To the contrary, with reference to Defendant Stephen Haut, a lease was signed on behalf of Agatha Haut by Mr. Haut, security deposit was paid to Mr, HaUl, all complaints as to the habitability were made to Mr. Haut, and, further, all ren1a1 payments, until December 1998, were paid directly to Stephen Haut as a result of the apparent and factual agency relationship existing between Defendants. See attached Exhibit "A". With reference to Defendant Henson, on or about December 1998, Plaintff's received verhal communication from Mr. Henson that he is "taking over" for his brother, Stephen Haut, and that all future rent payments are to be made to him.
