WHi:REAS, 011 September ;\0, 1998 ,Owller alld Conlmclor ente"ed illto all agreemellt
for the above-referellced I'rojecl, which is located on the parcel of property set fOllrth on
Exhibit "A" attached hereto CIhe "Premises"); alld
WHEREAS, in considemtion for the wnlmct, Owner has reqllired Contractor to waive
any claim which it has or may acqllire, on behalf of itself, its sllbcontractors, and sllppliers,
with regard to the I'roject.
NOW THEREFORE, ContractOl' agrees as follows:
I) Neither COli tractor nor any of its sllbeonlmctors or sllppliel's shall file any Mechanic's Lien
against the Project 01' against the Premises on accollnt of Ihe performance of any labor or
the fllrnishing of any materials with regard 10 the Project,
2) Contractor shall inform all sllbcontractors and material sllppliers with regard to the Project
that Contractor has waived any rights which they may have to file a lien against the Project
or the Premises,
3) This agreemenl is an independenl eovenanl, and shall opemte and be effective regardless of
Owne"'s performance unde,' the contmct. I'urthermore, Ihis Agreemeut shall extend to and
be effective with regard to any supplemenlal contract for extm work to be performed
relalive to the Projecl,
4) In orde"to fully proteclthe Owner and the Premises againsl any Mechanic's Lien claim
which may be filed by Contmcto,' or its subcontractor or supplier in violation of the
covenants contained herein, Contractor, for itself, its subconlmctor, and suppliers, hereby
irrevocably authorize and empowers any attorney of any eOlll't of record in and for the
Commonwealth of Pennsylvania to appear for it, them, and any of them in any of the
Courts of Common Pleas of the Commonwealth of Pennsylvania as Attorney for it, them, or
any of them and, in the name of any c1aimanl who files a lien against the Project or the
Premises, mark "Satisfied" any such lien at the cost and expense of the Contractor and of
5) any such Mechanic's Lien claimant. For such action, this instrllment or a true and correct
copy hereof shall be sufficient warrant. This warrant of attol'lley shall not be exhausted by

ALL THAT CERTAIN tract of land situate parUy in the Borough of Meehanicsburg
and partly in Hampden Township, Cumberland County, Pennsylvania, more panicularly
bounded and described as follows:
BEGINNING at a point in the center line of Brandy Lane marked by a railroad spike.
which point is 2,060,32 feet from the intersection of the center lines of Brandy Lane and
Berkshire Lane as measured along the center line of Brandy' Lane on a course South 43
degrees 46 minutes West; thence in the center line of said Brandy Lane South 43 degrees 46
minutes West 648,91 feet to a bolt in line of land now or late of Joseph M, Herron; thence
along said last mentioned land Nonh 46 degrees 20 minutes West 456,84 feet to a railroad
spike in the center line of a public road known as Old Silver Spring Road, also known as Old
Legislative Route No, 21051: thence in the center line of said Old Silver Spring Road North
30 degrees 20 minutes West 833,61 feet to a railroad spike; thence along other land of
Harrisburg Area Industrial Development Corporation of which this described tract was
formerly a part, North 59 degrees 40 minutes East 750 feet to a concrete monument; thence
