NOW COMES, the Borough of Carli sIc, by and through its solicitor, Edward L.
Sehorpp, Esquire, which filcs this Complaint based upon the following:
I. Plaintiff, Borough or Carlisle, is an incorporated municipality and body politic
with principal offices at 53 West South Street, Carlisle, Cumberland County,
Pennsylvania 17013,
2. Defendan;, Waste Managcment of Central PA, a division of Waste Management
of Pennsylvania, Inc., a/k!a Waste Management,lnc" of Central PA, a division of
Waste Management orPennsylvania,lnc"is a business Corporation doing business
in the County of Cumberland, Commonwealth of Pennsylvania, with business
address of 4300 Industrial Park Drive, Camp Hill, Cumberland County,
Pennsylvania 17011.
3, On Wednesday, February 18, 1998, in the early morning hour3, Defendant's
servant, agent and employee, was operating a trash collection vehicle in the front
of premises located at 19 North Hanover Street, Carlisle, Cumberland County,
Pennsylvania,

During said early morning hours on said datc. Dcfcndant's scrvant. agl'lll and
cmploycc attcmptcd to cmpty a waste dumpstcr at a constructioll sitc in lillnl of
said prcmiscs, whcll said scrvant, agcntor employcc drovc said wastc-hauling
vchiclc into cont<lct with, and/or opcrated the waste removal apparatus of thc
vchiclc in such a manner as to comc in contact with, a strcet light pole and fixture
owned by the Plaintiff and mounted on the sidcwalk in front of said prcmises,
Thc damages causcd to Plaintiffs property were caused by lhc negligcnt, careless
and rcckless conduct of Defendant's agcnt, scrvant or cmploycc, in thc altcrnative,
as follows:
A. In opcrating said vchicle too close to the curb and sidewalk and causing
Defendant's vchiclc to strike the pole and light fixture;
In emptying the dumpster locatcd at said premises in such a manncr as to
strike Plaintiffs light polc and fixture;
In throwing a canvass over the dumpster which hooked onto the light pole
and sevcral branches of the tree adjacent thereto, and thcn backing the
waste-hauling truck away from the dumpster thereby pulling down the
light fixturc and pole;
D, In failing to use due care under the circumstances,
As a result of the conduct of Defendant's scrvant, agcnt or employee, damages
were incurred by the Borough of Carlisle as follows:
A, Replacement of nine (9) foot Madison light, and related
components, see Exhibit "A", attached hereto:
Labor and benefit costs, see Exhibit "B", attached hcreto:
Fifteen (15%) pcrcent administration and processing
fee, see Exhibit "C", attached hcreto: $401.42
TOTAL DAMAGES: $3,077.53
WHEREFORE, Plaintiff demands of the Defendant the sum of Three Thousand
