COMPLAINT
I. Plaintiffs Takai and Donald Vcnablc ("Plaintiffs") arc husband and wifc residing
at 20 Taylor Boulcvard, Harrisburg, P A.
2. Defendant Waync A. Grccnaway, Jr. ("Dcfcndant") is an adult individual rcsiding
at R.D.2 Box 354, A-I, Cogan Station, 17728.
3. The facts and occurrenccs hcrcinaftcr relatcd took placc on or about November 8,
1996 at approximately 2:00 p.m. at the interscction of U.S. Routc 15 and 32nd Street, Camp Hill
Borough, Cumberland County, Pennsylvania.
4. At the aforemcntioned date, time and placc, Ms. Venable was operating a 1993
Pontiac Grand Am travelling south on Route 15.
5. The 1993 Pontiac Grand Am was owned by Ms. Venable.
6. At the aforementioned date, time and placc, Defendant was operating a 1990
Pontiac Firebird proceeding south on Routc 15.
7. At the aforementioned ate, time and place, Defendant negligently, carelessly and
recklessly operated his vehicle so that it struck the rear of Ms. Venable's vehicle.

ll. The Iilregoing accident and all of the injuries lllld danlllges set forth hereinafter
sustained hy I'lailllilTs arc the direct and proxilllllle result oflhe negligence, earclcssness, wanton
and reckless conduct of Defendant in the operation of his motor vehicle as filllows:
(a) Failure 10 keep alert and maintain a proper watch lilr thc prescnce of other motor
vehicles having the right of way;
(h) Failing to hring his vehicle wilhin a Slop;
(c) Operating his vchicle Ilia speed too fust for conditions;
(d) Operming his vchicle in u rccklcss munncr;
(c) Failing to obcy traffic control dcviccs and/or thc upplicablc stop lights;
(I) Fuiling to kccp ulook oUlund/or to obscrvc tmffic;
COUNT 1- NEGLIGENCE

10. I'laintifTTakai Vcnablc sustaincd painful and scvcrc injuries, including but not
limitcd to ncck pain, low back pain, knce pain, and other injurics to thcse and other areas of the
body.
11. By rcason ofthc aforcsaid injurics sustaincd by Ms. Venable, she was forced to
incur liability for medical trcatment, mcdication, physical therapy, and similar expenses in an
effort to restorc herself to hcalth and claim is mudc therefor.
12. Bccausc of thc nature of hcr injurics, Ms. Vcnable has been advised and therefore
avers that shc may be forccd to incur similar cxpenses in thc future, and claim is made therefor.

13. As u rcsult ofthc uforcsilid injurics, Ms. Vcnublc is undcrgoing und in thc futurc
will undergo physicul und mcntul suffcring, inconvcnicncc in currying out duily uctivitics, loss of
Iifc's plcusurcs and cnjoymcnt. and claim is madc thcrcfor.
14. As a rcsult ofthc aforcsaid injurics, Ms. Vcnublc has bccn and inthc futurc nmy
bc subjcct to humiliation and cmbarrassmcnt and claim is madc thcrcfor.
15, As a rcsult ofthc aforcsaid injurics, Ms. Vcnablc has sustaincd work loss. loss of
opportunity and a permancnt diminution ofhcr carning powcr and capacity and claim is madc
thcrefor.
16. Ms. Vcnablc continucs to bc plagued by persistcnt pain and limitation and
therefor avcrs that her injury may be of pcrmanent nature causing rcsidual problems for thc
remainder of her life time and claim is made therefor.
17. As a result of said accident, Ms. Venable suffered damages to her vehicle in the
amount of$7.976.22 and the loss of use thereof.
WHEREFORE. Plaintiff requests this Honorable Court enter judgment against the
Defendant in an amount in excess of$35,OOO.OO, exclusive of interest and costs and in excess of
the jurisdictional amount requiring compulsory arbitration.
COUNT II - LOSS OF CONSORTIUM

18. The averments of paragraphs I through 17 are incorporated herein and made a
part hereof as if set forth in full.
19. Donald Venable hereby makes claim for the loss of the comfort, companionship
and consortium of Plaintiff Takai Venable as a result of the injuries she suffered as set forth
above.
