2. Thc Dcfcndants arc Thomas E. Mastcn and Robbin R. Mastcn. sui juris. who reside at 10
Sandy Bollom Road. Cumbcrland County, Carlisle. Pennsylvania.
3. On February 26. 1998, Plaintiffs purchascd their house at 17 N. Acorn Drive, South
Middlcton Township. Cumberland County. Pcnnsylvania. from Dcfendants. the previous
rcsidcnts of said homc.
4. By Sellcr's Property Disclosure Statcmcnt, datcd October 26, 1997. (copy attached and
incorporatcd hcrein as Exhibit ";\"), Delcndants rcprcsented to Plaintiffs. and Plaintiffs'
justifiably relied thcrcon. thc ccntral air conditioning unit was in good working order.
5. Thc first time Plaintiffs attcmptcd to usc thc ccntral air conditioning they discovered the unit
did not producc cool air.
7. Timothy Lcbo dctcrmincd thatthcrc was a Icak inthc air conditioning unit that allowed all
the Freon gas to cscapc.
6. Plaintiffs contactcd Timothy LdJO, Plumbing and Hcating contractor, to examine the central
air conditioning systcm. Lcbo's addrcss is 1'. O. Box 206. Plainficld, Pennsylvania 17081.
8. Timothy Lcbo also discovcrcd scvcral caps from Frcon rccharging canisters laying next to
the air conditioning unit indicating that Dcfcndants had previously refilled the system on
numerous occasions.

I. Plaintiffs, in their Complaint filed on or about December 18, 1998, seek damages
from Defendants Thomas E. Masten and Robbin R. Masten, his wife, (hereinafter "Masten") for
