g. During periods of temporary custody. Respondent has railed to
piek Elizaheth up Irom school, causing Elizabeth to walk home
without the assistanec of crossing guards.
h. When Respondent has exercised temporary custody of Elizabeth,
Respondent has evidenced a degree or disregard for the welfare of
Elizabeth in that, Rcspondent would take Elizabeth to bars where
Respondent would drink, smoke and place hets in the presence of
Elizabeth.
I. Respondent has evidenced a degree or disrcgard lar thc welfarc of

j. Respondcnt, in thc prcscnec of Elizabeth, is often verbally abusive
toward Petitioner.

activities, and in fact Respondent's home has heen in the past
raided by the police, and thereforc, Petitioner is eoneemed that
such an incident could happen again only this time in the presence
or Elizabeth.
I. Petitioner has always, and will continue to do so, rostered an
ongoing, loving relationship with Respondent.

WHEREAS, the parties, Dcnise E, Fclkcr and Gregory T, Clouser, wish to providc
amicably for custody and visitation with rcgard to thcir minor daughtcr, Elizabcth A. Clouscr.
NOW THEREFORE, the partics hercby stipulate and agrcc as follows:
I. Primary custody of thc partics' minor daughter, Elizabcth A. Clouscr, born July
II, 1991 shall be with plaintiff, Denise E. Felker.
2. Dcfendant, Gregory T. Clouscr, shall have temporary custody of Elizabcth as
follows:
a. Two nights a week from approximately 5:00pm - 8:30am thc following
morning. If thc following morning is a weekcnd morning thcn tcmporary
custody ccases at 12:00pm. Thc two nights will be thosc nights that
plaintiff is working hcr evening job.
New Years Day, Easter, Thanksgiving Day and Christmas Day from
5:00pm - 8:30am thc following morning.
Fathers Day from 9:00am - 8:30am the following morning.

to obtain hcr clothing and toiletries bceause she has indicated that she
is scared that the Respondcnt will be hiding in the home and will
hold the child against her will;
p) The child has expressed a desire to remain with the Petitioner and his
fiancee;

The Petitioner is concemed for the safely and welfare of the child
when in the care of Respondent;

The Petitioner does not believe it is in the child's best interest to be
lefl alone with Respondent at this time;

The Petitioner provides the child with a home with adequate moral,
emotional and physical surroundings as required to meet the child's

WHEREAS, the parlies. Denise E. Felker and Gregory T, Clouser. wish to provide
amicably for custody and visitation with regard to their minor daughter, Elizabeth A, Clouser.
NOW THEREFORE, the parties hereby stipulate and agree as follows:

II, 1991 shall be with plaintiff, Denise E, Felker.
2, Defendant, Gregory T. Clouser, shall have temporary custody of Elizabeth as
follows:
a. Two nights a week from approximately 5:00pm - 8:30am the following
morning, If the following morning is a weekend morning then temporary
custody ceases at 12:00pm. The two nights will be those nights that
plaintiff is working her evening job,
b. New Years Day, Easter, Thanksgiving Day and Christmas Day from
5:00pm - 8:30am the following morning.
c, Fathers Day from 9:00am - 8:30am the following morning,

upon consideration of the attached CUstody Conciliation
ordered and directed as follows:
1. A Hearing is scheduled in Court Room # c-";; , of the

1999, at b '15 o'clock, .-JL..m., at which time testimohy will be taken.
For purposes of this Hearing, the Mother shall be deemed to be the moving
party and shall proceed initially with testimony. Counsel for the parties
shall file with the Court and opposing counsel a Memorandum setting forth
each party's position on custody, a list of witnesses who will testify at
the Hearing, and a surnnary of the anticipated testimony of each witness.
These Memoranda shall be filed at l~ast ten (10) days before the Hearing
date.

2. Pending further Order of Court or agreement of the parties, the
temporary custody schedule set forth in this Order shall be in effect.
3. The Mother, Denise E. Felker, and the Father, Gregory 1'. Clouser,
shall have shared legal custody of Elizabeth Ann Clouser, born July 7,
1991. Each parent shall have an equal right, to be exercised jointly with
the other parent, to make all major non-emergency decisions affecting the
Child's general well-being including, but not limited to, all decisions
regarding her health, education and religion.
4. The Mother shall have primary physical custody of the Child.
5. The Father shall have partial physical custody of the Child two
nights each week from approximately 7:00 p.m. until 8:30 a.m. the following
morning. The overnight periods of custody under this provision shall be
scheduled on the nights that the Mother is working.
6. The Father shall have custody of the Child beginning at 5:00 p.m.
on the following holidays and ending at 8:30 a.m. on the morning after the
holiday: Christmas Day, New Years Day, Easter, and Thanksgiving Day. The
Father shall have custody of the Child on Father's Day from 9:00 a.m. until
8:30 a.m. the following morning.
7. The Father shall have custody of the Child for ten (10) vacation
days each ye~r with no more than five (5) days to be scheduled
consecutively. The Father's periods of custody under this provision shall
be scheduled on days when the Child does not have school.
O. In the event el ther pJrty is unable to provide care [or the Child

shall first contact the other pJrty to provide the opportunity to provide
