16. Averments I through 17 are hereby re-alleged as though fully set forth in this complaint,
17, On or about June 28, 1998, the Plaintiffs vacated lease premises and surrendered
possession to the Plaintiffs.
18. During the term of the leased premises, Defendants wrongfully, willfully, unlawfully,
and with malice, fraudulently converted Plaintiffs security deposit funds to Defendants'
own use without Plaintiffs knowledge or consent and in violation of applicable
LandIordffenant statutes, in that during the term of the lease, Plaintiff's jointlyand/or
severally withdrew moneys from the security escrow prior to the expiration of said lease
and without legal cause,
19. Defendants are exereising unlawful control over the security moneys and interest,
20. Plaintiffs have demanded the return of their security deposit, but Defendants have refused
to do so,
21, On infonnation and belief; Defendants do not intend to return the converted security
moneys plus interest to Plaintiffs,

AND NOW, this q~day of March, 1999, comes the Plaintiffs, Tina Pittman and
Randy Kuykendall, by and through their attorney, Anthony Miley, Esquire, and files the
following Reply to Defendants' New Matter
23, Paragraph 23 of Defendants' New Matter is a conclusion oflaw to which 1\0 responsive
pleading is required, To the degree, however, a response is required, it is specifically
denied. To the contrary, with reference to Defendant Stephen Haut, a lease was signed
on behalf of Agatha Haut by Mr. Haut, security deposit was paid to Mr, HaUl, all
complaints as to the habitability were made to Mr. Haut, and, further, all ren1a1 payments,
until December 1998, were paid directly to Stephen Haut as a result of the apparent and
factual agency relationship existing between Defendants. See attached Exhibit "A".
With reference to Defendant Henson, on or about December 1998, Plaintff's received
verhal communication from Mr. Henson that he is "taking over" for his brother, Stephen

possession to the Plaintiffs.

and with malice, fraudulently converted Plaintiffs security deposit funds to Defendants'
own use without Plaintiffs knowledge or consent and in violation of applicable
Landlordffenant statutes, in that during the term of the lease, Plaintiff's jointly and/or
severally withdrew moneys from the security escrow prior to the expiration of said lease
and without legal cause,
19. Defendants are exercising unlawful control over the security moneys and interest,

AND NOW, this ~ day of March, 1999, comes the Plaintiffs, Tina Pittman and
Randy Kuykendall, by and through their attorney, Anthony Miley, Esquire, and files the
following Reply to Defendants' New Matter
23. Paragraph 23 of Defendants' New Matter is a conclusion oflaw to which no responsive
pleading is required. To the degree, however, a response is required, it is specifically
denied. To the contrary, with reference to Defendant Stephen Haut, a lease was signed
on behalf of Agatha Haut by Mr. Haut, security deposit was paid to Mr. Haut, all
complaints as to the habitability were made to Mr, Haut, and, further, ail rental payments,
until December 1998, were paid directly to Stephen Haut as a result of the apparent and
factual agency relationship existing between Defendants. See attached Exhibit "A".
With reference to Defendant Henson, on or about December 1998, Plaintffs received
