actions done with the expressed and or apparent authority of the
Defendant.
4. During the period of January 1995 through November 1997,
Plaintiff at the request of the defendant provided goods and
services to Rite Aid Corporation. The Defendant accepted these
goods without complaint over this two-three year period. Plaintiff
at Defendant's request provided said goods and services but
Defendant after any setoff, has failed to pay the balance of the
bill in full. ~1 Outstanding balance on the account exists of ONE
HUNDRED AND SIXTY TWO THOUSAND SEVEN HUNDRED AND EIGHTY-FOUR
DOLLARS and ninety-eight cents ($162,784.98).
5. The goods and services provided were billed and invoiced
regularly to the Defendant. Attached hereto is a true and correct
copy of said Ledger and open invoices marked exhibit "Au through
"B" respectively.
6. All goods and services were provided timely and in a
workmanlike manner without complaint to the Plaintiff. The total
cost outstanding as of today with interest of $29,301.29 is ONE
HUNDRED AND NINETY TWO THOUSAND AND EIGHTY-SIX DOLLARS and twenty-
seven cents ($192,086.27).
7. Plaintiff after numerous requests to Defendant to pay
this outstanding amount continues to be frustrated and the sums
owed continue to be outstanding and accruing interest.
8. All charges for goods and services provided were fair
and reasonable and in compliance with the parties agreement and
understanding.
WHEREFORE, Plaintiff, respectfully request this Honorable Court to
