SUSPENDING OPERATING PRIVILEGE
TO THE COURT OF COMMON PLEAS OF CUMBERLAND COUNTY
Petitioner, Don Alvin Bair, Jr., by the undersigned counsel,
respectfully petitions the Court pursuant to 75 Pa. Cons. Stat.
Section 1550 for review of an order of the Department of Transpor-
tat ion suspending petitioner's operating privilege, and in support
thereof represents as follows:

Petitioner, Don Alvin Bair, Jr., is an adult individual
residing at 2132 canterbury Drive, Mechanicsburg, Cumberland

County, Pennsylvania.
2. Petitioner currently possesses a valid Pennsylvania
driver's license. His driver's license number is 17394081.
3. By letter dated October 7, 1998, petitioner was notified
in writing by the Department of Transportation of the entry of an
order suspending his driver's license for a conviction of Section
1543A of the Vehicle Code.
A copy of the notice is attached as
Exhibit A.
4. The suspension is improper because defendant is not
guilty of the offense charged. The defendant was not operating his
