GOODLING CONSTRUCTION, a sole proprietorship, hereinafter referred to as Contractor, AND KEITH R. NEW AND FLORA M. POSTERARO-NEW, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Hampden, Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 3704 Leyland Drive (Lot 606) Mechanicsburg, Hampden Township, Cumberland County, PA. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covp.nant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. L ~ "': Exhibit "A" ALL THAT CERTAIN tract of land situate in Hampden Township, Cumberland County, Pennsylvania, being Lot No. 606, as shown on the Plan entitled Kingswood Final Subdivision Plan of Phase IIIB, dated December 6, 1996, last revised June 11, 1997, and recorded in Cumberland County Plan Book 74, Page 149, more particularly bounded and described as follows: BEGINNING at an iron pin, lying in a northerly right of way line of Leyland Drive (50 foot right of way) and being a southerly corner of Lot No. 605; thence along Lot No. 605, North 14 degrees 13 minutes 32 seconds East, 128.90 feet to an iron pin, being an easterly corner of said lands and lying in a southerly line of lands now or formerly of Daniel E. Whitaker, Jr.; thence along lands now or formerly of Whitaker and lands now or formerly of Clark Edward and Nancy G. Bretz, South 78 degrees 02 minutes 23 seconds East, 115.00 feet to an iron pin, lying in a southerly line of lands now or formerly of Bretz, and being a northerly corner of Lot No. 607; thence along Lot No. 607, South 30 degrees 25 minutes 29 seconds West, 103.18 feet to an iron pin, being a tlesterly corner of said lands and lying in a northerly right of way line of the Leyland Drive cul-de-sa (60-foot radius); thence along said right of way line, along a curve to the left having a chord bearing of South 81 degrees 11 minutes 27 seconds West, a chord distance of 61.58 feet, a radius of 60.00 feet, and an arc length of 64.68 feet to an iron pin; thence continuing along said right of way line, along a curve to the right having a chord bearing of South 77 degrees 18 minutes 00 seconds West, a chord distance of 22.69 feet, a radius of 25.00 feet, an arc length of 23.55 feet to an iron pin; thence continuing along said right of way line, North 75 degrees 42 minutes 57 seconds West, 9,23 feet to an iron pin, being the Place of BEGINNING. CONTAINING 0.252 acres and being known and numbered as 3704 Leyland Drive. UNDER AND SUBJECT, NEVERTHELESS, to one-half of a 30-foot sanitary sewer easement along its eastern boundary. BEING the same premises which Zimmerman Building COrporation granted and conveyed to Keith R. New and Flora M. Posteraro-New, Borrowers herein.
