1. The Plaintiff is PROVIDIAN N~rIONAL BANK, a national
banking association, located in Tilton, New Hampshire.

4. At the request of the Defendants, First Union Direct
Bank, N.A" issued to Defendants a credit account. The account
number now is 5497485001236290 and at all times relevant hereto,
Defendants were the holders of said credit account issued through
First Union Direct Bank, N.A., credit facilities.
5, Subsequent to the delivery of the First Union credit
account to the Defendants, and therein acceptance of same, First
Union Direct Bank, N.A., for valuable consideration and in the
normal course of business, sold, assigned and transferred the
Defendants' account to Pl"inti [(, which in now and has been since

agreement.
6. Defendants, upon acceptance and use of the credit
account, agreed to be' bound by the terms and condi t ions of the
credit account agreement. ^ true and correct copy of said terms

sum of $2,364.86, no part of which has been paid
although duly demanded.
8. Notwithstanding the frequent demands by Plaintiff for
payment of the amount due, there has been a failure and refusal
by the Defendants to pay the same or any part thereof.

pay a finance charge on all sums due at an annual
rate of 21.90%, and Plaintiff is entitled to
finance charges from 21 JUL 1998.
10. In accordance with the terms of Exhibit "A," Defendants
agreed to pay reasonable attorney's fees if the account was
referred to an attorney for collection, and Plaintiff will incur
an attorney's fee in the amount of $472.97.
WHEREFORE,
