3, By Order dated October 20, 1998, this Court granted Petitioner's Motion
to proceed in forma pauperis and denied Petitioner's Motion for Appointment of
Counsel.
4. Upon receipt of the Commonwealth Court's Order dated Septernber 16,
1998 and this Court's Order dated October 20, 1998, Respondents' Counsel reviewed
the case file and discovered that no other documents except the Court Orders were
served upon the Respondents, To date, Petitioner has filed to effect service upon the
Respondents and the Attorney General's Office in accordance with Pa.R.C.P. No,
422(a),
5. Pa.R.C.P, No. 422(a) requires that service of original process upon the
Commonwealth or a Department, Board, Commission or instrumentality of the
Commonwealth shall be made at the office of the Department and the Office of Attorney
General by handing a copy to the person in charge thereof.
6. Petitioner's failure to serve the Respondents and Office of Attorney
General by hand delivery in accordance with Pa.R,C.P. No, 422(a) renders the service
defective and deprives this Court of personal jurisdiction over the Respondents.
7. Respondents request permission to file any additional preliminary
objections within thirty (30) days of service of the Complaint if and when Petitioner
effects service upon the Respondents,

Respondents' obligation to answer Petitioner's discovery requests until Respondents'
pending Preliminary Objection is resolved, As grounds for this Motion, Respondents
make the following averments:
1, On or about September 10, 1998, Peter Cook ("Petitioner"), an inmate
who is incarcerated at the State Correctional Institution at Camp Hill ("SCI-Camp Hill"),
filed the above-captioned Complaint, Motion for Appointment of Counsel, and Motion
seeking leave to proceed in forma pauperis in the Commonwealth Court of
Pennsylvania ("Commonwealth Court"),

2, By Order dated Septernbcr 16,1998. the Commonwealth Court
transferred this matter to the Court of Common Pleas of Cumberland County because
the courts of common pleas have jurisdiction over such actions. Fawber v, Cohen, 532
A,2d 429 (Pa, 1987),
3. By Order dated October 20. 1998, this Court granted Petitioner's Motion
to proceed in forma pauperis and denied Petitioner's Motion for Appointment of
Counsel.
4, Upon receipt of the Commonwealth Court's Order dated September 16,
1998 and this Court's Order dated October 20, 1998, Respondents' Counsel reviewed
the case file and discovered that no other documents except the Court Orders were
served upon Respondents, To date, Petitioner has failed to serve his Complaint upon
Respondents in accordance with Pa.R,C,P. No. 422(a).
5, On December 9, 1998, Respondents filed a Preliminary Objection
requesting this Court to dismiss the Petitioner's Complaint for lack of in personam
jurisdiction due to Petitioner's failure to serve his Complaint upon Respondents
pursuant to Pa,R.C.P, No, 422(a).
6, On or about March 3, 1999, Petitioner served Petitioner's Request for
Production of Documents by first class mail upon Respondents' Counsel.
7, Respondents' Preliminary Objection is still pending before this Court,
8, Respondents request that it be relieved of the obligation to respond to
Petitioner's discovery request until resolution of Respondents' pending Preliminary
Objection and it is clear that the above-captioned action presents viable claims against

Respondents,
9. Respondents should be protected from the unreasonable annoyance,
oppression, unduly burdensome, and expensive acts of responding to discovery requests
propounded upon Respondents until this Court has had an opportunity to rule upon
Respondents' Preliminary Objection. (See Pa,R,C'p, No, 4012(a)),
10. Since it is not clear at this juncture whether Petitioner has a viable claim
against Respondents, any discovery related obligation on the part of Respondents should
be deferred in the interest of avoiding harassment of public officials and conserving limited
public resources.
11. If this Court sustains Respondents' Preliminary Objection, Respondent will
no longer bear the burdens of a litigant. Thus, Respondents should not be required to
respond to discovery unnecessarily and prematurely until this Court has had an opportunity
to rule on Respondents' Preliminary Objection, Discovery should be stayed until such time
as this Court determines that Respondents are obligated to answer Petitioners' Complaint.
12, Petitioner will not be harmed or prejudiced by the deferral of discovery.
