Sharp, by and through his attorneys, Caldwell & Kearns, and submits this Complaint against the Defendant, Coleman Spas, Inc., stating in support thereof, avers as follows: 1. Plaintiff. Ira J. Sharp, is an adult individual currently residing at 11 Raspberry Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 2. Defendant, Coleman Spas, Inc., is a corporatl.on duly organized and existing under the laws of the State of Arizona with J a place of business located at 25605 South Arizona Avenue, Chandler, Arizona, 85248, 'J .c. 3, On or about February 25, 1995, Bob's Indoor Spa's [~' , installed a spa in Plaintiff's home. 4. On the aforementioned date, approximately five hundred (500) gallons of water were caused to be released from the spa into Plaintiff's basement, thereby causing extensive damage to > ~~t, (i\ ~:~ Plaintiff's home and its contents, 3 : , f'~ 5. Plaintiff avers that the water release into the basement was caused by a premature brake in the plastic fitting which connected to the ozonizer of the spa. 7. The aforementioned water release resulted in extensive damage to the structural and personal items of Plaintiff, including, but not limited to the carpet, drywall and doors. 8. As a proximate result of Defendant's failure to manufacture the spa correctly, PlaIntiff suffered a total loss of $5,533.57. COUNT I NE.GL.I..GE.liCE 11. Paragraphs 1 through 10 of Plaintiff's Complaint are incorporated herein as if fully set forth below. 12. The aforementioned defect existed at the time the product left Defendant's care, custody and control, and rendered the product unreasonably dangerous for its intended use. 17. As a result of the defective nature of the spa, and/or plastic fitting of the spa, Defendant, Coleman Spas, Inc., ~s strictly liable to Plaintiff pursuant to 5 402A of the Restatement (Second) of Torts as more specifically set forth below: (a) Failing to properly and adequately design the spa and/or plastic fitting; (b) Failing to properly and adequately manufacture the spa and/or plastic fitting; (c) Failing to warn Plaintiff of the dangerous nature of the spa and/or plastic fitting; (d) Placing the spa in the stream of commerce in a defective condition, which such condition existed at the time Defendant tested, inspected and manufactured the spa and/or plastic fitting.
