Plaintiff, Charles Wilson ("Plaintiff"), is an adult individual currently residing at 400 Park Hill Drive, Mechanicsburg, Cumberland County, Pennsylvania. 2. Defendant, Hempt Brothers, Inc. ("Defendant Hempt Brothers"), is a corporation with a place of business at 55 Locust Point Road, Mechanicsburg, Cumberland County, Pennsylvania. 3. Defendant, Fisher Buildings ("Defendant Fisher Buildings"), is a corporation with a place of business at R.R.I, McVey town , Pennsylvania. 1 4. In 1997, Plaintiff hired Defendant Fisher Buildings as a general contractor to build a garage on his property located at 5 Gale Circle, Camp Hill, Cumberland County, Pennsylvania. 5. Defendant Fisher Buildings then subcontracted with Defendant, Hempt Brothers, Inc. to delivery concrete to the jOb site. 6. On or about August 22, 1997, Defendant Hempt Brothers delivered several loads of concrete to Plaintiff's residence. 7. During the course of said delivery, Defendant Hempt Brothers negligently, careless and recklessly damaged a stone wall and shrubbery along Plaintiff's driveway. 8. As a result of the negligence of Defendant Hempt Brothers, Plaintiff suffered the damages herein after described. COUNT I - NEGLIGENCE CHARLES WILSON v. HEMPT BROTHERS. INC. 9. The averments in Paragraphs 1 through 8 hereof are incorporated herein by reference as if set forth in their entirety. 10. The occurrence of the aforesaid incident on our about August 22, 1997, and the subsequent damages resulting therefrom, were the direct and proximate result of the negligent, careless and reckless conduct of Defendant Hempt Brothers, including but not limited to the negligent driving of a concrete 2 .~ ~ truck owned by Defendant Hempt Brothers and operated by an employee of Defendant Hempt Brothers and the improper delivery of several loads of concrete. 11. HEMPT BROTHERS. INC. 1. On October 28, 1998, judgment was entered by District Justice Elder in the above-referenced matter. 2. Plaintiff, Charles Wilson ("Plaintiff"), filed a timely Notice of Appeal on November 17, 1998. 3. Pursuant to Pa. R.A.P. D.J. No. 1005, Plaintiff duly made service of the Notice of Appeal upon the Appellee/Defendant, Hempt Brothers, Inc. ("Defendant") and the District Justice. Thereafter, Plaintiff filed Proof of Service with the Prothonotary. A copy of said Proof of Service is attached hereto, incorporated herein by reference and labeled Exhibit "A". exhibit A exhibit B 4. In 1997, Plaintiff hired Defendant Fisher Buildings as a general contractor to build a garago on his property located at 5 Gale Circle, Camp Hill, Cumberland county, Pennsylvania. S. Defendant Fisher Buildings then subcontracted with Defendant, Hempt Brothers, Inc. to delivery concrete to the jOb site. 6. On or about August 22, 1997, Defendant Hempt Brothers delivered several loads of concrete to Plaintiff's residence. 7. During the cour.se of said delivery, Defendant Hempt Brothers negligently, careless and recklessly damaged a stone wall and shrubbery along Plaintiff's driveway. 8. As a result of the negligence of Defendant Hempt Brothers, Plaintiff suffered the damages herein after described. COUNT I - NEGLIGENCE CHARLES WILSON v. HEMPT BROTHERS. INC. 9.
