2/23/96 the mortgage was assigned to PLAINTIFF which

The premises subject to said mortgage is described as
attached.

The mortgage is in default because monthly payments of
principal and interest upon said mortgage due 7/1/98 and
each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such
payments after a date specified by written notice sent to
Mortgagor, the entire principal balance and all interest due
thereon are collectible forthwith. A copy of such notice is
attached as Exhibit "A."

7. The attorney's fees set forth above are in conformity with
the Mortgage documents and Pennsylvania Law, and will be
collected in the event of a third party purchaser at
Sheriff's Sale. If the Mortgage is reinstated prior to the
Sale, reasonable attorney's fees will be charged.
8. This action does not come under Act 6 of 1974 because the
original mortgage amount exceeds $50,000.00.
9. The Temporary Stay as provided by the Homeowner's
Emergency Mortgage Assistance Program, Act 91 of 1983,
has terminated because Defendant(s) have failed to meet
with the Plaintiff or an authorized Credit Counseling
Agency in accordance with Plaintiff's written Notice to
Defend~nts, a true and correct copy of which is
attached hereto as Exhibit "8".
10. Pursuant to the Fair Debt Collection Practices Act, 15
U.S.C. S 1692 et seq. (1977), Defendant(s) may dispute
the validity of the debt or any portion thereof. If
Defendant(s) do so in writing within thirty (3D) days
of receipt of this pleading, Counsel for Plaintiff will
obtain and provide Defendant(s) with written
verification thereof; otherwise, the debt will be
assumed to be valid. Likewise, if requested within
thirty (30) days of receipt of this pleading, Counsel
for Plaintiff will send Defendant(s) the name and
address of the original creditor if different from
above.
WHEREFORE, PLAINTIFF demands an in rem Judgment against the
Defendant(s) in the sum of $92,237.08, together with interest
from 10/1/98 at the rate of $17.48 per diem to the date of
Judgment, and other costs and charges collectible under the
mortgage and for the foreclosure and sale of the mortgaged
property.

Dear Member(s):
The mo~tgage held by PHH Mortgage Services (hereinafter
We us or ours) on your property located at 36 Edgewood Drive
Mechanicsburg PA 17055 is in serious default because you
have not made the monthly payment of $ 744.82 for last 3
montha. Late charges (and other charges) have also accrued to
this date in the amount of $ 60.83.
You may cure this default within thirty (30) days of the date
of this letter by paying to us the amount of $ 2,310.59 plus
any additional monthly payments and late charges which may
fall due during this period. Such payment must be made either
by cash, cashier's check, certified check or money order, and
sent to 6000 Atrium Way, Mount Laurel, NJ 08054,
If you do not cure the default within thirty (30) days, we
intend to exercise our right to accelerate the mortgage
payments. This means that whatever is outstanding on the original
amount borrowed will be considered due immediately and you
may losa the chance to payoff the original mortgage in
monthly installments. If full payment of the amount of
default is not made within thirty (30) days, we also intend
to instruct OUr attorneys to start a lawsuit to foreclose
your mortgaged property,
If the mortgage is foreclosed, your mortgaged property will
be sold by the sheriff to payoff the mortgage debt. If we
refer your case to our attorneys and you CUre the default
before they begin legal proceedings against you, you will
still have to pay the reasonable attorney's fees incurred up
to $50.00. However, if legal proceedings are started against
you, you will have to pay the reasonable attorney's fees even
if they are over $50.00.

Attorney's fees w~ll be added whatever you owe us, wh~ch
may also include our reasonable costs, If you cure the default
within the thirty day period, you will not be required to pay
attorney's fees,
We may also sue you personally for the unpaid principal balance
and all other s~ under the mortgage. If you have not cured the
default within the thirty day period and foreclosure proceedings
have begun, you still have the right to cure the default and
prevent the sale at any time up to one hour before the sheriff's
foreclosure sale, ~ou rr~y do so by paying the Total Amount
of the unpaid monthly payments plus any late or other chargas
then due, as well as the reasonable attorney's fce~ and cost#
connected with the foreclosure sale (and perform any other
requirements under the mortgage). It is estimated that the
earliest date that such a sheriff's sale could be held would
be approximately six months from date of this letter. A
notice of the date of the sheriff's sale will be sent to
you before the sale. Of course, the amount needed to cure
the default will increase the longer you wait. You may
find out at any time exactly what the required payment will
be by calling Us at the following number 1-800-257-0460.
This payment must be in cash, cashier's check, certified
check or money order and made payable to us at the address
s ta ted above.
You should realize that a sheriff's sale will end your
ownership of the mortgaged property and your right to remain
in it. If you continue to live in the property after the
sheriff's sale, a lawsuit could be started to evict you.
~ou have additional rights to help protect your interest in
the property, You have the right to sell the property to
obtain money to payoff the mortgage debt, or to borrow
money from another lending institution to payoff this debt,
You may have the right to sell or transfer the property
subject to the mortgage to a buyer or transferee who will
assume the mortgage debt, provided that all the outstanding
payments, charges and attorney's fees and costs are paid prior
to or at the sale, (and that the other requirements under the
mortgage are satiSfied). Contact us to determine under what
circumstances this right might exist, You have the right to

same position as if no default had occurred. However, you are

The names and addresses of designated Consumer Credit Counceling Agencies
are shown on the attached sheet. It is only necessary to schedule one
face-to-face meeting. You should advise this lender immediately of your
intention.
Your mortgage is in default because you have failed to pay prompt
installments of principal and interest, as required, for a period of
at least sixty (60) days, The total amount of the delinquency is

UNIFORM COVENANTS. Borrower and Lander covenant and agree as IoIlows:

NOle.

leasehold payments or ground rents on the Property, n any; (c) yearly hazard or property Insurance premiums; (d)

Borrower to Lander, In accordance w~h the provlslons of paragraph 8, In lieu 01 the payment 01 mortgage Insurance

The Funds shall be held In an Institution whose depos~s are Insured by a lederal agency, Instrumentality, or entity
Qncludlng Lander, /I Lander Is such an Institution) or In any Federal Home Loan Bank. Lander shall apply the FUnds to
pay the Escrow !tems. Lander may not charge Borrower for holding and applying the Funds, annually analyzing the
escrow account, or verifying the Escrow /lems, unless Lender pays Borrower Interesl on the Funds and applicable law
permits Lander to make such a charge. However, Lender may require Borrower to pay a one-time charge lor an
Independent real estate tax reporting service used by Lender In connection with this loan, unless applicable law
provides otherwise. Unless an agreement Is made or applicable law requires Interest to be paid, Lender shall not be
required to pay Borrower any Interest or earnings on the Funds. Borrower and Lender may agree In wrlling, however,
that Interest shall be paid on the Funds. Lender shall give to Borrower, w~hout charge, an annual accounting ot the
Funds, showing credits and debits to the Funds and the purpose lor which each debit to the Funds was made. The
Funds are pledged as additional security for all sums secured by this Security Instrument.
II the Funds held by Lender exceed the amounts permilled to be hold by applicable law, Lender shall account to
Borrower lor the excess Funds In accordance with the requirements of applicable law. II the amount of the Funds held
by Lendor at any time Is not su/IJcient to pay the Escrow lIems when due, Lender may so notify Borrower in writing, and.
In such case Borrower shall pay to Lender the amount necessary to make up the deficiency. Borrower shall make up
the deficiency In no more than twelve monthly payments, at Lender's sole discretion.
Upon payment In lull 01 all sums secured by this Security Instrument, Lender shall promptly refund to Borrower any
Funds held by Lander. II, under paragraph 21, Lender shall acquire or soli the Property, Lender, prior to the acquisition
or sale 01 the Property, shall apply any Funds held by Lender at the time of acquisition or sale as a credit against the
sums secured by this Security Instrument.
3. Application 01 Payments. Unless applicable law provides othorwlse, all payments received by Lender under
paragraphs 1 and 2 shall be applied: first, to any prepayment charges due under the Note; second, to amounts payable
under paragraph 2; third, to Interest due; lourth, to prinCipal due; and last, to any late charges due under the Note.
4. Charges; Uens. Borrower shall pay all taxes, assessments, charges, fines and Impositions allributable to the
Property which may allaln priority over this Security Instrument, and leasehold payments or ground rents, /I any.
Borrower shall pay these obligations In the rnanner provided In paragraph 2, or II not paid in that manner, Borrower
shall pay them on time directly to the person owed payment. Borrower shall promptly furnish to Lender all notices 01
amounts to be paid under this paragraph. II Borrower makes these payments directly, Borrower shall promptly furnish
to Lander receipts evidencing the payments. . .
Borrower shall promptly discharge any lien which has priority over this Security Instrument unless Borrower: (a)
agrees In writing to the payment of the obligation secured by the lien In a manner acceptable to Lender; (b) contests In
good faith the lien by, or detends against entorcement 01 the lien In, legal proceedings which In the Lender's opinion
operate to prevent the enlorcement 01 the lien; or (c) secures Irom the holder 01 the lien an agreement satlslactory to
Lender subordinating the lien to this Security Instrument. If Lender determines that any part 01 the Property Is subject
to a lien which may attain priority over this Security Instrument, Lender may give Borrower a notice Identifying the lien.
Borrower shall satisfy the lien or take one or more of the actions set forth above w~hin 10 days of the giving of notice.
5. Hazard or Property Insurance. Borrower shall keep the Improvements now existing or hereafter erected on the
Property Insured against loss by fire, hazards included within the term 'extended coverage' and any other hazards,
Including floods or flooding, lor which Lender requires Insurance. This Insurance shall be maintained In the amounts
and lor the periods that Lender requires. The Insurance carrier providing the Insurance shall be chosen by Borrower
subject to Lender's approval which shall not be unreasonably withheld. If Borrower fails to maintain coverage described
above, Lender may, at Lender's option, obtain coverage to protect Lender's rights In the Property In accordance with
paragraph 7.

7. Protection of lender's Rights In the Property. If Borrower lalls to per/arm the covenants and agreements
contained In this Security Instrument, or there Is a legal proceeding that may slgnificantiy affect lender's rights In the
Property (such as a proceeding In bankruptcy, probate, for condemnation or for/ellure or to enforce laws or
regulallons), then Lender may do and pay for whalever Is necessary to prolectthe value of the Property and Lender's
rights In the Property. lender's actions may Include paying any sums secured by a lien which has priority over this
Securlty Instrument, appearing In court, paying reasonable attorneys' fees and entering on the Property to make repairs.
Although lender may take action under this paragraph 7, lender does not have to do so. .
Any amounts disbursed by Lender under this paragraph 7 shall become add~ionai debt of Borrower secured by
this Security Instrument. Unless Borrower and Lender agree to other terms of payment, these amounts shall bear
Interest from the date of dlsbursemenl at the Note rate and shall be payable, with Interest. upon notice from Lender to
Borrower requesting payment.
8. Mortgage Insurance. If Lender required mortgage Insurance as a condition of making the loan Secured by this
Security Instrument, Borrower shall pay the premiums required to maintain the mortgage Insurance In effect. If, for any
reason, the mortgage Insurance coverage required by lender lapses or ceases to be In effect, Borrower shall pay the
premiums required to obtain coverage substanllally equivalent to the mortgage Insurance previously in effect, at a cost
substantially equivalent 10 the cost to Borrower of the mortgage Insurance previousiy In effect, from an alternate
mortgage Insurer approved by Lender. If substantially equivalent mortgage Insurance coverage Is not available,
Borrower shall pay to Lender each month a sum equal to one-twelfth of the yearly mortgage Insurance premium beIng
paid by Borrower when the Insurance coverage lapsed or ceased to be In effect. Lender will accept, use and retain
these payments as a loss reserve In lieu of mortgage Insurance. Loss reserve payments may no longer be required, at
the opllon 01 lender, W mortgage Insurance coverage (in the amount and for the period that Lender requires) provided
by an Insurer approved by Lender again becomes available and Is obtained. Borrower shall pay the premiums required
to maintain mortgage Insurance In effect, or to provide a loss reserve, until the requirement for mortgage Insurance ends
In accordance w~h any written agreement between Borrower and lender or applicable law.
9. Inspection. lender or lis agent may make reasonable entries upon and inspections of the Property. Lender
shall give Borrower notice at the time of or prior to an Inspection speCifying reasonable cause for the Inspection.
10. Condemnation. The proceeds of any award or claim for damages, direct or consequential, In connection with
any COndemnation or other taking of any part of the Property, or for conveyance in lieu of condemnation, are hereby
assigned and shall be paid to Lender.

11. Borrower Not Released: Forbearance By Lender Not a Waiver. Extension of the time lor payment or
modification 01 amortization of the sums secured by this Security Instrument granted by Lender to any successor In
Interest 01 Borrower shall not operate to release the liability of the original Borrower or Borrrower's successors In
Interest. Lender shall not ba required 10 commence proceedings against any successor In Interest or rei use to extend
time lor payment or otherwise modify amortization 01 the sums secured by this Security Instrument by reason of any
demand made by the original Borrower or Borrower's successors In Interest. Any lorbearance by Lender In exercising
any right or remedy shall not be a waiver of or preclude the exercise 01 any right or remedy.
12. Successors and Assigns Bound; Joint and Several Liability; Co-signers. The covenants and agreements
01 this Security Instrument shall bind and benefrt the successors and assigns of Lender and Borrower, subject to the
provisions 01 paragraph 17. Borrower's covenants and agreements shall be joint and several. Any Borrower who
co-signs this Securlty Instrument but does not execute the Note: (a) Is co-signing this Security Instrument only to
mortgage, grant and convey that Borrower's Interest In the Property under the terms of this Security Instrument; (b) Is
not personally obligated to pay the sums secured by this Securit'llnstrument; and (c) agrees that Lender and any other
Borrower may agree to extend, modify, forbear or make any accommodations wtth regard to the terms of this Security
Instrument or the Note wtthoutthat Borrower's consent.
13. Loan Charges. If the loan se~ured by this Security Instrument is subject to a law which sets maximum loan
charges, and that law Is finally Interpreted so that the Interest or other loan charges collected or to be collected in
connection wtth the loan exceed the permitted limits, then: (a) any such loan charge shall be reduced by the amount
necessary to reduce the charge to the permitted limit; and (b) any sums already collected Irom Borrower which
exceeded permitted limits will be refunded to Borrower. Lender may choose to make this refund by reducing the
principal owed under the Note or by making a direct payinentto Borrower., If a refund reduces principal, the reduction
will be treated as a partial prepayment wtthout any prepayment charge under the Note.
14. Notices. Any notice to Borrower provided for in this Security Instrument shall be given by delivering it or by
mailing it by first class mall unless applicable law requires use of another method. The notice shall be directed to the
Property i\ddress or any other address Borrower designates by notice to Lender. Any notice to Lender shall be given
by first class mall to Lender's address stated herein or any other address Lender designates by notice to Borrower.
Any notice provided for In this Security Instrument shall be deemed to have been given to Borrower or Lender, when
given as provided In this paragraph.
15. Governing Lew; Severability. This Security Instrument shall be governed by federal law and the law'of the
Jurisdiction in which the Property Is located. In the event that any provision or clause of this Security Instrument or the
Note conflicts with applicable law, such conflict shall not affect other provisions of this Security Instrument or the Note
which can'be given effect wllhoutthe conflicting provision. To this end the provisions of this Security Instrument and
the Note are declared to be severable.
16. Borrower's Copy. Borrower shall be given one conformed copy of the Note and of this Security Instrument.

affecting the Property that Is In vlolallon of any Environmental Law. The preCeding two sentences shall not apply to the
presence, usa, or storage on the Property of small quantities of Hazardous Substances that are generally recognized to
be appropriate to normal residential uses and to maintenance of the Property.
Borrower shall promptly give Lender wrfllen notice of any Invesllgallon, claim, demand, lawsuU or other acllon by
any govemmental or regulatory agency or Private party Involving the Property and any Hazardous Substance or
Environmental Law of which Borrower has actual knowledge. If Borrower leams, or Is notlfled by any govemmental or
regulatory authorfty, that any removal or other remediation of any Hazardous Substance affecting the Property Is
necessary, Borrower shall promptly take all necessary remedial acllons In accordance wUh Environmental Law.
As used In this paragraph 20; 'Hazardous Substances' are those substances defined as toxic or hazardous
substances by Environmental Law and the following substances: gasoline, kerosene, other flammable or toxic
petroleum products, toxic pesllcldes and herbicides, volalile solvents, materials containing asbestos or formaldehyde,
and radioactive materials. As used In this paragraph 20, 'Environmental Law" means federal laws and laws of the
jUrfsdlctlon where the Property Is located that relate to nealth, safety or environmental protecllon.
NON-UNIFORM COVENANTS. Borrower and Lender further covenant and agree as follows:
21. Acceleration; Remedies. Lender shall give notice to Borrower prior to acceleration fOllOWing Borrower's
breach of any covenant or agreement In this Security Instrument (but not prior to acceleration under paragraph
17 unless applicable law provides otherwise). Lender shall notify Borrower of, among other things: (a) the
default; (b) the action required to cure the default; (c) when the default must be cured; and (d) that failure to cure
the default as speclfled msy result In acceleration of the sums secured by this Security Instrument, foreclosure
by Judicial proceeding and sale of the Property. Lender shall further Inform Borrower of the right to reinstate
after acceleration and the right to assert In the foreclosure proceeding the non-existence of a default or any other
defense of Borrower to acceleration and foreclosure. If the default Is not Cured as specified, Lender at Its Option

to direct the Prothonotary to reassess the damages in this matter, and in
support thereof aVers the following:
1. This is an action in Mortgage ForeClosure in which JUdgment was
entered by default on J~VUARY 6, 1999 in the amount of $93,967.60.
2, A Sheri ff 's Sale of the mortgaged premises was postponed or stayed
for the following reasons:
The Defendant (s) filed a Chapter 13 Bankruptcy

PLAINTIFF'S MOTION TO REASSESS DAMAGES
1. BACKGROUND OF CASE
Plaintiff uod Defendant (~) cotel-cd into .:l Promissory Note and Mortgage
Agreement, wherein Dcfend<1ot (.s) agreed to pay Plaintiff principal, interest,
late charges, real e~Jtate taxes, hazard insurance premiums and mortgage
insurance premi urns as sa i d monies became due.
In turn, Plaintiff's Note was
secured by a mortgage on the subject premises.
The Mortgage Agreement
indicates that in the event Defendant(s) defaults, Plaintiff may pay any
necessary obligations in order to protect its collateral, the subject premises.
In the case sub Judici.a, Defendant (s) failed to abide by the t40rtgage
Agreement by fail ing to tender numerous, promised monthly mortgage payments.
Accordingly, after Plaintiff determined that Defendant (5) were not going to
cure the default and bring the loan current, Plaintiff commenced a Mortgage
Foreclosure Action.
Judgment was subsequent.ly entered by the Court, and the subject property
is scheduled for Sheriff's Sale.
Because of the excessive period of time between the ini t iat ion of the
Mortgage Foreclosure Action, the entry of Judgment and the Sheriff's Sale date,
damages as previously assessed by the Court are outdated and must be increased
to include current interest, real estate taxes, insurance premiums, and other
expenses which Plaintiff has been obligated to pay under the Mortgage Agreement
in order to protect its interest.

In addition, Rule 1037{a) provides that the Court, on motion of a party,
may enter an appropriate judgment against a party upon default or admission.
If the Court has the power to enter judgment, it certainly has the power to do
a lesser act, to wit, reassess damages.

equitable powers to control the enforcement of a judgment and to grant any
relief until that judgment is satisfied. 20 P.L.E., Judgments Sec. 191. See

assessed following defendant's failure to file a responsive pleading in a
mortgage foreclosure action, a mortgagee "... could properly move the court to
amend the judgment to add addit ional sums due by vi rtue if the mortgage I 5
failure to comply with the terms of the mortgage agreement.. .!.9"~. at 24.
Becduse a judgment in mortgage foreclosure is strictly tn. r"~_~, it is critical
that the judgment reflect those amounts expended by the Plaintiff in protecting

III. CONCLUSION

with the understanding that it would recover the monies it expended to protect
