Enclosed is a copy of a letter allegedly from Jenifer Klose, asking to have the
money from her accident. Please check this out to make sure that this is truly the
child's wish without any coercion and that a mortgage foreclosure is imminent.
I do not mind helping out since there is not a lot of money in the account, but I
want to make sure that this is not some scam. If you are satisfied that I should
release the funds for mortgage purposes, please prepare a very short petition
signed by everyone and forward it to me with an appropriate order.

COMPLAINT
1. rHnor Plaintiff, Jennifer Klose, born on January 21,
1984, resides with her mother, Plaintiff Kathy Klose, in New
Kingston, Cumberland County, Pennsylvania,
2. Plaintiff, Kathy Klose, is an adult individual and
citizen of the Commonwealth of Pennsylvania who resides in New
Kingston, Cumberland County, Pennsylvania.
3. Defendant, Edmund Gagliardi, is an adult individual
and citizen of the Commonwealth of Pennsylvania who resides at 151
West Vine Street, Shiremanstown, Cumberland County, Pennsylvania.
4. The facts and occurrences hereinafter related took
place on or about February 2, 1998 at approximately 10:50 a.m. on
E. Main Street, New Kingston, Cumberland County, Pennsylvania.
5, At that time and place, Mr. Gagliardi was operating
his motor vehicle, a 1997 Mercury, in a northern direction on
Locust Point Road, New Kingston, prior to the intersection of East
Main Street and Locust Point Road.
6. Mr. Gagliardi failed to stop for the stop sign at
the intersection, traveled onto East Main Street, and collided with
another motor vehicle.

9. Kathy Klose was also inside her home when the
Defendant's vehicle crashed into the house and as a direct result
of the Defendant's negligence, she sustained physical injury.
IO. The foregoing accident and all of the injuries and
damages set forth hereinafter sustained by Jennifer and Kathy Klose
are the direct and proximate result of the negligent, careless,
wanton and reckless manner in which Mr. Gagliardi operated his
motor vehicle as follows:
a. failure to stop his vehicle at a stop sign;
b. failure to keep alert and maintain a proper
watch for the presence of other motor vehicles on the highway;
c.
failure to travel at a safe speed;
d.
the highway:
failure to keep a proper watch for traffic on
e. failure to keep proper and adequate control
over his vehicle: and
f. dri ving his vehicle upon the highway in a
manner endangering persons and property and in a reckless
manner with careless disregard to the rights and safety of
others and in violation of the Motor Vehicle Code of the
Commonwealth of Pennsylvania.

22. Because of the nature of her injuries, Mrs. Klose
has been advised and, therefore, avers that she may be forced to
incur similar expenses in the future, and claim is made therefor.
23. As a result of the aforementioned injuries, Mrs.
Klose has undergone physical suffering, inconvenience in carrying
out her daily activities, loss of life's pleasures and enjoyment,
and claim is made therefor.
24. Mrs. Klose continues to be plagued by persistent
pain and limitation and, therefore, avers that her injuries may be
of a permanent nature, causing residual problems for the remainder
of her lifetime, and claim is made therefor.
WHEREFORE, Plaintiffs Jennifer and Kathy Klose demand jUdgment
against Edmund Gagliardi in an amount in excess of Twenty-Five
Thousand ($25,000.00) Dollars exclusive of interest and costs anc

respectfully represents:
I. Jennifer Klose, a minor. is the daughter of Kathy Klose. the petition herein, Jenniler is
fifteen (15) years old. having been born on January 21. 19X4.
2, On Febntary 2. 1998. Jennifer was laying on the couch of her residcnee when the
Defcndant's vchiclc impacted the living room wall.
3. As a result ofthc accident, Jennifer began to surlcr panic attacks and anxiety.
4. As a result of the aforesaid accident. an action was tiled against the Defendant.
5. Once discovery was eompletcd, PlaintiOs' counsel listed the case for Arbitration.
Attached as Exhibit A is the Plaintifls' Arbitration Memorandum and referenced exhibits.
6. The Defendant, by and through his counsel, John H. McCarthy. extended a settlement
offer of$12,500. Petitioner and Pctitioncr's counsel believe that it is in the best interest ofJcnnifer
to accept the proposed scttlcment oOer. Attached as Exhibit B is Attorney McCarthy's November
22, 1999, correspondcnce and referenced Release.

10. Jenniler's mother and filther havcjusI received a I(lreclosure notice demanding payment
of $1,658.69. to be paid no later Ihan Decemher 28, 1999. Jennifer slrongly desires to loan her
parents $1,658,69, said loan 10 be repaid, to stop the foreclosure. Attached as Exhihit C is Jim
Edmonds' December 2, 1999. forcclosure notice Irom Cendant Mortgagc Scrvices.
11. Petitioner avers thaI should the Court approve the payment of $1.658.69 to Cendant
Mortgage Services, the remainder of the settlement. $6.266.3 I, is to be placed in the Harris Bank, in
an account that provides that no withdrawal will be made therefrom until Jennifer reaches majorily.

WHEREFORE. Petitioner requests Your Court to approve the minor's settlement and

II. Procedural History
The Plaintiffs filcd a Complaint in the Court of Common Picas of Cumberland Count)' on
Octobcr 14. 1998, On January 7. 1999, the PlaintifTs scrvcd lhc Dcfcndant wilh Rcqucst for
Admissions _ Set 1. Said Requcst for Admissions are attachcd as Exhihit C. 'l1\crcallcr. thc
Dcfendant replied to the Request for Admissions. said rcply attachcd as Exhihit Il. although thc
Defendant's verification was not included \\ith said responsc to thc Rcqucst for Admissions,
On or about January 14. 1999, the Defendant filcd an Answer with Ncw Mattcr. Thcrcafter.
on or about March 24. 1999, the Plaintiffs served the Dcfcndant with Requcst for Admissions. Said
Admissions arc attachcd as Exhibit E, On or about AprilS. 1999. the Dcfendant filed another
response to the Plaintiffs' Request for Admissions, providing the Defendant's vcrification datcd'
April I. 1999. Said response is attached hereto as Exhibit F.
Additionally, in depositions. the Defendant testified that he did not remember the accident.
Ill. Damages
Pursuant to Pa, R.C.P. 1305, Plaintiffs' counsel has provided defense counsel with
admissible documents.
A. Accident scene
At the time of the accident, Jennifer was 14-years old. When the Defendant's vehicle
impacted with the living room wall of the residence, Jennifer was laying on the couch watching
television. She became very upset and eventually exited her home and went to view the accident
scene. Jennifer went to the rront of the house where the Defendant's vehicle collided into her home.
She then saw a man with his ann hanging outside the passenger window. She became very

frightcned and ran back into hcr home. Once inside, Jennifer related what she saw to her mother,
Hcr mother telephoned for emergency assistancc,
Jennifer thought her anxicty would rcsolve, hut during the days following the accident shc
was extrcmcly anxious, Her anxicty did not resolve in time and. in l'lcl. during the early morning of
February 19, 1998. Jennifer suffered a panic attack and she lold her parents that she felt likc shc was
"dying." She was experiencing nallsca and dizziness, Mr, :lI1d Mrs, Klose called an anlbulance,
Emergency medical technicians from the Silver Spring Ambulance Company came to the
Klose residence and the ambulance personnel transported Jennifer to the Carlisle Hospital.
Attached as Exhibit G is the EMT trip sheet.
At the Carlisle Hospital, Jennifer was cvaluated by Dr. Gerald Fronko and the history"
recorded provided that she was experiencing light-headedness, dizziness, weakness. drowsiness and
a rapid heart beat. Attached as Exhibit H are the Carlisle Hospital emergency room records.
During the next several wccks. Jennifer continued to experience panic and an.xiety
symptoms, Accordingly, Mrs. Klose scheduled an appointment with Jennifer's pediatrician. On
April 3, 1998 after her initial evaluation with Holly Hoffman Bauer, M.D.. Jennifer was placed on
Prozac, 20 mg. per day. Dr. Bauer saw Jennifer for follow-up visits on May I, 1998 and December
10, 1998. Jennifer's Prozac had to be increased in August 1998 to 30 mg. per day. Jennifer
remained on Prozac until March of 1999.
Dr. Bauer reported that Jennifer's Panic Attacks and Anxiety Disorder were the direct result
of the Februarv 2. 1998 accident. Attached as Exhibit I arc Dr. Bauer's two reports dated May 6,
1998 and March 21, 1999 and her office notes.

IV. Gcncral Damal!cs
Jcnnifcr was in thc seventh (7th) grade at the limc of this accident. She was an average
studcnt in terms of her grades. Ilowever, her grades took a very dramatic fall during the first two
marking pcriods and thc last two marking periods, Shc was failing four (4) c1asscs and almost
failcd two (2) others in thc third (3rd) marking period. During thc last marking period of hcr
scventh gradc year. she was failing five (5) c1asscs.
Jcnnifcr also had a markcd dccrease in hcr attendance during her seventh grade year. She
was absent from classes 40 timcs that ycar. This was relatcd to hcr anxicty attacks and a dircct
causc ofhcr poor gradcs.
Jcnnifer was ablc to ovcrcomc hcr anxiety attacks and the gradcs for hcr eighth (8th) gradc
ycar wcrc morc likc thc gradcs shc had rcccivcd prior to thc accidcnt. Attachcd as Exhibit J arc
Jcnnifer's report cards from 7th ane! 8th gradcs.
Bccausc Jcnnifcr was pronc to cxpericncing anxicty attacks and could not anticipate when
they would occur, shc was restrictcd from going out with her fricnds or participating in the normal
activities of a tecnage girl. Jennifer's mothcr did not pcnnit her to stay ovcrnight at friends because
she was conecrned about thc unprcdictability of Jennifer's anxkty attacks.

The defendant Edmund Gagliardi by his attorney Edward J. Stolarski hereby
answers the Complaint of the plaintiffs as follows:
1 - 2. Denied. After a reasonable investigation, the answering defendant is without
knowledge and/or information sufficient to form a belief as to the truth or the
falsity contained within this paragraph and therefore they are denied. Strict proof
is demanded of same at time of trial.

involving Edmund Gagliardi took place on or about February 2, 1998 at

6. Neither adlllilled or denied. In that Edlllund Gagliardi has no recollection of
events prior to the accident. said lack of recollection possibly due to a meclical
condition of Mr. Gagliardi, to with diabetes. the defendant can neither admit nor
denied that he failed to stop for the stop sign at the intersection. The averment
that Mr. Gagliardi "collided with another vehicle" is specifically denied. 1'0 the
contrary. the Gagliardi vehicle was strict by another motor vehicle and was not the
striking vehicle.

NEW MATTER
1. The Complaint of the plaintiffs against the answering defendant fails to state a
cause of action upon which relief can be granted.
2. Answering defendant was not negligent and the answering defendant's action
were not the approximate cause of any injuries or damages sustained by the
plaintiffs.
3, It can be found that the plaintiffs sustained injuries and damages as a result of
an incident occurring on February 2, 1998, the answering defendant avers that said
injuries and damages were approximately caused by the actions, error, and/or
omissions of third parties over whom the answering defendant had no control.

symptoms. Accordingly, Mrs. Klosc sehcduled an appointment with .lenniler's pcdiatrician. On

III. Damagcs
Pursuant to Pa, R.C.p. 1305, Plaintiffs' counsel has provided dcfcnse counsel with
admissiblc docwnents.
A. Accident scene
At the time of the accident. .lennifer was 14-years old. When the Defendant's vehicle
impacted with the living room wall of the residence, .lennifer was laying on the couch watching
television. She became very upset and eventually cxited her home and went to view the accident
scene. .lennifer went to the front of the house where the Defendant's vehicle collided into her hOl11e,
She then saw a man with his ann hanging outside the passcnger window. She became very

frightened and ran back into her homc, Once inside, Jennifcr related whal she saw 10 her mother.
I fer mother telephoned I(lr emergency llssistance,
.lennifer Ihought her anxiety would resolve, but duriug the days filllowing the accident she
was extremely anxious, Iler 1111xi<'IY did not resolve in lime and. in lacl. during the early morning of
February 19, 1998. .lennilcr sullered a panic a!lack and she told her parents that she felt like she was
"dying." She was cxperiencing nausea and dizziness. Mr, and Mrs. Klose called an ambulance.
Emergency medical tcchnicians from the Silver Spring Amoulance Company came to the
Klose residcnce and thc ambulance personnel transponed .lcnnifcr 10 thc Carlislc Hospital.

At the Carlislc Hospital, .lcnnifcr was evaluatcd by Dr, Gcrald Fronko and thc history
recorded providcd that she was experiencing Iight-hcadcdness, dizziness, weakness, drowsiness and
a rapid hcart bcal. Attachcd as Exhibit H arc thc Carlislc Hospital cl11ergeney room rceords,
During the ncxt sevcral weeks. .lennifcr continued to expericnce panic and anxiety
symptol11s. Accordingly, Mrs, Klose scheduled an appointment with .lennifcr's pcdiatrician, On
April 3, 1998 after her initial cvaluation with Holly Hoffman Bauer, M.D.. .lcnnifer was placed on

Jennifcr also had a markcd dccrcasc in hcr attendance during her scventh grade ycar. She
was absent frol11 c1asscs 40 times that ycar. This was related to her anxiely attacks and a direcl
cause of hcr poor gradcs,
Jennifer was able to ovcrcomc hcr anxicty attacks and thc grades for hcr eighth (8th) gradc
year were l110re like the gradcs she had reccived prior to thc accidcnt. Attached as Exhibit J arc
Jennifer's rcport cards from 7th and 8th gradcs,
Bccausc .lennifer was prone to cxpcricncing anxiety attacks and could not anticipatc whcn
they would occur, she was rcstricted from going out with hcr friends or participating in thc nonnal
activities ofa teenagc girl. .lcnnifer's mothcr did not pennit hcr to stay overnight at friends because
she was concerned about thc unpredietability of .lennifer's anxicty attacks.

The PlaintifTs tiled a Complaint in the Court of Cmnmon Picas of Cumberland County on
Oetoher 14, 199K, On January 7. 1999, thc Plaintiffs scrvcd thc Dcfcndant with Rcquest for
Admissions - Sct I. Said Rcqucst lllr Admissions mc a!tachcd as Exhihit C. Therc;llier, the
Defendant replicd to the Rcquest llJr Admissions, said rcply attaehcd as Exhibit D, although the
Defendant's vcrifieation was not included with said rcsponsc to the Rcquest for Admissions,
On or about January 14, 1999. the Defendant filed an Answer with New Matter. Thereaftcr,
on or about March 24, 1999. the Plaintiffs servcd the Dcfendant with Requcst for Admissions, Said
Admissions are attachcd as Exhibit E. On or about April 5. 1999, the Defendant filcd another
rcsponse to the Plaintiffs' Request for Admissions, providing the Defendant's verification datcd
April !. 1999. Said rcsponse is attaehcd hercto as Exhibit F.
Additionally, in depositions. the Dcfendant tcstified that he did not rcmembcr the accident.
III. Damages
Pursuant to Pa. R,C.P. 1305, Plaintiffs' counsel has providcd defense counsel with
admissible documcnts.
A. Accident scene
At the time of the accident, .lennifcr was 14-years old. When the Defendant's vehicle
impacted with the living room wall of the residence. .lennifer was laying on the couch watching
television. She became very upset and eventually exited her home and went to view the accident
scene. .lennifer went to the front of the house where the Defendant's vehicle collided into her home,
She then saw a man with his arm hanging outside the passenger window. She became very

At the Carlisle Hospital. Jennifer was evaluated hy Dr, Gerald Fronko and the history
recorded provided that she was experien~ing light-headedness, dizziness, weakness, drowsiness and
a rapid heart beat. Attached as Exhihit H are the Carlisle Hospital emergency room records,
During thc next several weeks. .lenniler continued to experience panic and anxiety
sYl11ptoms, Accordingly. Mrs, Klose scheduled an appointment with Jenniler's pediatrician. On
April 3, 1998 after her initial evaluation with lIolly Ilonrnan Bauer, M.D.. .lennifer was placed on
Prozae, 20 mg, per day, Dr. Bauer saw .lennifer for follow-up visits on May I, 1998 and December
10, 1998. .lennifer's Pro/~1C had to be increased in August 1998 to 30 mg. per day. .lennifer
rel11ained on Prozae until March of 1999.
Dr, Dauer reported that .lennifcr's Panic Attacks and Anxiety Disorder were the direct result

Because Jennifer was prone to experiencing anxiety attacks and could not anticipate when
they would occur. shc was restricted from going out with her friends or participating in the normal
activities ofa teenage girl. Jennifer's mother did not permit her to stay overnight at friends because
she was concerned about the unpredictability of Jennifer's anxiety attacks.

HISTORY: This Is a 14.year.old white female who presents 10 the emergency room for complaints of
dizziness, She apparenlly had some rapid heart bealing. She took four teaspoons of Pediatric rlyQuil
20 mins prior to going 10 bed. At bedtime she felt the symptoms of light.headedness, dizziness. weak-
ness, and feeling drowsy. She has been evaluated by Dr. Hoffman for upper resplralory tract Infection.
A streptococcal pharyngitis screen was negative, She has been eating and drinking okay. She did
havo fover yesterday and none today.
PAST MEDICAL HISTORY: Negalive. She is an otherwise healthy person, and does not have any
history of exertlonal dyspnea or asthma.
PHYSICAL EXAMINATION: Temperature is 37.2'C, pulse 118, respiratory rale 20, blood pressure
122170. Pulse ox was 98% on room air. Generally this child was awake and alert. She appears well.
Exlraocular muscles were intact. The pupils were reactive. Conjunctiva were not injected. Oro-
pharynx - mucous membranes were slighlly hyperemic but without exudate. Neck _ supple, no
adenopathy, no rigidity. Lungs - clear, no wheezing, Heart - regular rate, S1/S2 without murmurs,
rubs or gallops. Abdomen - soft, non tender. Bowel sounds were present. Exlremities _ 2+ pulses, no
rash. Neurologic - she is awake and alert. . Exam Is nonfocal and she is able to ambulate without
difficutty .
EMERGENCY DEPARTMENT COURSE: The patient's parents were informed that mosltikely Jennifer
was haVing an adverse reaction to the adrenergic stimulants as part of the Pediatric NyQuil medication
and that I had advised her to slop using that medicine and is to follow-up with Dr. Hoffman as needed
for continued problems with her cold symptoms.
DIAGNOSES:
1. Dizziness.
2. Adverse reaction to NyQuil.

3. Kathy and J~nniJer Klose ha\'c recently conlacted Plaintifls' cDunscl and inlarmed
counsel that their mortgage is in delimIt. It is counsel's understanding thai Mr. Klosc had lost his
job. causing a severe financial burden on the Klose Jiunily.
4, Attached as Exhihit C is a documenl Irom Federman and Phelan, presumably
representing a reinstalcment figure of $8.409. 96.
5. Petitioner Kathy Klose. and her daughter .lenniler. have requesled that Plaintifls'
counsel seek this Petition and ha\'e $5,000.00 of the proceeds deposited on Jcnniler"s behalf be

on behalf of her daughter, and entered into a eonlingency lee agreement \l'ith "lid attomeys
whercby said attorneys are to reccivc, for professional services, 35% of any amount recovered, plus
out-of-pockct expenses.
9, Howcver, Pctitioner's counsel has informed thc Petitioner that given thc facts and
circumstances of this case, Angino & Rovner, P.c., will reduce its fee to 30% (Le" $3.750.00). The
out-of-pocket expenses cxcecd $825.00.
10. Jeanifer's mother and father have just received a foreclosure notice demanding payment
of $1,658.69, to be paid no later than Decembcr 28, 1999. Jennifcr strongly desires to loan hcr
parents $1,658.69, said loan to be repaid, to stop the foreclosure, Attached as Exhibit C is Jim
Edmonds' December 2, 1999, forcclosure noticc from Cendant Mortgage Services.
II. Petitioner avers that should the Court approve the payment of $1,658,69 to Cendant
Mortgage Services, the remainder of the settlement, $6,266.31, is to be placed in the Harris Bank, in
an account that provides that no withdrawal will be made therefrom until Jennifer reaches majority,
except as authorized by Court order.
WHEREFORE, Petitioner requests Your Court to approve the rninor's settlement and
authorize the payment 01'$3,750.00 for atlomeys' fees and $825.00 for out-of-pocket expenses and

SErrLEMENT AND DISTRIBUTION
The Petition of Jennifer KIDse, by Kathy Klose, her mother and natural guardian,
respectfully represents:
1. Jennifer Klose, a minor, is the daughter of Kathy Klose, the petition herein. Jennifer is
fifteen (15) years old, having been bom on January 21,1984.
2. On February 2, 1998, Jennifer was laying on the couch of her residence when the
Defendant's vehicle impacted the living room wall.
3. As a result of the accident, Jennifer began to suffer panic attacks and anxiety.
4. As a result of the aforesaid accident, an action was tiled against the Defendant.
5. Once discovery was completed, Plaintiffs' counsel listed the case for Arbitration.
Attached as Exhibit A is the Plaintiffs' Arbitration Memorandum and referenced exhibits.
6. The Defendant, by and through his counsel, John J-l. McCarthy, extended a settlement
offer of $12,500. Pelitioner and Petitioner's counsel believe that it is in the best interest of Jennifer
to accept the proposed settlement offer, Attached as Exhibit B is Attomey McCarthy's November
22, 1999, correspondence and referenced Release.

7. Should Your Court deem ilueeessary 10 schedule a hearing to apprnve the acceptance of
said settlement oller, and if a hearing is scheduled, Jennifer's mother, Kathy Klose, Jennifer, and
Pctitioner's counscl, will bc present at the hearing.
8. Your Pctilioner rctained the law lirnl of Angino & Rovner, P.C.. to prosccute this aclion
on behalf of her daughter, and entered into a contingency fee agrecment with said attorneys
whereby said attomeys arc to receive, for professional serviccs. 35% of any amount recovcred, plus
out-of-pocket expenses.
9. However, Pctitioner's counsel has infonncd the Petitioner that given the f.1cts and
circumstances of this case, Angino & Rovner, P.C., will rcduce its fee to 30% (i.e., $3,750.00), The
out-of-pocket expenses exceed $825.00.
