Plaintiff alleges that he was in an automobile accident on November 9, I 994 in
Derry Township, Dauphin County, Pennsylvania. At that time, Plaintiff was
insured by Defendant, Erie Insurance Company. On February 12, 1999, Plaintiff
filed a Complaint against Defendant alleging that Defendant has not paid certain
chiropractic bills nor lost wages.

Facts:
Arguments: Defendant argues that Plaintiff's Complaint should be stricken for failure
to attach the underlying insurance policy, necessary to establish that Plaintiff was
in fact entitled to receive wage loss benefits and required under Pa.R.C.P. 1019(h)
and 1029(a)(4). Plaintiff has also failed to produce any records relating to
chiropractic treatment.
In the alternative, Defendant asserts that Plaintiff's claims for lost wages
should be dismissed because they were not covered by the policy and that if they
had been covered, there is a mandatory five day waiting period before wage loss
applies and Plaintiff only missed three days of work. Plaintiff's claim for lost
wages should be dismissed pursuant to Pa.R.C.P. 1028(a)(4).
Defendant also argues that Plaintiff's claims for interest, attorney fees and
costs should be dismissed because despite repeated requests, Plaintiff has failed to
provide Defendant with any medical records from which Defendant could make a
determination as to whether treatment was reasonable and necessary and payable
under Plaintiff's policy.

Plaintiffs claims are based on an undcrlying insurance policy. Despite this. Plaintiff failed to
attach the underlying policy to his Complaint.

C. Plaintiffs claims for interest, attorney's fees and costs should be dismissed.
Plaintiff and his healthcare providers failed to forward the bills at issue to Erie for
consideration of payment. Erie had no notice ofthese bills until receipt of the Complaint in the
above-referenced malter. It should bo noted thai Plaintiffs Complaint does not allege that the
bills had ever been submitted and rejected by Erie.
Moreover, despite repeated requests by counsel for Erie, Plaintiff has failed to provide
any medical records or reports for Erie's consideration. Without the requested information, Erie

COMPLAINT
AND NOW, comes the Plaintiff, Michael L. Blouch by his
attorney, Dusan Bratic, Esquire and files this Complaint, averring
the following:
1. Plaintiff, Michael L. Blouch, is an adult individual
residing at 1902 Daybreak Circle, Harrisburg, Dauphin County,
pennsylvania.
2. Defendant, Erie Insurance Company is a corporation
registered to do business in the state of pennsylvania, with a
branch office at 4901 Louise Drive, Mechanicsburg, Cumberland
County, pennsylvania.
3, On or about November 9, 1994 at or about 5:20 p.m. on SR
743 (Hersheypark Drive) near its intersection with Laudermilch
Road, Derry Township, Dauphin County, Pennsylvania, plaintiff,
Michael L. Blouch was operating a 1988 Ford Escort automobile when
he was involved in a motor vehicle accident which resulted in
bodily injury and harm to the Plaintiff,
4. By the terms of an insurance policy issued to Michael L.
Blouch, Defendant provided coverage for plaintiff in accordance
with the provisions of the pennsylvania Motor Vehicle Financial
Responsibility Law, 75 Pa.C.S.S 1702 et seq. and said policy of
insuranco was in full forco and offoct on Novembor 9, 1994.
5. As a result of this accident, Plaintiff, Michael L.
Blouch, has been and will be obligod to recoivo and undergo medical
attention and caro and to oxpond varioull sums of monoy or to incur
various expenses properly due and allowable under the terms of the
policy of insurance and Plaintiff, Michael L, Blouch, may be
obliged to continue to expend such surns or incur expenditures for
an indefinite period of time,
6. As a result of this accident, Plaintiff, Michael L.
BlOUCh, was off work 3 days and has incurred $900.00 in medical
bills which have not been paid and/or reimbursed for chiropractic
services to Renaissance Chiropractic Services, copies of said bills
are attached and marked as "Exhibit A," which is incorporated by
reference.
WHEREFORE, the Plaintiff, Michael L. Blouch, requests that he
be paid $900.00 by Erie Insurance and for his lost wages plus
attorney fees and costs.

AKENDED COMPLAINT
AND NOW, comes the plaintiff, Michael L, Blouch by his
attorney, Dusan Bratic, Esquire and files this Complaint, averring
the following:
1. plaintiff, Michael L, Blouch, is an adult individual
residing at 1902 Daybreak Circle, Harrisburg, Dauphin County,
pennsylvania.
2. Defendant, Erie Insurance Company is a corporation
registered to do business in the state of pennsylvania, with a
branch office at 4901 Louise Drive, Mechanicsburg, Cumberland
County, Pennsylvania.
3. On or about November 9, 1994 at or about 5:20 p.m. on SR
743 (Hersheypark Drive) near its intersection with Laudermilch
Road, Derry Township, Dauphin County, pennsylvania, plaintiff,
Michael L. Blouch was operating a 1988 Ford Escort automobile when
he was involved in a motor vehicle accident which resulted in
bodily injury and harm to the plaintiff.
4. By the terms of an insurance policy issued to Michael L.
Blouch, Defendant provided coverage for Plaintiff in accordance
with the provisions of the pennsylvania Motor Vehicle Financial
Responsibility Law, 75 Pa.C.S.S 1702 et seq. and said policy of
insurance was in full force and effect on November 9, 1994; a copy
of which is attached hereto marked "Exhibit B", which is
incorporated herein by reference.
5. As a result of this accident, Plaintiff, Michael L.
Blouch, has been and will be obliged to receive and undergo medical
attention and care and to expend various sums of money or to incur
various expenses properly due and allowable under the terms of the
policy of insurance and Plaintiff, Michael L. Blouch, may be
obliged to continue to expend such sums or incur expenditures for
an indefinite period of time.
6. As a result of this accident, Plaintiff, Michael L.
Blouch, has incurred $900.00 in medical bills which have not been
paid and/or reimbursed for chiropractic services to Renaissance
Chiropractic Services, copies of said bills are attached and marked
as "Exhibit A," which is incorporated by reference.
WHEREFORE, the Plaintiff, Michael L. Blouch, requests that he
be paid $900.00 by Erie Insurance plus attorney fees and costs.
