deficiencies that existed at the time that he occupied the prelltises,

effective May 31, 1998 and in 11lct left Ihe premises on May 31, 1998,
7, Plaintiff altempted to colli act Defendant, and the Defendant's realtor for the purposes of
doing a final inspection, hut was unsuccessful in all of his repeated attempts to do so,
8, On or ahout June 25, 1998, plaillliff received fJ'OIlt Defendant a list of deficiencies found
to be existing at the renlal premises, In addition to refusing to return the security deposit, the
Defendant required an additional $1,238,39 colltpensation for dalltage done 10 the premises and for
unpaid utility hills,
9, Each itellt of damage listed in the Defendanl's June 25, 1998 correspondence was a
preexisting condition within the renlal property at the time it was first occupied by the plaintiff.
10, Plaintiff has consistently colltmunicated to the Defendant that he would satisfy all utility
bills incurred while he was in residence at the rental property, Plaintiff has requested copies of these
bills from the Defendant 10 verify balances, but has never beeu provided with any such copies,

process of selling the premises located at 922 Gobin Drive,
Carlisle, PA.
4. Admitted with the clarification that the lease was between the
Defendant and the Plaintiff, Scott R. Bryer, and Andrea Bryer.
A true and correct copy of that lease is attached hereto,
marked Exhibit "A" and made a part hereof.
5. Admitted in part and denied in part. It is admitted that the
Plaintiff inspected the premises at the inception of the
lease, It is specifically denied that the Plaintiff provided
the Defendant with a list of "move in conditions" upon moving

15. As set forth on Defendant's Exhibit "B", attached hereto, the
Defendant notified the Plaintiff of the aforesaid damages and
offset the $700 security deposit leaving a balance due and
owing by the Plaintiff to the Defendant in the amount of
$1,202.14.
16. Since the damages are greater than the amount of security
deposit, the Plaintiff is not entitled to any damages against
the Defendant and the Defendant is entitled to retain the same
as an offset against the damages and unpaid utility costs.
WHEREFORE the Defendant requests this Honorable Court to enter
judgment in favor of the Defendant and against the Plaintiff.

17. The Defendant incorporates by reference the averments set
forth in Paragraphs one (1) through sixteen (16) herein, the
same as if fully set forth herein at length.
18. The Plaintiff is liable to the Defendant for damages in the
amount of $1,202.14 representing the difference between the
damages and utilities set forth on Paragraph 14 herein and the
