1, The Plaintiff is LEONARD G, LANDER, JR., who currently resides at 125 Steelstown
Road, Newville, Cumberland County, Pennsylvania, where he has resided since for the last five
years,
2, The Defendant is MARVETTA L, LANDER, who currently resides at 595 Geneva Drive,
Apt. 11, Mechanicsburg, Cumberland County, Pennsylvania, where she has resided since October
1,1998,
3, The Plaintiff and Defendant both have oeen bona fide residents in the Commonwealth of
Pennsylvania for at least six months immediately prior to the filing of this Complaint.
4, The Plaintiff and Defendant were married on May 27, 1989, in Missouri.
5, That there have been no prior actions of divorce or for annulment between the parties in
this or in any other jurisdiction,
6, The Plaintiff avers that he is entitled to a divorce on the ground that the marriage is
irretrievably broken and Plaintiff is proceeding under Sections 3301 (c) and/or (d) of the Divorce
Code,

Dear Judge Bayley:
The hearing on a Petition for Counsel Fees and Costs in this case is scheduled for
February 25, 1999 at 11 :00 a,m, I have a conflict in the Office of Domestic Relations
where there is a support conference scheduled(or,10:30, Although a matter in the Court
Room would normally take priority over a support conference, the support conference in
question is on a Petition that has been pending for well over a year, transferred back to this
County from New Jersey, and rescheduled once already, I have asked Mary Dissinger if
she would agree to a brief continuance of the Lander matter, and she will not. I am asking
for a continuance, I have time in my calendar both in the morning and the early afternoon
on Thursday, February 25'h, and time in the afternoon of the 24'h and 261h, As Sharon is
out of the office today, I am not sure what would be possible, but I am willing to work with
the Court and counsel, and I point out to the Court that no request for a continuance on this
Petition has been made before this time,
I enclose a proposed Order, Thank you for your consideration of this request.

I counsel, SAIDIS. SHUFF, FLOWER & LINDSAY, and petitions this Honorable Court
I as follows:
1. Petitioner is Leonard G. Lander, Jr. who resides at 216 Stratford Drive,
Irwin, Pennsylvania 15642.
2. Respondent is Marvella L. Lander, who resides at 595 Geneva Drive,
Unit 11, Mechanicsburg, Pennsylvania 17055.
3. The parties are parents of a daughter, Rachel M. Lander, born
November 27,1989.
4. On March 29, 2000, this Honorable Court entered an Order, a copy of
which is attached hereto as Exhibit "A". Paragraph 5 of the Court Order calls for
Petitioner to have custody of his daughter three weekends out of every four-week
segment of the school year.
5. On the weekend of May 10 through May 12, Respondent enjoyed
custody of Rachel. At or about that time, Respondent requested that Petitioner agree
that she could relocate to Kansas. When Petitioner refused to agree, Respondent
threatened that he would "never see her again."

ORDER OF COURT
AND NOW, this -z.qlhday of March, 2000, IT IS ORDERED:
(1) All prior custody orders are vacated and replaced with this order.
(2) Marvetta L, Lander and Leonard G. Lander, Jr., shall have shared legal
custody of Rachel M. Lander, born November 27, 1989.
(3) The mother shall have primary physical custody of Rachel.
(4) The petition of the mother to move Rachel to Kansas City, Kansas, IS
DENIED.
(5) The father shall have temporary physical custody of Rachel:
(a) During each four-week segment of the school year, three out of four
weekends from Friday after school until Sunday evening at 8:00 p.m., but
if Monday is a school holiday then until Monday at 8:00 p.m. Two of these
weekends shall be on the weekends the mother is working. The third
weekend shall be agreed upon by the parents at least one week in
advance.
(b) During the summer vacation period, starting on the first Sunday for

three continuous weeks Rachel shall tt18n spend three continuous weeks
with her mother after which the father shall have her for another three
continuous weeks,
(c) Each December 27" until January 1". The mother shall always have

(6) The father shall provide al/ transportation for his periods of temporary
physical custody.
(7) When each parent has Rachel that parent shall provide her with reasonable
telephone access to the other parent.
