Your affiant is a Detective in the Cumberland County District Attorney's Office, Criminallnvcstigation Division and have
been so employed for thc past 2 years.
On September 28, 1999, there were two letters reeeived by the Vietim Witness Department of the Cumberland County
District Attorney's Office from the victim, Cynthia Klein. These letters had becn sent to Ms. Klein by the Defendant from
Cumberland County Prison. With each letter was the envelope it was scnt in with a return address for Cumberland County Prison and
the Defendant's name written above the re{um address. Additionally, the envelopes were addressed to Mikaila Foster, the
Defendant's daugbtcr. Four additional letters were imercepted from the Cumberland County Prison, prior to them being sent to the
Plaintiff.
These acts are in violation of paragraphs 3 and 4 of Final Protection Order 98.4689, which read: Defendant is prohibited
from having ANY CONTACT with the Plaintiff at any loealion, including, but no limited to, any contact at the Plaintiff's scbool,
business or place of employment. Defendant is specifically ordercd to stay away from the Plaintifrs residence for tbe duration of this
Order; Defendant shall not conlact the Plaintiff by telephone or by any other means, including third parties,

PROBABLE C^USE BELIEF IS BASED ON THE FOLLOWING FACfS AND CIRCUMSTANCES:
Your am30t is a Detective in the Cumberland County District Attorney's Office, Criminallnvcsligation Division and have
been so employed for the past 2 ycars.
On September 28,1999, there wcre two letters received by Ihe Viclim Witness Department of the Cumberland County
District Attorney's Omce from the victim, Cynthia Klein. Thesc letters had bccn sent to Ms. Klein by the Dcfendant from
Cumberland County Prison. With each letter was thc envelopc il was scnl in with a return address for Cumberland County Prison and
the Defendant's name written above the retum address. Addilionally, the envelopes were addressed to Mikaila Foster, Ihe
Defendant's daughter, Four additional letters were intercepted from the Cumberland County Prison, prior to them being sent to the
Plainliff.
These aclS are in viola lion of paragraphs 3 and 4 of Final Prolection Order 98.4689, which read: Defendant is prohibited
from having ANY CaNT ACf with the Plainliff at any localion, including, but no limited 10, any contact at thc Plaintiffs school,
business or place of employment. Defendant is specilieally ordered to stay away from thc Plaintiffs rcsidence for the duration of this
Order; Defendant shall not eontact the Plaintiffby telephone or by any other means, including third parties.

finds that the defendant, David Allen Foster, has abused the

10, The fllcts of the most recenl incident of ahuse arc as
follows: On several occasions since thc end of October 1998, the
defendanl has mai led several IInwanled letters, packages, and
flowers to the plaintiff's residence, a residence she had
not disclosed to him hecause she feu red further ahuse, and
to her place of employment saying that "soulmates are
forever" and"' will IllwllY~ love you," The defendant also
made several harassing telephone cal Is to the plaintiff's
residence and her place of employment causing her to fear
for her safety,
It. Defendanl has committed the fOllOWing prior acts of abuse
against Plaint i ff and the minor chi Idren:
Since May 1996, three Protection from Abuse Orders were
entered by the Courts of Arizona on behalf of the plaintiff,
The plaintiff's fear of abuse is exacerbated because of the
defendant's history of abuse which included, but was not
I imi ted to, the follOWing: grabbed the plaint i ff by the
neck piCking her up off of the ground and threatening to
kill her saying, "This is the day you die"; slammed her head
against the kitchen door knOCking her unconscience and
causing the door to crack; threw her onto the ground;
pushed, choked, shoved, hit, punched, and kicked her;
threatened to burn down the house if she left; broke the
telephone and disabled her vehicle so that she could not get
help; burned her on the face with a cigarette; sprayed water
in her face causing her to choke; threw her onto the kitchen
floor causing her to land on her face and injure her cheek;
forced her to have sexual relations with him; threatened to
kil I her if she ever left him; pointed a loaded shotgun at
her and threatened to kiJ I her, and broke down her door with
a sledgehammer.
In August 1998, the most recent Protection from Abuse
Order expired after six months according to ordinary
practice in Arizona,
