AND NOVJ, this 20th day of August, 1999,
after hearing and after having reviewed the exhibits, it is
ordered and directed as follows:
1, The father, Lawrence D. Cardone, Jr" and
mother, Elaine L. Cardone, shall enjoy shared legal custody
of Leo William Cardone, born February 22, 1995, and Nicolas
DeAngelo Cardone, born November 7, 1996.
2. The mother shall have primary physical
custody of the children, She is specifically granted
permission to relocate with the children to Florida.
3. Father shall enjoy temporary periods of
physical custody with the children as follows:
a. During the summer months from one week
after school ends until one week before school begins.
b. One week at Christmas or Thanksgiving
vacation to be worked out by the parties. In the event it
cannot be worked out by the parties, it shall be on an
alternating basis with father having the week of

4. The custodial parent shall make sure that the
children call the non-custodial parent at least once per
week and that they be allowed to talk for up to one half
hour. The non-custodial parent may call at least two other
times per week for up to one half hour. The parties shall
cooperate with arranging ~he times.
5. The father shall be responsible for
transporting the children from Florida to Pennsylvania at
his expense. The mother shall be responsible for
transporting the children from Pennsylvania to Florida at
her expense,
6. This Court shall retain jurisdiction for the
purpose of modifying and/or enforcing the terms of this
order.

AND Nml, this 9th day of July, 1999, after a
conciliation conference with counsel, it is apparent that the
Father, who lives in the Pittsburgh area, is opposed to the move
because it will cut down on his ability to visit with the
children.
The parties have indicated that they will attempt
to reach a stipulation on as many facts as possible, if
possible. In any event, the hearing in this matter has been
scheduled for Friday, August 20, 1999, at 12:30 p,m. The parties
are confident that they can complete this case in one-half day.

AND NOW, the Plaintiff, Lawrence 0, Cardone, Jr., by and through his attorney,
Jeanne B, Wigbels, Esquire, makes the fDllowing Petition for Injunctive Relief:
1, A court order was entered by the Honorable Edward E. Guido regarding the
above-captioned custody case on January 27, 1999. See attached Exhibit A.
2, The order provides Defendant, Elaine L. Cardone, with primary physical
custody of their minor children, Leo William Cardone (DOB 2/22/95) and
Nicolas DeAngelo Cardone (DOB 11f7196),
3. The order further provides Plaintiff with periods of temporary physical custody
on alternating weekends from Sunday at 5:00 p,m, until Tuesday at 5:00 p.m.
4. Furthermore, the order provides for alternating holidays, and one week
summer vacation for each party during the summer,
5, On June 8, 1999, undersigned counsel received a facsimile from Carol L.
Van Horn, attorney for Defendant, stating that her client plans to relocate with

Dear Jeanne:
The purpose of this letter is to inform you of my client's plans to relocate with the
children to Florida in August of this year. Mrs. Cardone is planning to move to the
Barefoot Bay area, transfer her emplDyment through Applebee's and begin SChoDling.
Her parents are in that area and are available as a support system for her.
Arrangements are in plaoe pursuant to the Court Order providing for Mr. Cardone to
have the children for his week of summer vacation through August B, 1999. We will
need to discuss a revision to the existing Order for revised periodS of partial custody
after that date.
Given the current ages of the ohildren being just fO'Jr and two years of age, it is our
suggestion that for the summer of 2000 that Mr. Cardone have a total of four weeks
of time divided into two blocks of two weeks each. As the children became Dlder, the
blocks of time could be expanded. In addition Mr. Cardone could have the children for
one full week at either Thanksgiving or Christmas and for an additional week sometime
during the spring upon thirtY days' notice.
On another matter. I am unclear as to where settlement stands on the house being
purchased by your client. At this point in time, mv client is not interested in creating
problems for YDur cliE!,nt by forcing the matter thrDugh to execution on her judgment
for the arrearages if wil':oare able to see some cooperation on the part Df Mr. Cardone
in terms of prDviding the information repeatedly requested in our prior letters of
correspondence. Please refer to my letter of May 6, 1999 which provides YDU with
pointed questions for answer which also include requests for documentation.
