STIPULATION AGAINST LIENS
THIS AGREEMENT made the 9th of November, 1998, by and
between William H, Goodling,
AND
Damian P. Kopec and Georgia S, Kopec, his wife, hereinafter
referred to as Owner, whereby the former undertook and agreed to
erect and construct a single family dwelling on that certain lot
of ground situate in
Lot #602, 3712 Leyland Drive, Mechanicsburg, PA. as per attached
legal:
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of ($1.00) Dollar
to william H. Goodling in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned
in the agreement aforesaid, for themselves and their
subcontractors, and all parties acting through or under them,
covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for themselves, their
subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's
liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right of lien, shall be
an independent covenant.

LEGAL DESCRIPTION
ALL THAT CERTAIN tract of land situate in Hampden Township,
Cumberland Coullty, Pennsylvania, being Lot No, 602, as shown on
the Plan entitled Kingswood Final Subdivision Plan of Phase IIIB,
dated December 6, 1996, last revised June 11, 1997, and recorded
in Cumberland County Plan Book 74, Page 149, more particularly
bounded and described as follows:
BEGINNING at an iron pin, lying in a northerly right-of-way
line of Leyland Drive (50' foot right-of-way) and being a
southerly corner of Lot No. 601; thence along Lot No. 601, North
14 degrees 17 minutes 03 seconds East, 125.00 feet to an iron
pin, being an easterly corner of said lands and lying in a
southerly line of lands now or formerly of william H. and Ruth S.
Shellabear; thence along lands now or formerly of Shellabear and
lands now or formerly of Gary L, and Kathleen A. Milbrand Living
Trust, South 75 degrees 42 minutes 57 seconds East, 100.00 feet
to an iron pin, lying in a southerly line of lands now or
formerly of Milbrand, and being a northerly corner of Lot Uo.
603; thence along Lot No. 603, South 14 degrees 17 minutes 03
seconds West, 125.00 feet to an iron pin, being a westerly corner
of said lands and lying in a northerly right-of-way line of
Leyland Drive; thence along said right-of-way line, North 75
degrees 42 minutes 57 seconds West, 100.00 feet to an iron pin,
being the place of BEGINNING. CONTAINING 0.287 acres and being
known and numbered as 3712 Leyland Drive.
UNDER AND SUBJECT, NEVERTHELESS, to Declaration of Kingswood,
Phase IIIB, a Planned Community, dated August 27, 1997, and
recorded August 28, 1997, in Cumberland County Miscellaneous Book
555, Page 996.
