17, 197H in Harrisourg, Dauphin County, Pennsylvania. WIFE instituted an action in divorce

Pcnnsylvania on Novcmoer 10, 1998. The pleadings in thc case requested dissolution of the

2. The tcrms of this Agrccmcnt and thcir cffcct havc bccn fully explained 10 the WIFE
by her counsel, J<lnc M, Alex<lnder, Esquire. HUSBAND has bccn advised by his counsel,
Diane S. B<lker, Esquirc. The partics acknowledge that they have received independent legal
advicc from counsel of thcir choicc <lnd have bcen fully informcd <IS to their lcgal rights and
obligations or have chosen not to do so, The parties undcrstand thc facts <lnd acknowledge and
accept this AgrecmcJ1l as fair and equitable.
3. The parties h<lve attcmpted to divide their matrimonial property in a manner which
conforms to a just and right stand<lrd, with due regard 10 the rights of each party, It is the
intent of the parties that such division shall be tinal :md sh<lll forever determine their respective
rights. The division of existing marital property is not intended by the parties to constitute in
any way <I sale or exchange of assets. and the division is being effected without the
introduction of outside funds or other property not constituting a part of the marital estate,
4. Further, the parties agree to live separately <lnd apart from the other at any place or
places that he or shc may select. Neither party shall molest, harass. annoy, injure. threaten or
interfere with the other party in any matter whatsoevcr. E<lch party may carryon and engage
in any employment, profession, business or other activity as he or she may deem advisable for

enjoyment or disposition of any property now owncd and not specified herein or property

5. The consideration for this contract and agreement is the mutual benefits. to be.

not pay promptly and for the balance duc on thc loan over $3,000,00. HUSBAND will make
arrangcmcnts tilr a dircct transfer from his Mcmbcrs 1st F.C.U. account to WIFE's Members
1st F.C.U. account.
7.2) Bank Accounts:
a) Each party will opcn or has opencd their own bank account. Neither
party willmakc a claim against thosc funds. WIFE will Coopcrate and sign whatcver
documcnts arc requircd to have her name removed from HUSBAND'S account no. 117141 at
Members 1st FeU.
7,3) .l.'.cnsions:
a) WIFE maintains an IRA which had a value as of December 31,2000
of $7,708.23. HUSBAND will makc no claim for any portion of this fund and will agree to
executc any documents requircd to confirm said release,
b) HUSBAND maintains an IRA annuity account no. WY14 7866-7602
with Whcat First Union and no. WYI4 7866-7569 combined which had a value as of February
I, 1999 of $20,578.24. The parties agree that WIFE shall receive $13,722.16 from these
accounts and the remainder of the funds in the accounts shall become HUSBAND'S sole and
separate property.
c) HUSBAND Postal Thrift Savings Plan will be divided
cqually bctwcen thc partics. The value as of January 1999 was $79,306,00. WIFE

d) WIFE will make no claim tilr any portion of HUSBAND's National
Guard pension and will agrce to exccute any documcJ1ls rcquired to confirm said release.
8. lliIEREST IN V ACA TlillI...ffiQ,FERI.Y:
WIFE has agreed that she will waive any imcrcst shc may have in thc Equivest
Vacation Club. HUSBAND has been paying the mOl1lhly charges since separation, WIFE
will sign any documents neccssary to effectuate thc transter and HUSBAND will be
responsiblc for any debts rclated to the vacation club,
9, MARITAl. RESIDENCE:
The marital residence located at 9 Bourbon Red Road, Mechanicsburg,
Cumberland County, Pennsylvania 17055 was sold and the net proceeds divided by agreement
of the parties.
10. SPOUSAl. SUPPORT/ALIMONY:
The order for spousal support entered to Docket No. 00189 S 1999 Cumberland
County, has been terminated effective June 15, 2001 by agreement of the parties. However,
the remaining unpaid spousal support in the amount of $348.48 will be paid directly to WIFE
along with the unpaid child support in the amount of $496.90 at the rate of $100.00 per month
beginning July I, 2001 until the total amount of $845.38 is paid in full. For purpose of
income tax reporting payment of this amount will be treated as a debt between the parties.
Upon receipt of all funds due WIFE will notify Cumberland County Domestic
Relations that the arrearages have been paid in full.

12. CUSIODY AND SUPPORT OF CI/IL/):
Thcre is no longcr any issuc regarding cuslotfy or support for Anna J. Townsend,
daughter of [he parties, horn Fehrmlry 19, 1983. She is now eighteen and has graduated from
high school. The ortfcr for child support enlcred to Docket No. 00189 S 1999 in Cumberland
County has becn tcrminatetf as of Junc 6, 2001. The arrears of $496.90 will be paid directly
to WIFE hy HUSBAND as s~[ forth in paragraph 9 and WIFE will advise Cumberland Coumy
Domestic Relations when payment is completed.
13. The parties agree that simultaneously witb the signing of this Agreement they will
sign the necessary affidavits of consent and affidavits acknowledging notice of marriage
counseling in order to conclutfe the divorce action tiled by HUSBAND under the no-fault
provisions of the Pennsylvania Divorce Act.
14. The waiver or unenforceability of any term, condition, clause or provision of this
Agreement shall in no way be deemed or considered to be a waiver of or forfeiture of right to
enforce any other term, condition, clause or provision of this Agreement.
IS. SUBSEQUENT RECONCII.IATION: The parties agree that the terms of this
Agreement shall not be affected by their subsequent co-habitation or resumption of marital
relations, unlcss the parties otherwise specifically agrec in writing.
16. AGREEMENT TO BE INCORPORATED IN DIVORCE DECREE: The parties
agree that the terms of this Agreemem shall be incorporated, but not

merged. into any divorce decree which may bc entered wilh respeCl to Ihem. The parties

indemnity and hold harmlcss Ihe other from and against :my loss or liahilily for any such tax
deficicncy or asscssmcnt and any intercsl, penalty and cxpensc incurrcd in connection
therewith. Such tax, interest, penalty or expense shall hc paid solcly and cntirely by thc
individual who is finally delerlllincd to he the causc of thc misrcprcscntations or failures 10
disclose thc nature and extent of his or hcr separate income on Ihe aforcsaid joint returns.
18. .BANKRlTPTCY: It is hereby understood and agreed by and belween Ihe parties
that their obligations pursuant to this agrecment shall not bc affected by any bankruptcy
proceeding and shall not be deemed to constitute or he a dischargeable debt of a bankruptcy.
Both parties warrant that he/shc has not heretotore instituted any proceedings pursuant to the
bankruptcy laws nor are there any such proceeding spending wjth respect to him/her which
have been initiated by other.
19. MlTTlIAI. COOPERATION: Each party shall, at any time and from time to time
hereafter, take any and all steps and execute, acknowledge and deliver to the other party any
and all further instruments and/or documents that the other party may reasonably require for
the purpose of giving full force and effect 10 the provisions of this Agreement.
20. ENFORCEMENT OF AGREEMENT: If either party breaches any
