and also that he is
the appropriate parent to provide the primary care at this time. The Father proposed that the Custody
Order dated March 15, 2000 be changed so that the Father has the Mother's primary custody schedule
and the Mother has the Father's alternating weekend partial custody schedule.
5. The Mother's position on custody is as follows: The Mother stated that she does not doubt
that the boys prefer to live with the Father at this time. However, the Mother does not believe that
their preference would serve their best interests and needs at this time. The Mother alleged that the
Father does not have sufficient rules and supervision in his household. The Mother believes that the
Children want to reside with the Father to avoid the more stringent rules in her household. The Mother
stated that while she was agreeable to continuing the alternating weekly schedule which was initiated
at the conciliation conference in September, 2010, she was not willing to relinquish more than half of
the time with the Children in light of her history of being the primary custodian.
6. The conciliator recommends an Order in the form as attached scheduling a hearing in this
matter and continuing the existing shared physical custody schedule pending the hearing. It is
anticipated that the hearing will require up to one-half day. Neither party intends to obtain legal
representation for the hearing. It should be noted that the parties' older son, Kyle, will no longer be a
minor and therefore subject to these proceedings, by the date of the hearing schedule in the proposed
Order.

ORDER OF COURT
AND NOW, this 7th day of January, 2011, following a
hearing on this matter, which included the testimony of the
parties and their children, Kyle, date of birth, January 6,
1993, and Chayton, date of birth, August 23, 1995, and also the
testimony of Mr. Marlin Markley, the Court finds that it is in
the best interest of the minor child, Chayton, that Mr. Weidman,
hereafter father, be the primary custodian, and therefore the
Court enters the following order:
1. The parties shall share legal custody of their
minor child, Chayton.
2. Father shall have primary physical custody of
Chayton subject to liberal periods of partial custody by mother,
which shall include, at a minimum, every other weekend from
Friday after school, or at the earliest time that is convenient
to both parties, until Sunday evening at 7:00 p.m.
3. The parties shall alternate major holidays.
4. Mother is entitled to three nonconsecutive weeks
of summer vacation with Chayton. She shall provide father with
advanced notice as to when she intends to exercise these periods
of summer vacation. Father is encouraged to permit such other
times during the summer vacation and any other school holidays
to encourage Chayton's contact with the mother.
5. Chayton will be with mother on Mother's Day and
with father on Father's Day at times that. are convenient to the
parties.
6. The parties are free to amend this order by mutual
agreement in any fashion that they deem appropriate. However,
if they cannot reach a mutual agreement, the terms of this order
shall control.
