STEPHEN J. SCHNOOR and DIANA C. SCHNOOR, husband alld wife,
hereinafter referred co as Owner, whereby the former undertook
and agreed to erect and construct a single family dwelling on
that certain lot of ground s1tuate 1n
Silver Spring Townslnp, County of Cumberland, Commonwealth of
Pennsylvania, more fully bounded and described in attached
Exhibit "A", and also known as Lot 40, Hillside Farms, 6 Bull Run
Court, Mechan1csburg, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to J. W. Mumper Construction, Inc. in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of
them against the said buildings and the lot of ground appurtenant
thereto for or on account of any work done or materials furnished
by them or any of them under said contract or otherwise, for,
towards, in, or about the erection and construction of the said
buildings on the lot above described, and the said Contractor,
for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.

acknowledged himself to be the President of J. W. Mumper
Construction, Inc., a corporation, and that he as such President,
being authorized to do so, executed the foregoing instrument for

ALL THAT CERTAIN tract or lot of land situate in the Township
of Silver Spring, County of Cumberland, Commonwealth of
pennsylvania, bounded and described as follows:
BEGINNING at a point on the northern right of way line of Bull
Run Court at the corner of Lot No. 41 of the hereinafter
mentioned Plan of Lots; thence by Lot No. 41 North 36 degrees 17
minutes 20 seconds East, a distance of 215.91 feet to a point at
the corner of Lot No. 29; thence along Lot No. 29 and Lot No. 30
South 51 degrees 52 minutes 05 seconds East, a distance of 257.34
feet to a point at the corner of Lot No. 36; thence along Lot No.
36 South 38 degrees 07 minutes 55 seconds West, a distance of
169.99 feet to a point at the corner of Lot No. 39; thence along
Lot No. 39 North 81 degrees 30 minutes 44 seconds West, a
distance of 189.59 feet to a point on the eastern right of way
line of Bull Run Court; thence along the eastern right of way
line of Bull Run Court by a curve to the left having a radius of
95.00 feet, an arc distance of 103.13 feet to a point at corner
of Lot No. 41, the place of BEGINNING.
CONTAINING 1.28 acres of land.
BEING Lot No. 40 of the final subdivision plan of Hillside
Farms, Phase I, prepared by H. Edward Black and Associates, P.C.,
and recorded in the Office of the Recorder of Deeds of Cumberland
County, pennsylvania, in Plan Book 72, Page 77.
UNDER AND SUBJECT to a Declaration of Covenants and
Restrictions recorded in Cumberland County Miscellaneous Book
529, Page 333, and under and subject to the By-Laws of Hillside
Farms Homeowner's Association, Inc., recorded in Cumberland
County Miscellaneous Book 529, Page 354.
BEING THE SAME PREMISES which Max C. Hempt and Martha D.
Hempt, his wife, by their deed recorded in the Office of the
Recorder of Deeds of Cumberland County, granted and conveyed unto
Stephen J. Schnoor and Diana C. Schnoor.
