Therefore, we need to look at two scenarios, Let us suppose that
the husband and wife (let LIS w;sllllle hllslJalld is the party in the
military) have separated and divorced before the husband has attained
his twenty years of service, In that situation, neither party would be
entitled to any benefit.
Let us assume that the parties have separated before husband has
his twenty years of service but subsequently are divorced after the twenty
years of service. It is my belief that wife would be entitled to share,
therefore, in the pension benefit. Of course, wife would share if the
parties separated and divorced after husband has attained his twenty
years of service,
Now let us turn to the issue that is pending with regard to the
county pension. Obviously, we do not have any twenty years of service
requirement.
If the parties are separated and divorced before vesting, then the
spouse as the alternate payee would be entitled only to benefit in the
contributions of the employee. If the parties separated and divorced after
vesting, then there is no question that the spouse would be entitled to
share in the full pension benefit of the employee. In the present case, we
have a situation where the employee was not vested at the time of
separation but subsequently vested before the parties obtain a divorce.
The value of the pension after vesting is, of course, substantially more
than the employee's contributions prior to vesting.
In the present case if we used a DRO with a coverture formula, it is
my opinion that the alternate payee spouse would be sharing in the
pension benefit using the vested value. Consequently, why should the
method of distribution affect the value? The suggestion is that if the case
law supports the argument that we use the date of separation value,
which in this case would only be the employee's contributions, then the
employee's spouse would not be entitled to benefit from any of the value
that was attributed to the benefit as a result of vesting. This, of course,
follows the scenario that the divorce has not occurred prior to vesting. If
we take the present value argument using the date of separation value
versus the deferred distribution method using a coverture formula, it
appears to me that we are going to be arriving at a different financial
result which on the one hand will be to the detriment of the alternate
payee and on the other hand to the benefit of the alternate payee.

Dear Mr. Mulderig and Mr. Scherer:
Discovery should be complete. Mr. Scherer had indicated in his
certification document that he was going to obtain some information on
Helen Sneed's county retirement. That document was dated in July
2002.
The action was commenced by the filing of a divorce complaint on
November 4, 1998, raising grounds for divorce of irretrievable breakdown
of the marriage and the economic claim of equitable distribution, An
amended complaint was filed September 7,2001, averring that the
parties have been separated since February 14, 1997. On the same date
an affidavit under Section 3301(d) was filed by the Plaintiff averring a
separation in excess of two years. Consequently, there does not appear
to be any issue with respect to grounds for divorce,
The only economic claim pending before the Master is equitable
distribution. Neither party has raised a claim for alimony or counsel fees
and costs.
In accordance with P.R.C.P. 1920.33(b) I am directing each counsel
to file a pretrial statement on or before Tuesday, September 24, 2002.
Upon receipt of the receipt of the pretrial statements, I will immediately

Before us are cross-appeals from an order of the Court of Common Pleas of Westmoreland
County directing equitable distribution of marital property. The parties' principal
dissatisfaction with the trial court's order ~e.r1.t.e.r~upon t!.lJsban.d's pension pia!' and profit
shar!l1g plan. For the reasons set forth herein, we must reverse and remand.
Husband and Wife were married on June 18, 1980, and separated on or about September 15,
1989. A complaint In divorce was flied by Wife on August 14, 1990, The action was bifurcated
and a decree In divorce was entered on August 26, 1992. No children were born of this
marriage. Husband Is self-employed In a family-owned and operated lumber and home
building business. Wife Is employed as a teacher. A Master's hearing was conducted on July
15, 1992, In his report filed January 141 1993, the Master recommended that the assets of
the marital estate be divided on an equal basis, Both parties filed exceptions to the report, A
hearing was held on July 16, 1993, by the trial court for clarification on the Issue of

Before addressing the Issues presented, we note that In reviewing challenges to an order of
equitable distribution, the trial court's decision will stand unless the court abused Its
discretion In formulating the order. Endy v. Endy, 412[*133] Pa, Super. 398,403,603 A.2d
641,643 (1992). We have stated that an abuse of discretion Is not found lightly, but upon a
showing of clear and convincing evidence. Miller v, Mlllerl 421 Pa, Super. 23, 28,617 A,2d
3751377 (1992), Under the abuse of discretion standard, the appellate court does not usurp
the trial court's duty as factflnder. (d. An abuse of discretion will be found by this court If the
trial court failed to follow proper legal procedures or misapplied the law. L1ciardello v,
L1clardel!o, 391J'a,.Super. 219, 222, 570 A.2dl062, 1063 (1990).

Accepting the parameters of our review we r 0 thp 1<<ulW2leSJ:Dted bv Wife. Wife
argues that the trial court aouse Its discretion by applying a coverture fraction to Husband's
pension and profit sharing plans which resulted In an unfair and unequitable valuation of the
marital component on the plans. The thrust of Wife's galm Is that because Husband's clans
are defined contribution plans, the use of a covertur @ctlon Is nnt required for determining
e ma or-= utlon.
Pension plans are generally of two basic types: the defined contribution plan and the
defined benefit plan, Recently, In Berrlngton v, Berrington, 534 Pa. 393, 633 A.2d 589
(1993), our supreme court discussed the two types of pension plans.
A defined benefit plan Is one InuV-!hlch the emplo}'er Eromlses a certain benefit; a

In a defined benefit plan, the benefit which Is promised Is calculated by a formula
defined in the pension plan provisions, The employer pays a specified benefit at
retirement, In some defined benefit plansl the employee contributes nothing; In
others, the benefits are based, in part, on what the employee contributes. The
employer's contribution to the planl however, varies from year to year based on
the amount which Is needed at any particular time to pay the benefits which are
due. Individual accounts of each employee's contribution, If any, are maintained,
but these accounts do not specify an employer contribution.
In a defined contribution plan, however, Individual accounts specify not only the
employee's contribution, but the employer's as well, The benefits to be paid In
the defined contribution plan, however, unlike those In the defined benefit plan,
are not fixed, for they depend upon the performance of Investments which are
made with the contributions,

their method of valuation Is different as well. As one commentator has explained:

Valuing the defined contribution plan
Defined contribution plans are similar to savings accounts, In the sense that the
value of each Individual account Is Indicated by current account statements. The
[marital portion subject to equitable distribution] In the employee's retirement
account Is equal to the value of the account at the date of separation. Valuation
becomes a matter of reviewing the latest account statement furnished to the
employee by the plan administrator. For example, if the parties separate on
January 1, and the latest account statement dated January 1 lists the fair market
value of the employee's account as $ 20,000, that figure Is the value of the
account for the purpose of disposing of the retirement Interest. When separation
occurs after the most recent statement, the fair market value of the account can
be approximated by determining what additional Investments were made on
behalf of the account and computing Increases, or decreases, In the account.
Further Information from the plan administrator should be available to make an
acceptably accurate determination In this Instance.
Valuing the defined benefit plan
It is the defined benefit plan which raises significant valuation problems. Unlike
the defined contribution plan, there Is no individual account statement which
provides the parties with the value of the plan at regular Intervals. All we know is
that if the employee stays alive and on the JOb[*13S] until retirement, he will be
entitled to receive a speCified monthly payment for the balance of his life,
Defined benefit plans are valued by actuarially determining their present value. .
. , The calculation of a present value requires discounting for mortality, based
upon group annuity mortality tablesl discounting for Interest, and discounting for
the probability that the employee will remain with the company to retirement
age. All of the various factors can be considered by the actuary In determining
the present value of the plan.

Wife argues on appeal that because no present value calculation Is necessary for the
valuation of a defined con~rlbutlon plan, then no coverture fraction calculation need be
applied to such a beneflt.(In effect, the value of the marital portion of the plan account is
readily ascertainable by simply reviewing the account for the dates and amounts of the
contributions.

As to the valuation of the pension benefits involved In the Instant case, we agree with Wife
that the use of a coverture fraction is unnecessary and unfairly reduces the portion of the
pension which should be available for distribution, However, we will not go so far as to direct
that the use of the coverture fraction is Inapplicable to all defined contribution plans,

portion of the defined benefit plan, it Is not an essential factor in the valuation process itself.

As set out earlier, because a defined contribution plan is very similar to a savings account
with valuation readily determinable, the marital portion of that valuation may also be readily
ascertainable without resort to a percentage calculation. If..lJPon reviewing the account

Moreover, no separate determination of Increase In value of the pre- marital portion Is
required, Following this valuation of the marital portion of the defined contribution plan the
only additional calculations left for the court would be to determine lhe dlstrlbullve share of
the pension and Its increase in value from date of seDaratlon to riate of distribution.
Turning to the case at hand, because the valuation of husband's defined contribution plans
appears readily ascertainable, [*137] the application of the coverture fraction Is
unnecessary. Therefore, we must vacate the order of the trial court and remand for
recalculation of the marital share of the plans. n2

Our decision today focuses on the particular pension and profit sharing plans before this
court and precludes the use of a coverture fractlor> calculation for this plan, However, we will
not at this time extend our holding to include all defined contribution plans. The valuation of
any pension plan must depend upon the characteristics of the Individual plan. To the extent
that there are defined contribution plans, which accounts will not show specific account
balances for the years of marriage, then It may well be that a coverture fraction may have to
be utilized In determining the percentage of the account balance which Is attributable to the
marriage, We also note that there may be Instances where a coverture fraction need not be
applied to a defined benefit plan. SpecifiCally, In t'le Instance where the coverture fraction
represents one hundred percent, Accordingly, we leave It to the discretion of the trial court
whether such a calculation Is necessary In any given case, The use of a coverture fraction has
nothing to do with the valuation of a pension plan Itself. Rather, Its sole purpose Is to
determine what part of the value of the plan Is attributable to the years of marriage and
hence marital property subject to equitable distribution. However, If this marital portion Is
c;1.eilr from the records of the plan Itself, the use of the cO"/c'rtu'ridractlor. Is unnecessary and
potentia Iy unfair to either the employee or non-emp ovee spouse,
The Issue presented by Husband on appeal challenges the method of distribution utilized by
the trial court of Husband's pension plans, Husband contends th.at .the trlaLcourteuedjn

Retirement benefits may be distributed by either an Immediate offset method which divides
the benefits at the time of the equitable distribution proceeding or the deferred distribution
method which allows the court to reserve jurisdiction over the benefits until they mature or

regarding discussion of two methods as they apply to a defined benefit plan.
The reasons why one method may be preferred over another have been set out as follows:
Deferred distribution. . . Is the preferred method of distribution for unvested
retirement benefits, since the risks of nonreceipt of the benefits are shared by

Because we are dealing Instantly with a defined contribution plan where valuation Is not a
factor, the only consideration before the court as to method of distribution is whether there
are sufficient assets available to make an adequate division of marital property. Husband
argues that he ha~ Insufficient liquid assets to satisfy Wife's marital portion of the pension
plans. He argues that a deferred distribution of the funds Is the better method or, In the

separation, the amount of $41,184.94 has become vested. It is not significant as to

The $41,000 was earned during the marriage and is, therefore, marital property. If
it had not been vested yet, we would have to use the deferred computation method
to determine at the time of the retirement, But since it is now vested, it is part of
her retirement. To conclude otherwise would lead to the ridiculous assumption that
in every divorce involving an active-duty military person there would be no pension
because the pension does not come into existence until retirement. This is clearly
absurd. Using the figures of the difference between the two payments, which is a
total of $6,073,60, I recommend a division of this pension and awarding to the wife

from the husband's Thrift Savings Plan, the sum of $3,036,80.

My client has requested that I proceed with the filing of a Divorce
Complaint. Enclosed, accordingly, is a certi f ied copy for your
records. We are in the process of having a certified copy served
upon Helen by certified mail, restricted delivery.
Enclosed please find for your information documentation received
from Carlisle Syntec providing an estimate of the value of Mr.
Sneed's defined benefit plan, as of March 1, 1997, of $10,299.70.
The marital value of this defined benefit is subject to a coverture
fraction with a numerator of 14.4 years (based on the period from
the date of marriage to the date of separation) and a denominator,
which will be equal to the total time that Mr. Sneed has
participated in the plan. As of this date, that would be 21 years.
Furthermore, with respect to Mr. Sneed's savings plan, this
reflects a balance as of February 28, 1997, of $85,259.14. This is
as per information received from Carlisle Syntec.
With regards to the letter that we had received from Helen, which
you had forwarded to us, and the information pertaining to her
benefits, it is not clear from the information as to what type of
retirement fund she has. It would be helpful if we could review
the information from the County as to the type of retirement

This action \'Jc.1.':i ,::un.;r;(~n\:cd by the f i1 ing of a
complaint in divorce 011 November '1, 1990, raising grounds
for divorce of irretrievable breakdown of tIle marriage.
Although counsel have previously filed an affidavit under
Section 3301(d) averring a separation in excess of two
years, nevertheless I counsel have prepared affidavits of
consent and waivers of notice of intention to request entry
of divorce decree for the parties' signature.
Those
affidavits and waivers will be signed today and filed with
the Prothonotary's office by the Master's office; therefore I
the divorce can conclude under Section 330l(c) of the
Domestic Relations Code.
The complaint raised the economic claim of

agreement of the parties not subject to any changes or
modifications except for correction of typographical errors
which may be made during the transcription. The parties,
when they leave the hearing room today, will be bound by the
terms of the agreement even though they do not subsequently
sign the agreement affirming the terms of settlement. The
agreement is going to be transcribed and sent to counsel and
the parties for review to determine if there are any
typographical corrections which need to be made. Those

2. With respect to retirernent be~0iits, the parties agree
that as of the date of separation, ["ebruary 28, 19971
husband's total retirement benefits were $95,558.00, and the
marital portion of his retirement benefits were $68,802.00.
Wife's total retirement benefits as of the date of
separation were $62,728.00, and all of wife's retirement
benefits were marital.
Husband shall transfer to wife through a QDRO the sum of
$5,000.00 from his 401(k) plan with Carlisle Syntec within
thirty (30) days. Wife's counsel shall prepare the QDRO.
Each party shall waive any further claim to the other
party's retirement benefits and each party shall become the
separate owner of their respective retirement benefits,
Further, each party shall sign any documents necessary to
formally waive or release their interest in the other
party's retirement benefits if necessary,
Wife will establish a 401(k) account, notify husband as to
the account number and where the account is held so that
husband can rollover the funds from his 401(k) into wife's

Dear Messrs Elicker and Mulderig:
I suspected when I reviewed the retirement information in this case that an
expert may be necessary to provide an accurate assessment of the values of the
retirement benefits in this case. I will consult with Helen Sneed regarding whether or
not she is willing to share in the expense of the retention of an expert.
I had been anticipating that I would receive complete retirement information from
Mr. Sneed when he filed his pretrial statement. I took this case over from Ed Harker,
Esquire and I had only sketchy information in my files regarding Mr. Sneed's retirement
benefits, I attached that to my pretrial statement, but I was anticipating receiving a
complete description of the nature of Mr. Sneed's retirement benefits with values as of
the present date,
I will contact my client to see whether or not she wants to spend the money on
an expert, but in the meantime, I need accurate retirement information from Mr. Sneed
in order to go forward,
