Leamer and Eva S. Leamer, by and through their attorney, James W. Abraham, Esquire, Abraham Law Offices, Harrisburg, Pennsylvania, and file the following: 1. plaintiffs, Aaron C. Leamer and Eva S. Leamer, are adult individuals who currently reside at 709 Lyon Road, Cherry Tree, Cambria County, Pennsylvania. 2. Defendant, Ronald E. Leamer, Sr., is an adult individual who currently resides at P.O. Box 233 New Kingston, Cumberland County, Pennsylvania. 3. Defendant, Shelly A. Leamer, a/k/a Shelly A. Ivory, is an adult individual who currently resides at 101 Field Stone Drive, Carlisle, Cumberland County, pennsylvania. 4. On or about August I, 1989, Plaintiffs and Defendants entered into a loan agreement in which Plaintiffs agreed to lend to Defendants, and Defendants agreed to borrow from and repay Plaintiffs, the amount of approximately $22,000.00, payable in monthly payments through July, 2000, at an annual interest rate of AARON C. IVORY Defendants CIVIL ACTION . LAW COMPLAINT AND NOW, come Plaintiffs, Aaron C. Leamer and Eva S. Leamer, by and through their attorney, James W. Abraham, Esquire, Abraham Law Offices, Harrisburg, Pennsylvania, and file the following: 1. Plaintiffs, Aaron C. Leamer and Eva S. Leamer, are adult individuals who currently reside at 709 Lyon Road, Cherry Tree, Cambria County, Pennsylvania. 2. Defendant, Ronald E. Leamer, Sr., is an adult individual who currently resides at P.O. Box 233 New Kingston, Cumberland County, Pennsylvania. 3. Defendant, Shelly A. Leamer, a/k/a Shelly A. Ivory, is an adult individual who currently resides at 101 Field Stone Drive, Carlisle, Cumberland County, Pennsylvania. 4. On or about August 1, 1989, Plaintiffs and Defendants entered into a loan agreement in which Plaintiffs agreed to lend to Defendants, and Defendants agreed to borrow from and repay Plaintiffs, the amount of approximately $22,000.00, payable in monthly payments through July, 2000, at an annual interest rate of . . ~'..-r> I:: _.. . ,,;. eight (8\) percent, with the monthly payment of $250.00, pursuant to an amortization schedule, comprising of 132 monthly payments. The agreed upon amortization schedule is attached hereto and made part hereof as Exhibit "A". 5. In accordance with the parties' agreement, Defendants began making the $250.00 monthly payment to Plaintiffs, commencing with Defendants first payment of $250.00 on December 28, 1989, and Defendants initially continued to do so on a regular basis. 6. Defendants then stopped making said monthly payments to Plaintiffs, and made their last $250.00 payment to Plaintiffs by check dated March 25, 1996. A true and correct copy of said cheek, and true and correct copies of all checks paid to Plaintiffs pursuant to the agreement, are attached hereto and made part hereof as Exhibit "B". 7. Plaintiffs have fully complied with the agreement of the parties at all relevant times hereto. 8 . Defendants are in breach of the parties' agreement to repay the loan to Plaintiffs, and Defendants have defaulted as to the agreement, as a result of the failure of Defendants to pay the agreed upon monthly amounts due, and currently owe Plaintiffs, the amount of $18,864.59, which constitutes the remaining loan balance due to Plaintiffs, accounting for all payments made by Defendants, and allocated to principal and interest, from December 28, 1989 through March 25, 1996. .. - : ; ;. r ~ .. ,. : .- r' I. Leamer, in order to purchase the mobile home, which was used as a downpayment on Defendants' residence at 101 Field Stone Drive, Carlisle, Pennsylvania (hereinafter "Carlisle property"), and therefore it is admitted that the mobile home loan has been repaid, but it is denied that Plaintiffs are owed the money loaned to Defendants for the downpayment on the Carlisle property, which loan is the subj ect of the Complaint. It is further denied that any debts owed to Plaintiffs hereto have been forgiven. Strict proof thereof is demanded. ~ 11. Denied. It is denied that Defendant has made all of the payments on the Carlisle property loan or that Plaintiffs have failed to account for said payments. It is denied that the Statute of Limitations has expired hereto as Defendants continued to make payments to Plaintiff through March 25, 1996, which constitutes the date of Defendants' breach of the agreement for the loan on the Carlisle property, which is well within the applicable statute of limitations, 13, Denied.
