broken. consequently, I ask counsel to define what issues are
to be heard by this proceeding so we can schedule an appropriate

Dear Ms. Sunday and Ms. Meilton:
I received notice that Ms. Meilton filed an answer and
counterclaim on behalf of the Defendant raising the economic
claims of equitable distribution, alimony, alimony pendente
lite, and counsel fees and expenses. Inasmuch as economic
claims have now been filed, I am directing each counsel in
accordance with P.R.C.P. 1920.33(b) to file a pre-trial
statement on or before Friday, May 21, 1999. Upon receipt of
the pre-trial statements, I will immediately schedule a
pre-hearing conference with counsel to discuss the issues and,
if necessary, schedule a hearing.
I am proceeding on the assumption that there is not an
issue with respect to grounds for divorce, that the parties will
either sign affidavits of consent or that they have been
separated for a period in excess of two years. If my assumption
is not correct, please advise.

COUNT I
CLAIM FOR EQUITABLE DISTRIBUTION OF MARITAL PROPERTY
1, Plaintiff and Defendant are the owners of various items of personal property, furniture
and household furnishings acquired during their marriage which are subject to equitable distribution
by this court.
2, Plaintiff and Defendant are the owners of various motor vehicles, bank accounts,
investments, insurance policies and retirement benefits acquired during their marriage which are
subject to equitable distribution by this court.
COUNT II
CLAIM FOR ALIMONY UNDER THE DIVORCE CODE
3. The Defendant has no adequate means of support for herself except as provided for by
Plaintiff,
4. Plaintiff is retired from employment with the Federal Government and receives income
from said employment. as well as from a Navy pension and Social Security with approximate annual
income in excess of $30,000. Except for sporadic assignments, Defendant is currenlly unemployed
as a personal care assistant which position earned her $7.15 an hour.

Plaintiff, Henry M. Kirschman, by his attorney, Dawn S. Sunday,
requests that the Court issue a Decree of Annulment and in support thereof,
states the following:
1. Plaintiff is Henry M. Kirschman, who currently resides at 3522
September Drive, Apt. #3, Camp Hill, Cumberland County, pennsylvania.

Defendant is Sandra Y. Kirschman, formerly Sandra Y. Surrmers,
resides at 824 Meadow Lane, Camp Hill, Cumberland County,
3. Plaintiff and Defendant have been bona fide residents of the
Commonwealth for at least six lllDnths immediately preceding the filing of this
Complaint.
4. The Plaintiff and Defendant were married on May 1, 1994 in
Shiremanstown, Cumberland County, pennsylvania.
5. There have been no prior actions for divorce or for annulment
between the parties.
6. The Plaintiff avers that the marriage between the parties is
voidable pursuant to Section 3305(a) (4) of the Pa. Divorce Code based on the
fact that Plaintiff was at the time of the marriage, and is now, impotent.
7. Defendant was not aware of or did not believe the fact of
Plaintiff's impotence at the time of the marriage.
8. The parties have lived separate and apart since July 1994.
9. Plaintiff requests that the Court enter a Decree of Annulment
under Section 3305(a) (4) of the Pa. Divorce Code.

complaint was filed on February 11, 1999, averring the grounds

for the file which will ultimately result in the conclusion and

that has been reached between the parties is that after Mrs.
Kirschman withdraws the support action that is currently pending
in the Domestic Relations Office and cancels the support hearing
currently scheduled for September 3, 1999, and also signs a
written agreement stating the following -- and I will list
those -- in consideration of that, Mr. Kirschman will withdraw
the divorce action and have it dismissed and will agree to
retain Mrs. Kirschman on his Naval pension and federal pension
as his death beneficiary.
The terms of the agreement that is to be signed by
Mrs. Kirschman will waive all financial benefit from Mr.
Kirschman, again, except her status as beneficiary on the two
pensions; that she will agree not to seek either formally or
informally from Mr. Kirschman any money, funds, or any type of
financial benefit.
Also in the agreement, Mrs. Kirschman would agree
that in the event she were to seek a divorce in the future from
Mr. Kirschman, that she is waving all economic rights that she
may have under the Divorce Code to obtain alimony, alimony
pendente lite, support, equitable distribution, counsel fees and
expenses, or any other benefit that may have otherwise resulted
from the marriage to Mr. Kirschman.
MS. MEILTON: Just so the record is clear. The
parties are agreeing that Mrs. Kirschman will remain the
beneficiary on the military pension and federal pension and that
Mr. Kirschman will not do anything to hamper her ability to
collect on those at his death; that neither one is going to seek
any economic benefit from the other. I would like to make that
a reciprocal provision, that she will not come to him for money
and seek any benefits and he will not go to her for those as
well.
(A discussion was held off the record)
MS. MEILTON: Off the record there was a discussion
about whether we arc talking about death benefits and annuities
and the pilrtics' intont is thilt Mrs. Kirschmiln r:hollld r...ccivc
what we understand to be monthly benefits that would be
approximately $385.00 a month from the Naval pension and another
$1,100.00 a month from the federal pension. It is not intended
that Mr. Kirschman would have to change any of the beneficiary
designations as they now exist as long as wife is designated as
the beneficiary or survivor annuitant or whatever the proper
name is on those monthly payments.
THE MASTER: Counsel for husband has indicated that
she does not believe there has been any change to the pensions
by husband since the filing of the divorce complaint and that
the rights of the wife are not affected, therefore, by any
action that husband may have taken preceding today's meeting.
MS. MEILTON: The parties agree that Mrs. Kirschman
can contact either of the pension plan administrators to verify
her status as beneficiary/survivor annuitant or whatever the
proper designation is under the terms of our understanding, and
if necessary, Mr. Kirschman will sign any documents necessary to
permit her to get that information.
The parties also agree that this recitation of
their agreement accurately states the intent of the parties and
is a stipulation of counsel.
We will, within the next two (2) weeks, reduce the

AND NOW, comes the Defendant, Sandra Yvonne Kirschman, by and through
her attorneys. Tucker Arensberg & Swartz, and files the following Pre-trial Statement.
1. The marital and non-marital assets relative to this matter have been set
forth in the Inventory and Appraisement which was filed with the court on May 21, 1999.
2. Defendant does not expect to call any expert witness to testify at the time
of the hearing in this mailer.
3, Defendant will testify on her behalf and there will be no other witnesses
which the Defendant intends to call to testify on her behalf at the Master's Hearing. Defendant
will testify as to the assets and liabilities of the marriage and her income and expenses,
4. The following is a list of exhibits which Defendant intends to introduce at
the Master's Hearing:

1999, by ilnd between Henry Manheim Kirschman, hereinafter referred tu llS
"Husband", and Sandra Yvonne Kirschman, hcreir.ilfter rcfcrred to as "Wifc".
WITNESSETH:
and
WHEREAS, Husband and Wifc werc lawfully milrried on May 1, 1994;
WHEREAS, ccrtain differcnces have arisen between the parties as a
rcsult of which they havc scparatcd and now live separate and apart from one
another, and are desirous of scttling fully and finally their respective financial and
property rights and obligations as between each other, including, without limitation
by specification: the scttling of all matters between them relating to the past,
present and future support and/or maintenance of Wife by Husband or of Husband by
Wife; and in general the settling of any and all claims and possible claims by one
against the other or against their respective estates for equitable distribution of all
marital property; and a resolution of all mutual responsibilities and rights growing out
of the marriage relationship; and
WHEREAS, the parties hereto, after being properly advised by their
respective counsel, Husband by his attorney, Dawn S. Sunday, and Wife by her
attorney, Sandra L. Meilton, have come to the following agreement.
NOW THEREFORE, in consideration of the above recitals and the
following covenants and promises mutually made and mutually to be kept, the parties
heretofore, intending to be legally bound and to legally bind their heirs, successors
and assigns thereby, covenant, promise and agree as follows:
1. It shall be lawful for each party at all times hereafter to live
separate and apart from the other at such place or places as he or she may from time
to time choose or deem fit.
2. Immediately after execution of this Agreement by the parties,
Wife shall withdraw the Complaint for spousal support filed by her in the Domestic
Relations Office of Cumberland County, Pennsylvania, and docketed to No. 99
Support 1999, PACSES No. 827100718. Any arrearages which exist on said
account shall be .::ancelled and Wife shall take the steps necessary to cancel the
hearing which is presenting scheduled for September 3, 1999 in Court Room No.1,
Cumberland County Court House, Carlisle, Pennsylvania.

3. Immediiltely after execution of this Agreement by tho partIes.

to No. 98-6198 Civil Term, filcd vmh Cumberland County. Pennsylvania,
4. The parties acknowledge that Husband is the reclplOnt of two
pensions. one resulting from his enlistment with the United States Navy and the
other a Federal pension resulting from his employment with the Federal Government.
Husband receives gross monthly benefits of $710 for the Navy-military pension and
$2,239 for the Federal postal employees' pension. The parties agree that Wife is
currently designated as the survivor annuitant or beneficiary on said pensions.
It is the parties' understanding that, at the signing of this
Agreement, upon Husband's death. Wife is entitled to receive benefits under both of
the above-noted pensions in the form of a monthly annuity. It is anticipated that the
monthly annuity to Wife for the Navy-military pension would be approximately $385
and the monthly annuity to Wife for the Federal postal pension would be
approximately $1,100. 8y this instrument, Husband agrees that Wife shall continue
to be the recipient of these benefits upon his death and that during his lifetime, he
shall not take any position with respect to his retirement benefits and the parties'
anticipated passing of those benefits to Wife upon Husband's death which is
inconsistent with the position set forth in the preceding sentences.
To the extent that there are any benefits connected with the
pensions other than the monthly benefit payment which the parties intend to pass to
Wife upon Husband's death. those additional benefits shall be Husband's exclusive
property and he is free to dispose of said additional benefits as he so chooses.
Wife shall be responsible for reimbursing Husband each month for
the cost of maintaining the survivor annuitant option.
5. Husband agrees that he shall retain Wife on his health insurance
as long as he is able to do so. In return for this consideration, Wife shall reimburse
Husband the monthly cost which he incurs incident to providing her with this
coverage.
6. In return for Husband's agreement to have Wife remain as his
survivor annuitant on the pensions referenced above and in return for his further
agreement to keep Wife covered on his health insurance, Wife agrees that upon

Husband's dcath, shc will walVC 011 right. titlc, claim and intcrcst to any othcr assets
in Husband's cstate.
7. In the event that Husband does filo for n divorcc against Wife at
somc point in the future, all claims that oither Husband or Wifc havc against thc
other, including, but not limited to, Wife's elaim to Husband's pcnsion benefits,
claims for cquitablo distribution, alimony, counscl fees, oxpenses and alimony
pendcntc litc shall bc rcvivcd and this Agrecmcnt shall in no way prcjudice cithcr
party's ability to movc forward and raise thosc claims in subsequcnt divorcc
procccdings.
8. Wifc agrces that if, in the futurc, she files a divorce complaint
and procccds to obtain a divorcc against Husband, she hereby waives all of her
economic rights including, but not limited to, equitable distribution, alimony, alirnony
pendente lite, counsel fees and expenses under the Divorce Code, any claim which
she has to Husband's pensions referred to in Paragraph 4 above.
9. Subject to the provisions of this Agreement, each party waives
his or her right to alimony and any further distribution of property inasmuch as the
parties hereto agree that this Agreement provides for an equitable distribution of their
marital property in accordance with the Divorce Code of 1980. Subject to the
provisions of this Agreement, each party has released and discharged, and by this
Agreement does for himself or herself, and his or her heirs, legal representatives,
executors, administrators and assigns, release and discharge the other of and from all
causes of action, claims, rights or demands whatsoever arising out of their marriage,
except any or all cause or causes of action for divorce and except in any or all causes
of action for breach of any provisions of this Agreement,
10. Husband agrees that Wife is appropriately designated as sole
beneficiary/survivor annuitant on both pensions discussed in Paragraph 4 above and
to assure compliance with this Agreement shall provide Wife with signed
authorization forms which will enable her to contact the pension plan administrators
or other appropriate authority to verify that she is properly designated as surviving
spouse/beneficiary on the pensions.
11. The parties agree that while they rernain married, neither spouse
shall seek any economic benefit and/or financial assistance from the other spouse,
either formally or informally, including the filing of requests through the Court for

claims of alimony. spousal support or alimony pendente lite; or direct contact to the
other spouse.
12. Except as herein otherwise providod, each party may dispose of
his or her property in any way, and each party horeby waives and relinquishes any
and all rights he or she may now have or hereafter acquire, under the present or
future laws of any jurisdiction, to share in the property or the estate of the other as a
result of the marital relationship, including without limitation, dower, curtesy,
statutory allowance, widow's allowance, right to take in intestacy, right to take
against the will of the other, and right to act as administrator or executor of the
other's estate. Each will, at the request of the other, execute, acknowledge and
deliver any and all instruments which may be necessary or advisable to carry into
effect this mutual waiver and relinquishment of all such interests, rights and claims.
13. Each of the parties shall from time to time, at the request of the
other, execute, acknowledge and deliver to the other party any and all further
instruments that may be reasonably required to give full force and effect to the
provisions of this Agreement.
