COMPLAINT
1. Plaintiffs, Donald R. Franklin and Harriet J. Franklin,
are adult individuals residing at 2 Madder Drive, Mechanicsburg,
Cumberland County, Pennsylvania.
2. Defendant, Thomas A. Abraham Builders, is a sole
proprietorship owned by Thomas A. Abraham with its principal place
of business at 945 siddonsburg Road, Lewisberry, York county,
Pennsylvania.
3. Defendant, B. & B. Masonry, Inc., is a Pennsylvania
corporation with its principal offices at 49 West Orange Street,
Shippensburg, Cumberland County, Pennsylvania.
4, At all times relevant hereto, the Plaintiffs are the

6. On or about July 24, 1994, the Plaintiffs entered an

agreement with Defendant Thomas Abraham, t/a Thomas A. Abraham
Builders, for the construction of a home. A true and correct copy
of the Sales Agreement is attached hereto as Exhibit "A" and
incorporated herein by reference.
7. Pursuant to the aforesaid construction contract,

Defendant Thomas A. Abraham, t/a Thomas A. Abraham Builders,
provided a warranty on the home. A true and correct copy of the
warranty is attached hereto as Exhibit "B" and incorporated herein
by reference.
8. Pursuant to the aforementioned warranty, Defendant,

Thomas A. Abraham, t/a Thomas A. Abraham Builders, warranted the
chi.mneys and fireplaces in the home pursuant to the following
language "your chimney and fireplace have been built in strict
accordance with all applicable codes and regulations and are
warranted against defects that in any way make them unsafe or
inoperable. Unfortunately driving rain or snow can enter the best
chimney. This is not a defect."
9. On or about January 2, 1997, the Plaintiffs utilized the
fireplace in their home for the first time.

10. On January 19, 1997, a fire occurred in the Plaintiffs'
residence as a result of certain defects in the construction of the

fireplace and chimney, which defects are more specif ically set
forth below:
a) the fireplace and chimney were not sUfficiently insulated
from combustible surfaces;
b) the fireplace and chimney were constructed with a gap
between the front end of the flange from the damper and
the brick on the face of the fireplace, which gap allowed
hot air to escape the fireplace and come into contact
with combustible framing members;
c) the smoke chamber was constructed of insufficient
thickness;
d) the fireplace and chimney were constructed with
insufficient space between the fireplace and chimney and
combustible surfaces;
e) the fireplace and chimney were constructed with
insufficient parging of the inner walls of the chimney;
and
f) the fireplace and chimney were constructed in violation
of NFPA Fire Code 211 Specifications.
11. As a direct and proximate result of the defective
construction of the fireplace and chimney and resulting fire, the
Plaintiffs incurred the following damages:
a) the removal of the entire existing chimney, firebox and

disposal of old material;
b) the cost of rebuilding a new fireplace with new material.
12, The defects noted in Paragraph 10 above constitute a
material breach of the warranty provided by Defendant, Thomas A.
Abraham, t/a Thomas A. Abraham Builders.
WHEREFORE, Plaintiffs, Donald R. Franklin and Harriet J.
Franklin respectfully request Your Honorable Court to enter
judgment in their favor and against Defendant, Thomas A. Abraham,
t/a Thomas A. Abraham Builders, in the amount of Seven Thousand,
Two Hundred Eighty ($7,280.00) Dollars plus costs of suit, interest
and such other damages as are deemed appropriate.
COUNT II
Donald R. Franklin and Harriet J. Franklin v.
B. & B_ Masonrv. Inc. - Nealiaence
13. Paragraphs one through 13 of the Plaintiffs' Complaint
are incorporated herein by reference.
14. Plaintiffs believe and therefore aver that Defendant B.
& B. Masonry, Inc. was hired by Defendant, Thomas A. Abraham, t/a
Thomas A. Abraham Builders, to construct the fireplace and chimney
in the Plaintiffs' residence.
15. Plaintiffs believe and therefore aver that Defendant, B.
& B. Masonry, Inc., negligently constructed the fireplace and
chimney in the residence as more specifically set forth below:

a) the fireplace and chimney were not SUfficiently insulated
from combustible surfaces;
b) the fireplace and chimney were constructed with a gap
between the front end of the flange from the damper and
the brick on the face of the fireplace, which gap allowed

16. As a direct and proximate result of the negligence,
carelessness or recklessness of Defendant, B. & B. Masonry, Inc.,
the Plaintiffs sustained damages as more specifically set forth
below:
a) the removal of the entire existing chimney, firebox and
disposal of old material;

b) the coat of rebuilding a now fireplace with new material.
17. The fire of January 19, 1997 and the resulting damage to
the Plaintiffs' property was in no way attributable to any action
or failure to act by the Plaintiffs.
WHEREFORE, Plaintiffs, Donald R. Franklin and Harriet J.
Franklin respectfully request Your Honorable Court to enter
judgment in their favor and against Defendant, B. & B. Masonry,
Inc., in the amount of Seven Thousand, Two Hundred Eighty
($7,280.00) Dollars plus costs of suit, interest and such other
damages as are deemed appropriate.

19. It is believed that Plaintiffs may have been bnming improper materials in their
lireplace which could have causcu the lire and did not clean their chimney on a regular basis.
Accordingly, Plaintiffs are barred because they assumed the risk and also because of their
eompamtive negligence,
20. Defendant Thomas J, Abmham Builders was not infonned of this claim until May
of 1997. By this time, the scene of the lire had been changed and important evidence had been
thrown away. Defendant Thomas 1. Abraham Builders was not able to properly investigate lire and
is prejudiced in its defense.
21. Plaintiffs are barred from this action because they or their agents committed
spoliation of important evidence.
22, This claim is barred by the two year statute oflimitations.
23. Plaintiffs failed to mitigate their damages by replacing the chimney when it was
repairable,

averments of paragraphs 5 through 12 of the Complaint, inclusive,

fireplace and chimney had been removed and disposed of and
entirely reconstructed by the Plaintiff prior to any notification
to the Defendant of the existence of the fire.
21. Plaintiffs are barred from this action because they
and/or their agents committed spoilation of the important
evidence.
22. Defendant B, & B, believes and therefore avers that had
it been provided the opportunity to inspect the scene of the fire
and all relevant evidence prior to its destruction, the
investigation would have revealed that the Plaintiffs burning of
improper materials and/or failure to properly clean the fireplace
caused a chimney fire which was the cause of the fire and not any
negligence on the part of Defendant B, & B.
23. Defendant B. & B. believes and therefore avers that
following the fire the chimney itself was in tact and that the
