SlJMMARY This Court, by its Order and Decision of March 21. 2000, held that Plaintiffs' brcach of contract claim against Dcfendant Fickle was barred by the statute of limitations, The law of the case thus establishes that Plaintiffs' breach of contract claim against General Accident is similarly barred, Plaintiffs assert that Fickle acted as the agent of General Accident. resulting in its vicarious liability. As the claim against Fickle is barred by the statutc of limitations, Plaintiffs' claim against Gcneral Accident bascd upon Ficklc's allcged agency is similarly barred, II. FACTS A, PROCEDlJRAL FACTS On November 17, 1998. Plaintiffs began this action against Gcneral Accident by the filing ofa Writ of Summons, On Febmary 9. 2000. a Complaint was filed. Defendant, J. Rodney Fickle Insurance Agency. Inc,. filcd a Motion for Judgment on the Pleadings on March 21. 2000, By its Order and Opinion dated May 25, 2000, this Court granted the Motion for Judgment on the Pleadings, A copy is attachcd as Exhibit "A", The Court held that the statute of limitations began to run on September 20, 1994. (Opinion, p, 4), As this action was not commenced until Novembcr 18, 1998. this Court hcld that Plaintiffs' action was time barred. (Opinion, p, 4), II. B. PLAINTIFFS' ACTION AGAINST GENERAL ACCIDENT IS BARRED BY THE STATUTE OF LIMITATIONS Plaintiffs' action is bascd upon a policy of insurancc, (Complaint. '120), Thcy seck recover from Gencml Accident the cost of thc automobile that was found to have been stolen, Id, The statute of jimitations for breach of contract is four years. (42 Pa,C,S,A, g5525; Opinion, p, 3), Plaintiffs notified Fickle on September 20. 1994 that the vehicle was stolen, (Opinion, p. 4). Thus, Plaintiffs knew of their asserted claim by at Icast September 20, 1994, "The statute of limitations clearly began to run at that time," (Opinion, p, 4), "Since the instant action was not filed until November 18, 1998, it is time barred," (Opinion, p, 4), Accordingly, General Accident is cntitled to Judgment on the Pleadings, C. PLAINTIFFS' ACTION BASED UPON VICARIOUS LIABILITY FOR THE FAILURE OF FICKLE TO OBTAIN COVERAGE IS BARRED BY THE STATUTE OF LIMITATIONS, Plaintiffs allege Fickle was acting as the agent of General Accident. (Complaint, ~22), Plaintiffs contend that General Accident is "liable for the breach of contract of it's [sic] agent, Fickle," 1d, This Court has held that the action against Fickle was barred by the statute of limitations, (Order and Decision of March 21, 2000). Plaintiffs assert a claim against General Accident based upon Ficklc's breach of contract. (Garage coverage form, Section IV, Physical Damage Coverage, Exclusion Number 3 "False Pretense", Page 9 of 14, copy allached), 15. The applicable statute of limitations, 42 POI. C,S.A. ~5525, requires an action upon a contract founded upon a writing or upon an express contract not founded upon an instrument in writing (i.e., an oral contract) to be commenced within four years. 16. We represent the moving party, the Fickel Agency, <lnd have filed and briefed a Motion for Judgment on the Pleadings and furnished Mr. Wiener with s<lme. Mr. Wiener, bec<luse of his Federal detainment, had filed a Motion for St<lY of this proceeding, but this Motion was denied several weeks ago by an Order of this Court, speaking through Judge Guido, Mr. Wiener furnished us a one-page brief opposing our Motion and in case a copy of this brief has not been filed with the Prothonot<lry we are enclosing a copy so that you might include it with the Court's file, Knowing the difficulty Mr. Wiener would encounter in obtaining a writ of habeas corpus ad testificandum so that he could appear and argue against our Motion we told him that we would be willing to submit the matter on briefs and he has agreed to that procedure as evidenced by his letter of April 18, 2000, the original of which is enclosed for inclusion in the Court records. Applying the above standard to the case at bar, we arc satisfied that Defendant Fickel is enlit1ed to judgment on the pleadings. On July 12, 1994, Plaintiff Eric Wiener (hereinafter "Wiener") aCling on behalf of Plaintiff Carlisle AUlO Plaza, Inc. (hereinafter "Auto Plaza") purchased a vchiele from < another dealer.l The vehicle was subsequently sold by plaintiffs.) It turns out that the " vehicle was stolen.4 Plainliffs were required to reimburse the ultimate purchaser for the cost of the vel1icle plus legal fees.s o Defendant Fickel was the insurance agent for Plaintiff Auto Plaza.6 Plaintiff Auto Plaza had contracted with Defendant Fickel for "full and complete coverage for the !~ I I lfj automobile dealership.'" II They allcge that Defendant Fickel is liable "for breach of contract in ils failure to . . . obtain full and complete covcmge. . ," for I'laiotirr Auto Plaza.'1 In its new matter, Defendant Fickel alleges that plaintiffs' action is time barred. We agree. The statute of limitalions for contract actions is four years. I) Plaintiffs argue that the statute of limitalions did not begin to nm until they discovered that the vehicle was stolen and realized thatthcy did not have the co\'erage for which that they had allegedly conlracted. It is their position that this date was November 23, 1994, when they discovered that "the subject vehicle was, in fact, stolen. I' Under tile "discovery rule" the statute of limitations in a contract action begins to run when "the injured party becomes aware or reasonably should have been aware of his injury or its cause." Crouse v. Cvclops Industries, 704 A.2d 1090, 1094 (Pa. Super. 1997). The point in time when an injured party should have been aware of his injury is typically a question of fact. .w. Plaintifrs nOlificd Derendant Fickel on September 20, 199.1, that the vehi.:le might be stolen. On the same day they were advised that they did not have the coverage for which they had allegedly contracted. If a contract to provide "1'1111 and complete coverage" existed, plaintifrs were aware of its breach on that date. The statute of limitations clearly began to run at that time. Since the instant action was not filed until November 18, 1998, it is time barrcd. For the reasons set forth above, we will grant Derendant Fickel's motion for judgment on the pleadings.
