ACTION
1. The Plaintiff is PROVIDIAN NATIONAL BANK, a national banking
association located in Tilton, New Hampshire.
2. The Defendant is Dennis G. Deitch, an individual with a place
of residence located at 136 Greason Rd., Carlisle, PA 17013-9469.
3. At the request of the Defendant, First Union Direct Bank, N.A.
issued to Defendant a credit account. The account number now is
5497485001969817 and at all times relevant hereto, Defendant was the
holder of said credit account issued through First Union Direct Bank,
N.A., credit facilities.
4. Subsequent to the delivery of the First Union credit account to
the Defendant, and therein acceptance of same, First Union Direct Bank,
N.A., for valuable consideration and in the normal course of business,
sold, assigned and transferred the Defendant's account to Plaintiff,
which is now and has been since the date of the assignment, the legal
owner and holder of said agreement.
5. Defendant, upon acceptance of the credit account, agreed to be
bound by the terms and conditions of the credit account agreement. A
true and correct copy of said terms and conditions is attached hereto,
made a part hereof and marked Exhibit "A."

G. The Defendant incurred obligations on the account in the sum of
$1,854.00, no part of which has been paid since 14 JUL 1998 although
duly demanded.
7. Notwithstanding the frequent demands by Plaintiff for payment
of the amount due, there has been a failure and refusal by the
Defendant to pay the same or any part thereof.
8. In accordance with the terms of Exhibit "A," Defendant agreed
to pay a finance charge on all sums due at an annual percentage rate of
21.90%, and Plaintiff is entitled to additional finance charges from 15
JUL 1998.
9. In accordance with the terms of Exhibit "A," Defendant
to pay reasonable attorney's fees if the account was referred
attorney for collection, and Plaintiff will incur an attorney's

WHEREFORE, Plaintiff demands judgment against the Defendant in the
