I' 1. Susan Smith, Plaintiff, is an adult individual who presently resides at 147
II Brookwood Drive, Carlisle, Pennsylvania 17013.
i 2. Mary G. Smith, Plaintiff, is an adult individual who presently resides at
I 2121 Old Hollow Road, Apartment 2, Mechanicsburg, Pennsylvania 17055.
I 3. Susan Smith is the mother of Mary G. Smith.
4. Defendant G & M Land Development, Inc. (hereinafter referred to as "G &
M") is a Pennsylvania corporation having its principal place of business at 1 005
Brookside Road, Suite 190, Allentown, Pennsylvania 18106.
I 5. Defendant G & M are in the business of contracting, selling, and financing
mobile home properties.
6. Defendant Charles E. Milder (hereinafter referred to as "Milder") an adult
individual, is an executive officer of G&M Land Development, Inc.
7. Defendant, David Doheny (hereinafter referred to as "Doheny") an adult
individual is an executive officer of G&M Land Development, Inc.
8. Defendant, Kyle G. Shook, (hereinafter referred to as "Shook") an adult
individual who was an employee and agent of Mobile Masters Financial during the
relevant times as stated herein.

r: 9. Defendant Shook's address is unknown, but was last receiving mail at c/o
:: G&M Land Development, Inc. d/b/a Pennsylvania Mobile Home Brokers, 10011
II Brookside Road, Suite 190, Allentown, Pennsylvania 18106.
II 10. G & M is d/b/a Pennsylvania Mobile Home Brokers.
'i 11. Mobile Masters Financial is a subsidiary of Mobile Masters of

ii Pennsylvania which is a subsidiary of Pennsylvania Mobile Home Brokers.
II, 12. On or about May 5, 1998, Plaintiff Mary G. Smith telephoned Mobile
Masters of Pennsylvania to inquire about a mobile home which they had listed for sale.
II' 13. Said mobile home is located at 162 Amy Drive, Pine Ridge Mobile Home
Park, Carlisle, Cumberland County, Pennsylvania.
I 14. During this phone call, an agent for Mobile Masters Financial, Defendant

Shook, elicited credit information from Mary G. Smith.
15, On or about May 12, 1998, Plaintiffs Susan Smith and Mary G. Smith went
to the subject property at 162 Amy Drive, Carlisle, to view the mobile home.
16. Defendant Shook met the Smiths at the subject mobile home to tour the
'i property.

I 17. After inspection of the property, Defendant Shook advised Plaintiff, Mary
Smith that she was pre-approved and had qualified for financing based on the credit
information given the week prior over the phone.
1 B, However, in order to secure the home, Defendant Shook told Plaintiffs that
the contract needed to be signed immediately and a deposit was necessary on that
date.
19. Based on the information provided by Defendant Shook that Plaintiff was
already approved for financing, Plaintiff Mary G. Smith entered into an agreement with
Defendants through their agent, Shook. See Exhibit "A".
20. Also based on information Defendant Shook presented, Susan Smith gave
defendant's agent a check in the amount of $1500.00, on Mary G. Smith's behalf, for
deposit towards the purchase of the mobile home.
21. Defendant Shook stated the only obstacle remaining was for Plaintiff Mary
Smith to obtain mobile home park approval.
22. Mary Smith thereafter did obtain mobile home park approval.

23. Defendant Shook purposely, knowingly or with reckless disregard,
provided false information in regard to Mary Smith's financial approval.
24. Plaintiff, Mary Smith signed the contract based on Defendant Shook's,
misrepresentations.
25. Plaintiff, Susan Smith paid the deposit money based on Defendant
" Shook's misrepresentations.
il 26. Approximately one (1) week after the deposit was made, Defendant Shook
i: called Plaintiff Mary Smith and told her that she did not qualify financially for the mobile

27. Despite repeated attempts by the plaintiffs, the defendants have refused

32. Defendant Shook purposely, knowingly or with reckless disregard,
provided false information in regard to Mary Smith's financial approval.
33. Defendant Shook knew or should have known that he was providing false
information as to Mary Smith's financial approval telling her she was pre-approved on or
about May 12.
34. Defendant Shook knew or should have known that his statements about
pre-approval would cause the likelihood of reliance on those statements, by the
plaintiffs.
35. Defendant Shook knew or should have known that the plaintiffs reliance
on those statements would induce the plaintiffs to enter into the contract with
defendants.
36, Defendant Shook knew or should have known that the plaintiffs reliance
on those statements would induce the plaintiffs to give defendants the deposit money.

retained Plaintiffs deposit. It is denied that it has been applied to Plaintiffs account as
set forth in the counterclaim in that Plaintiff does not owe any money to Defendant.
60. Admitted. It is admitted that the contract in question as written does not
contain any loan approval contingencies. However, the Plaintiff was induced to sign
said contract on the assurance of Defendants' agent that she had already been
approved for credit.

3. In accordance with Pennsylvania Statute, Title 69, Section 1401,
Prohibited Contract Provisions. No contract, obligation or agreement shall
contain any provisions by which:
(h) The seller or holder of the contract is given the right to
commence an action on a contract under the provisions of this act
in a county other than the county in which the contract was in fact
signed by the buyer, the county in which the buyer resides at the
commencement of the action, the county in which the buyer resides
at the time that the contract was entered into, or in the county in
which the goods purchased pursuant to such contract have been so
affixed to real property as to become a part of such real property.
4. At the time of the contract, buyers were residents of Cumberland
County, Pennsylvania.
5. At the present time, buyers are residents of Cumberland County.
6. The subject property, which is affixed to real property, is located in
Cumberland County.
7. All portions of the transaction were conducted in Cumberland
County.
8.
Plaintiffs have had no contact with regard to this action in Lehigh
County.
9. Lehigh County has no vested interest in the outcome of this action.
10. Changing venue to Lehigh County would, for all practical purposes,
force Plaintiffs to terminate this action.
11. This action was originally brought in District Court before the
Honorable District Justice Paula P. Correal on September 28, 1998.
12. Defendants were served with notice by the District Justice's office.
13. Defendants failed to show for the hearing.
14. Defendants failed to raise the venue issue at the District Justice
level.
15. By this failure, Defendants have waived the right to raise the venue
issue.
WHEREFORE, Plaintiffs pray Your Honorable Court to overrule
Defendants' second preliminary objection and retain jurisdiction of this action.
