II. The Def~lIdaut has ill the past al1andolled Ih~ child wilholll ,up~rvi,iou for extended
periods of time. The Cumberland alld County Children and Youth Service, alld the Florida
eqlliva1ent of Children and YOllth Service, have invesligated the,e incident, of abandon me III in
the past.
12. Based upon the recent assault. the history of frequent abandonment, and the
Defelldalll's incarceration, the Plaintiff believes that the best interest and welfare of the child will
be served by granting Ihe relief requested as the Plaintiff has been the primary caretaker of the
child for the last two and one-half years and does not propose to dismpt her deve10pmelll as the
Defelldant has threatened to do '0. Defendalll, through her action, has demonstrated a failure
to act in the child's besl intere,l.
WHEREFORE, the Plaillliff requesls this Honorable Court to grant a temporary Order
providing the Plaintiff with primary physical custody of Ihe child ullli1 such time as the parties
can reach a permanenl agreement regarding ellstody or pending a Conciliation Conference to be

1. A lIearing is scheduled in Court Room # '-/ of the

testimony will be taken. For purposes of thirllearing, the Maternal
Grandmother shall be deemed to be the moving party and shall proceed
initially with testimony. Counsel for the parties shall file with the
Court and opposing counsel a Memorandum setting forth each party's position
on custody, a list of witnesses who will be expected to testify at the
Ilearing and a sumnary of the anticipated testimony of each witness. These
Memoranda shall be filed at least ten (10) days prior to the Hearing date.
2. The prior Order of this Court dated November 17, 1998 is vacated
and replaced with this Order.
3. Penidng further Order of Court or agreement of the parties, the
following custody arrangements shall be in effect:
A. The Maternal Grandmother, Lyda Gallagher, and the Mother,
Veronica Gallagher, shall have shared legal custody of Alexis
L. Gallagher, born April 25, 1993.
B. ~lle Maternal Grandmother shall have primary physical custody
of the Child.
C. The Mother shall have partial physical custody of the Child
every week from Tuesday at 5:00 p.m. until the Mother
transports the Child to school on Wednesday morning. In
addition, the Mother shall have custody of the Child at a
minimum every weekend on Sunday for church from 8:30 a.m.
until 2:30 p.m., and any additional period during the weekend
when the Mother is not working. The Mother may have
additional periods of custody as arranged by agreement of the
parties.
D. Each party shall ensure that the Child is not left
unsupervised during that party's period of custody.

Grandmother believes it would be in the Child's best interest to continue
to reside primarily with her. ACCording to the Grandmother, the Mother is
not able to provide adequate care for the Child on a primary basis as the
Mother has on several previous occasions left the Child unsupervised. The
Grandmother also believes the Mother's full-time school schedule and work
schedule do not allow sufficient time to provide for the Child's needs.
The Grandmother indicated that she has been the Child's primary caregiver
and has made arrangements for the Child to participate in counseling.
6. The f",other's position on custody is as follows: The Mother
believes it would be in the Child's best interest to reside primarily with
her. While the Mother acknowledged that she has a very heavy class and
work schedule, the Mother indicated that the Grandmother works the night
shift from 11:00 p.m. until 7:00 a.m. and is not available for the Child
during the night time. The Mother denies that she is unable to provide
adequate care for the Child and, through counsel, alleged generally that
the Grandmother has some psychological problems and serious problems in her
relationship with her children, including the Mother.
7. Despite the serious problems alleged between the parties, to their
credit the Grandmother and Mother were cooperative and deferential to each
other in reaching an agreement on temporary custody arrangements at the
Confet'ence. The Conciliator recomnends an order in the form as attached
scheduling a Hearing and setting forth the parties' temporary agreement.
Again, the parties agree that the Hearing should not be held before the end
of May to enable the Mother to assess her living circumstances and new
schedule after graduating from HACC in early May. It is expected that the
Hearing will require approximately one-half day, depending upon whether
expert testimony is presented. The Conciliator encouraged the parties to
continue cOlllllUllications in an effort to resolve the custody issues by
agreement without the necessity of the scheduled Hearing.

AND NOW, comes Petitioner, Veronica L. Gallagher, by ami through her legal counsel
of record, Bradley L. Griffie, Esquire. and the law lirm or Griffie & Associates petitions the
Court as follows:
I. Your Petitioner is the above-named Defendant, Veronica L. Gallagher, an adult
individual currently residing at 7 Pine Road, Apartment 406, Mount Holly Springs,
Cumberland County, Pennsylvania.
2. Your Respondent is the above-named Plaintiff, Lyda Gallagher, an adult individual
currently residing at 335 North East Street, Carlisle, Cumberland County,
Pennsylvania.
3. Petitioner is the natural mother of Alexis L. Gallagher, born April 25, 1993, and
Respondent is the maternal grandmother or the child.
4. The parties were previously involved in the above captioned matter through a
conciliation process which resulted in tile entry of an Order of Court date February 3,
1999, a copy or which is atlached hereto and incorporated herein by reference as
Exhibit "A."
5. The COllrt bearing scheduled in lhatlllaller fllr June 9, 11)1)9, was wntinned generally

incorporaled herein by rererence as Exhibil "B:'
6. Since the entry of the Order of Fcbruary 3, !9l)9, outlining lhe details relative to the
exchange of physical custody or the child, there Ims been substantial change in l10th
parties circumstances, ineluding but notlirnited to the rollowing:
a. Petitioner has been able to stabilized her home life and her personal situation so
as to be available to provide care for her child;
b. The Resllondent has encountered dramatic medical problems and other
dirticulties which has necessitated her addressing her own illness and, otherwise,
making her unavailable to provide care for the child;
e. During the periods of time of Respondent's illness and incapacity, Petitioner has
provided the primary care for her child; and
d. Despite repeated allempts 10 gain cooperation of Respondent, through counsel,
Respondent has failed and refused to discuss with Petitioner a means of resolving
this matter without use of litigation.
7. Since the enlry of the Ilrior Orders in this mailer the Child has continued to reside in
botl1 parties' physical custody and, therefore, has continued to reside in Cumberland
COllnty, Pennsylvania.
8. Thererore, the Court or Common Pleas of Cumberland County continues to have
jurisdiction over the issue of custody of the child.

THIS STIPULATION AND AGREEMENT entered into the day llnd year hereinafter set
forth, by and between LYDA GALLAGIIER, (hereinafter rererred to as "Grandmother") and
VERONICA L. GALLAGHER (hereinafter referred to as "Mother").
WHEREAS, Grandmothcr is the maternal grandmother of one child, namely ALEXIS L.
GALLAGHER, born April 25, 1993, (hereinafter referred to as "Child"); and
WHEREAS, Mother is the natural mother ofthe above named Child.
WHEREAS, the parties entered into a prior Order of Court dated February 3, 1999,
which was originally entered as a temporary Order or Court, bllt the parties ultimately decided to
withdraw their request for a hearing and abide by the terms of that temporary Order of Court,
said Order of Court being attached herelo and incorporated herein by reference as Exhibit "A."
WHEREAS, the parties wish to vaeale that prior Order and enter into an Order of Court
based upon the within Stipulation and Agreement.
NOW THEREFORE, in c"'lsideration of mutual covenants, promises and agreements as
hereinafter set forth, the parties stipulate and agree as follows:
I. The parties, LYDA GALLAGHER, (hereinafter rererred to as "Grandmother") and,
VERONICA L. GALLAGHER, (hereinafter referred to as "Mother") shall have
shared leg:11 custody of thc Child, ,fLEX/S I.. GA/,UGIIER. l1urn April 25, 191)3.

2. Muthcr shall have primary physical custody of lhe Child and Grandmuther having
periods of partial physical custody of the Child on the following schedule:
a. Every Wedncsday evening at the end of the Child's school day or at another time
to be agreed upon by the parties until Thursday morning when the Child again
allcnds school or is returned to Mother;
b. Every Satllrday evening rrom a time to be agreed upon by the parties until Sunday
morning at a time 10 be agreed upon by the parties; and
e. At other times as the parties may agree.
3. Grandmother shall be afforded four (4) hours of physical custody with the Child on
the Child's birthday and on Grandmother's birthday.
4. Grandmother shall be afforded rour (4) hours of physical custody with the child at
specific times to be agreed upon by the parties on Easter Sunday. Thanksgiving Day,
and Christmas Day. In addition, the child shall always be Grandmother from 8:00
p.m. until 10:00 p.m. on Christmas Eve to arford Grandmother the opportunity to
take the child with her ror Christmas Eve church services.
5. Each party shall be entitled to have two (2) one week uninterrupted periods of
physical custody with the child during the summer vacation months, with each party
providing the other with no less than thirty (30) days notice of their intention to
exercise each of the two (2) one week periods of physical ellstody.
6. The parties shall kcep each olher adviscd inlhe event of serious illness or medical
emergcney concerning Ihe ('hild and shall Ii III her lake any necessary steps to
ensure lhat the health and well.heing of lhe Child is protecled. During such
illness or medical emergency, hoth parlies shall have the right to visil the Child as
ofien as she desires cOllsisleut with Ihe propcrty medical care or the Child.
7. Ncither party shall do anything which may eslrange the Child rrom the other
party, injure the opinion of the Child as to the other parly, or which may hamper
the free and nalural devclopment or the Child's love and aflection for the other
party.
8. Any modification or waiver of any of the provisions of this Agreement on a
permanent basis shall be errective only ir made in writing, and only if executed
with the same formality as this Stipulation and Agreement.
9. The parties desire that this Stipulation and Agreement be made an Order of Court
of the Court or Common Pleas of Cumberland County, and further acknowledge
that the Court of Common Pleas of Cumberland County docs, in ract, have
jurisdiction over the issue or custody of the Child, who has resided for an excess
of six (6) months in ClImberland County, Pennsylvania.
10. The parties stipulate that in making this Agreement, there has been no fraud,
concealment, overreaching, coercion, or other unfair dealing on the part or the
other party.

shared legal custody of the Child, .-ILEUS L. GALLAGHER, born April 25, 1993,
(hcreinal'ter referrcd to as "Child").
,
Mother shall have primary physical custody of the Child and Grandmother having
periods of partial physical custody of the Child on the following schedule:
a.
Every Wednesday evening at the end ofthc Child's school day or at another time
to be agreed upon by the parties until Thursday moming when the Child again
attends school or is retumed to Mother;
b. Every Saturday evening from a time to be agreed upon by the parties until Sunday
moming at a time to be agreed upon by the parties; and
c. At other times as the parties may agree.
3. Grandmother shall be afforded four (4) hours of physical custody with the Child on
the Child's birthday and on Grandmother's birthday.
4. Grandmother shall be afforded four (4) hours of physical custody with the child at
specific times to be agreed upon by the parties on Easter Sunday, Thanksgiving Day,
and Christmas Day. In addition, the child shall always be Grandmother from 8:00
p.m. until 10:00 p.m. on Christmas Eve to afford Grandmother the opportunity to
take the child with her for Christmas Eve church services.
5. Each party shall be entitled to have two (2) one week uninterrupted periods of
physical custody with the child during the summer vacation months, with each party
providing the other with no less than thirty (30) days nOlice of their intention to
e.'(ercise each of the two (2) one week periods of physical custody.
6. Thc parties shall kecp each other adviscd in the event of serious illness or medkal
cmcrgency conccming Ihc Child and shall funher take any necessary steps to
ensure that the hcalth and well-being of thc Child is protccted. During such
illness or mcdieal emergency, both parties shall have the right to visit the Child as
often as she desires consistcnt with the propcrty medical care of the Child.
7. :-leither pany shall do anything which may estrange the Child from the other
pany, injure the opinion or the Child as to the other pany, or which may hamper
the free and natural development of the Child's love and affection for the other
party.
S. Any modification or waiver of any of the pro\'isions of this Agreement on a
permanent basis shall be effective only if made in writing, and only if executed
with the same formality as this Stipulation and Agreement.
9. The parties desire that this Stipulation and Agreement be made an Order of Court
of the Court of Common Pleas of Cumberland County, and further acknowledge
that the Court of Common Pleas of Cumberland County does, in fact, have
jurisdiction over the issue of custody of the Child, who has resided for an excess
of six (6) months in Cumberland County, Pennsylvania.
10, The parties stipulate that in making this Agreement, there has been no fraud,
concealment, overreaching, coercion, or other unfair dealing on the part of the
other party.
