Plaintiff is Ocwen Federal Bank FSB (hereinafter "Ocwen"), a corporation with registered offices located at The Forum, Ste. 402, 1675 Palm Beach Lakes Blvd., West Palm Beach, FL 33401. 2. Defendants are J, Robert Bock and Cecilia M. Bock, adult individuals with a last-known address of 1342 Kiner Blvd" Carlisle, PA 17013, C,IDlANEICOMPLAINIBOCK. DOC 3. On February 5, 1990. defendanls made. execuled and delivered a Promissory Note, inter alia, 10 Commonweallh Mortgage Company of America, L.P, for a loan made by illo Ihem. Attached hereto as Exhibit. A. and made a part hereof is a true and correct copy of said Promissory Note, Said Promissory Note accompanies a Mortgage on premises 1342 Kiner Blvd" Carli~le, PA dated February~, 1990 and recorded February 7. 1990 in the Office for the Recording of Deeds in and for Cumberland County, Mortgage Book No, 966, page 97. 4. Through a series of Assignments, all of which are of record, and all of which are incorporated herein by reference, the aforesaid loan was ullimately assigned 10 Berkeley Federal Bank & Trust FSB, now known as Ocwen Federal Bank FSB, the within Plaintiff by Assignment recorded February 19. 1997 in Book 540, P. 1086. 5. The said loan is in defaull as a resull of the failure to pay the monthly installments of $932.52 due on January I. 1994 and on the first day of each month thereafter. 6. The following is due on the loan: PRINCIPAL BALANCE $ 74,825.07 2,468.96 INTEREST (accrued thru 10/31/98 of $2,468.96. Interest after 10/31/98 shall accrue at the per diem rate of $19,75,) LATE CHARGES (accrued thru 10/98 of $179.35. In accordance with Section 403 of Act No, 6 of 1974, no notice was required because the original principal amount of the loan was in excess of $50,000.00. 8, In accordance with Act 91 of 1983, notice was sent to defendants and no response was made in the appropriate period of time, A copy of said notice is attached hereto as Exhibit "B". 9. Pursuant to the Fair Debt Collection Practices Act, 15 U.S.C, ~ 1692 et seq. (1977), Defendants rnay dispute the validity of the debt or any portion thereof. If Defendants do so in writing within thirty (30) days of receipt of this pleading, Counsel for Plaintiff will obtain and provide Defendants with written verification thereof; otherwise, the debt will be assumed to be valid.
