Mortgage is marked Exhibit "B", attachcd hereto and made a part hereof.
S, The Defendants are the current record and real owncr of the aforesaid mortgaged
premises,
6, The Defendants are in default under the terms of the aforesaid Note and Mortgage for, inter
alia, failure to pay the monthly Installments of principal and interest when due.
7. Demand for payment has been made upon the Defendants by Plaintiff, but Defendants
have failed or refused to pay the principal balance, interest or any other portion thereof to Plaintiff,
8, Plaintiff was not required to send Defendants written notice of Plaintiffs Intention to
Foreclose Mortgage pursuant /041 P.S. 9403 (Act 6 of 1974) prior to the commencement of this action for
the reason that said Mortgage is not a "residential mortgage" as defined In t041 P.S.9101.
9. On or about June 23, 1998, Defendants were mailed Notice of Homeowner's Emergency
Assistance Act of 1983, in compliance with the Homeowner's Emergency Assistance Act, Act 91 of
1983Take Action to Save Your Home From Foreclosure. A true and correct copy of said Notices are
attached hereto as Exhibit "C".
10. The amount due and owing Plaintiff by Defendants is as follows:
