d. The mother is the parent who can best facilitate
contact between the child and the other parent.
7. The father has not acted in the best interest of the chi 1d
for reasons including, but not 1 imited to, the following:
a. Since October 2, 1998, the father has kept the child
from having reasonable contact with the mother, refusing to
tell the mother where he and the chi ld resided and not
maintaining a stable residence for the chi 1d.
b. On several occasions in the recent past, the father
threatened to remove the child from the mother saying she
would never see the child again which concerned her since
the father has relatives in Virginia and West Virginia.

e. The father contacted one of the mother's friends on
October 26, 1998, th.eatening that when he finds the mother,
he wi 11 punch her "dead in the face."
8. The father's instability and violent temper cause the mother
to fear for the safety of herself and the child if the court does not

custody of the child with periods of partial custody in the father
will stabilize the situation and minimize danger to herself and the

WHEREFORE, the plaintiff requests that this court enter a
Temporary Custody Order granting her primary physical ad legal custody
of the child and the defendant partial custody the first three
weekends of each month from Friday until Sunday at times to be agreed
upon by the parties.
The plaintiff further requests that the court order the defendant
not to remove the child from Pennsylvania pending further order of
