AND NOW, comes the Petitioner, UGI UTILITIES, INC.. by and through its attorney.
Kevin T. Fogerty. Esq.. and respectfully petitions this Honorable Court as follows:
I. The Petitioner, UGI UTILITIES INC. ("UGI"), is a corporution organized and
existing under the laws of the Commonwealth of Pennsylvania, ami is principally engaged in the
business of producing. purchasing, storing, trunsporting and distributing natural gas. The
Petitioner maintains its principal office and place of business in Valley Forge, Montgomery
County, Pennsylvania, and has as its mailing address P.O. Box 858, Valley Forge. PA 19482.
2. The Petitioner, a public utility, by virtue of the power of emincnt domain as
provided in the Pennsylvania Business Corporution Law of 1988. 15 P.S. Section 1511, and by
resolution duly adopted by the ExecutivelNominating Committee of its Board of Directors on
October 27, 1998, as evidenced by the Secretary's Certificate attached hereto and marked as
Exhibit" A," has determined and concluded to cnter upon, take and appropriate for a public
purpose, an eascment and right of way over and upon certain parcels of land located in Silver
Springs Township. Cumberland County, PA, by route surveyed and located for the purposes of

1988).
4. Since in or about February, 1998, the Petitioner, through its agcnts and

cmployees, has attempted to securc an agreemcnt for a pipelinc easement and right of way over
and through the subject parcel of land from thc Owner referenced in Paragraph 3 hereinabove. [n
have not agreed upon reasonable compensation to be paid therefor and to aftix the amount of
that respect, the Petitioner has attempted to contact the Owner to try and agree as to the damages
properly payable, but to date has been unable to do so for thc purpose of entering into an
agreement! contract for such easement and right of way; hcnce. the Petitioner and the Owner
damages, ifany, which would be occasioncd by the taking of said casement and said right of way
and the construction of said pipeline.

which the Owner/Obligee has ownership interests and/or rights, to construct a pipeline, together
with such related equipment and siructures as may be required for the transmission of natural gas
over and upon said certain land of the Owner/Obligee, situated in Silver Springs Township,
Cumberland County, PA (with said parcel ofland hereinafter being referred to as "the
Premises"), and with the subject easement and right of way being herein taken and condemned
being as depicted on the plan drawings attached hereto as Exhibit "A." The easement herein
condemned by the CondemnorlPrincipa! shall not interfere with said Owner/Obligee's use and
enjoyment of said Premises except for the pUl]loses of said pipeline, exceptlhat no buildings or
permanent non-movable structures shall be placed or erected by the Owner/Obligee or any other
persons on or above the surface of the land encompassed by this casement and right of way.
NOW, THE CONDITION OF THIS OBLIGATION IS SUCH, that if the above-boW1d
UOl UTILITIES, INC., its successors or assigns, or the said SAFECO INSURANCE
COMPANY OF AMERICA, Surety, its successors or assigns, or either of them, do and shall

Premises"), and with the subject easement and right of way being herein taken and condemned
being as depicted on the plan drawings attached hereto as Exhibit "A." The easement herein
condemned by the CondcmnorlPrincipal shall not interfere with said Owner/Obligee's use and
enjoyment of said Premises except for the pUl]loses of said pipeline, exceptlhat no buildings or
p=anent non-movable structures shall be placcO or erected by the Owner/Obligee or any other
persons on or above the surface of the land encompassed by this casement and right of way.

Pelilioner. and therefor aver. that subject to agreement on reasonable compensation.
Respondents were prepared to grant an easement and right of way to Petitioner located
substantially along the southern boundary of the Karkul'f Homestead. likewise and
substantially the southern boundar)' of the Omilled Property, and that Petitioner refused to
negotiate in good faith over the said relocation of the easemeill and right of way.

Homestead for its own selfish gain and has. by virlue thereoC eleeled 10 impose the
burden therefore on the Respondents.
10. The purported or altempled condcmnalion of an easement and right of way
on or across the Karkuff Homestead is a gross abuse of discrelion" is arbitrary and
capricious. would constitute a taking beyond which is reasonably required for the

comprised of appriscd of approximalcly 15.5944 acres, as morc fully dcscribcd in Deeds
recorded at the Cumberland County Rccordcr of Deeds Office, at Dced Book Volume
E33. Pagc 944, dated February 18,1998, and al Deed Book Volumc 104, Page 1032,
dated April 28, 1994, respectively.
3. Paragraph 2 of the Petition avers that the Petitioncr "has determined and
concluded 10 enter upon, take and appropriate for a public pUl]lose, an easement and right
of way over and upon" lhe Propeny for purposes of locating and maintaining a natural gas
transmission or distribution line on or across lhe said Property.
4. The Petition fails to describc all of Rcspondent's contiguous real estate put to
a unified purpose, in that it fails to recognize two tracts of land owned by Respondents,
consisting of approximately 2.35 acres, as morc fully described in tbe Deed recorded at
the Cumberland County Recorder of Deeds Officc at Deed Book Volumc 31-N. Page
7 \ 2. datcd October 15, 1985, with improvcments thercon. including the pcrmanent
residence of Rcspondcnts (hercinafter the "Omitted Propcrty"), which is contiguous to the
Property.

6. Thc placcment and location of thc cascmcnt and right of way sought by a
purponcd claim of emincnt domain by Pctitioncr, as dcpictcd on thc plan drawing
idcntificd as Exhibit "A" to thc Bond For Damagcs Undcr Right Of Emincnt Domain
attachcd to thc Pctilion as Exhibit "B" (hcrcinafter "Plan Drawing") is arbitrary,
capricious and unreasonable in that it transccts the Karkuff Homcstcad through the
interior thereof and passes in the immediate vicinity of Respondents' home, thereby
maximizing the potential negative impact on Respondents' use and enjoyment oflheir
propeny.
7. The pUl]lorled or attempted condemnation ofan casement and right of way
on or across the Karkuff Homestead as depicted in the Plan Drawing by Petitioncr is
patently unreasonable and demonstratcs palpable bad faith in that Respondents advised
Petitioner, and therefor aver, that subject to agreement on reasonable compensation,
Respondents were prepared to grant an casement and right of way to Petitioner located
substantially along the southern boundary of the Karkuff Homestead, likewise and
substantially the southern boundary of the Omitted Property. and that Petitioner rcfuscd 10
negotiatc in good faith over the said relocation of the eascmcnt and right of way.
8. The purported or attemptcd condemnation of an eascment and right of way

on or across tlw Karkull'llomcstcad is arbitrary. capricious. unrcasonably cxcessive and
unnccessary inasmuch as the Rcspondcnts arc adviscd. and thcrcforc aver. thalthc n~tural
gas transmission or distribution linc intcndcd Itl hc constructcd and m:linlaincd by
Pctitioncr for thc purposc of scrving anothcr privatc propcrty. (to wit. thc Evergrccn
rcsidcntial subdivision immediatcly .Idjaccntto the Karkuff I (omestcad). can be routed
along and lhrough the public right of way currcmly existent in Statc Road. from the point
in the aforcmcntioncd State Road east of the Karkurrllomestead whcrc Pctitioncr's
natural gas linc now exisls, westerly along said road past the Karkuff Homcstead to the
entrance road of the said Evergreen residential subdivision, rather than through or across
Respondcnt's propeny.
9. The purponed or atlempted condemnation ofan casement and right of way
on or across the KarkuffHomestead is arbitrary, capricious, unreasonable and
demonstrates palpable bad faith inasmuch as Petitioner intends to provide natural gas
distribution service to the adjoining landowner-developer of the Evergreen residential
subdivision and, rather than availing itself of the public right of way currently situated
along State Road. bas chosen instead to merely "cut the corner" by traversing the Karkurr
Homestead for its own selfish gain and has, by vinue thereof, elected to impose lhe
burden therefore on the Respondents.
10. The purported or attempted condemnation of an easement and right of way
on or across thc Karkuff Homestead is a gross abuse of discrction" is arbitrary and
capricious, would constitute a taking beyond which is reasonably required for the
purposes averred in thc instant Petition. and the same is not in accordance with sound

cnginccring pmcticcs consonant with the requiremcnts of due process of law and is. in
addition thereto. beyond thaI which is constitutionally or statutorily pennilled or requircd.
II. The purported or .Illempted condcmnation or an cascment and right or way
on or across the Kurkuff IIomestead is void as not having been made in good !(Iith and.
for the reasons previously set fonh, will cause inordinate burdcn and detriment to
Rcspondents bcyond that which is rcasonably neccssary or that which is constitutionally
or statutorily pcrnlilled or requircd.
12. Thc Respondents reserve Ihe right 10 amend these Preliminary Objcetions
insofar as il is appropriate in connection with any infonnation dcvcloped by it as a result
of discovery to bc undcrtaken in connection with these proceedings.
WHEREFORE, Respondents requeslthat this Honorable Court dcny the instant
Petition for Approval, refuse to enter the Order For Filing Condemnation Bond, dcclare
any purponcd or attempted condemnation incident thereto null and void, and award costs
and counsel fees to Respondents for the reasons set fonh hcrein.
