The Cumberland alld County Children and Youth Service, alld the Florida eqlliva1ent of Children and YOllth Service, have invesligated the,e incident, of abandon me III in the past. 12. Based upon the recent assault. the history of frequent abandonment, and the Defelldalll's incarceration, the Plaintiff believes that the best interest and welfare of the child will be served by granting Ihe relief requested as the Plaintiff has been the primary caretaker of the child for the last two and one-half years and does not propose to dismpt her deve10pmelll as the Defelldant has threatened to do '0. Defendalll, through her action, has demonstrated a failure to act in the child's besl intere,l. GALLAGHER, born April 25, 1993, (hcreinal'ter referrcd to as "Child"). , Mother shall have primary physical custody of the Child and Grandmother having periods of partial physical custody of the Child on the following schedule: a. Every Wednesday evening at the end ofthc Child's school day or at another time to be agreed upon by the parties until Thursday moming when the Child again attends school or is retumed to Mother; b. Every Saturday evening from a time to be agreed upon by the parties until Sunday moming at a time to be agreed upon by the parties; and c. At other times as the parties may agree. 3. Grandmother shall be afforded four (4) hours of physical custody with the Child on the Child's birthday and on Grandmother's birthday. 4. Grandmother shall be afforded four (4) hours of physical custody with the child at specific times to be agreed upon by the parties on Easter Sunday, Thanksgiving Day, and Christmas Day. In addition, the child shall always be Grandmother from 8:00 p.m. until 10:00 p.m. on Christmas Eve to afford Grandmother the opportunity to take the child with her for Christmas Eve church services. 5. Each party shall be entitled to have two (2) one week uninterrupted periods of physical custody with the child during the summer vacation months, with each party providing the other with no less than thirty (30) days nOlice of their intention to e.'(ercise each of the two (2) one week periods of physical custody. 6. Thc parties shall kecp each other adviscd in the event of serious illness or medkal cmcrgency conccming Ihc Child and shall funher take any necessary steps to ensure that the hcalth and well-being of thc Child is protccted. During such illness or mcdieal emergency, both parties shall have the right to visit the Child as often as she desires consistcnt with the propcrty medical care of the Child. 7. :-leither pany shall do anything which may estrange the Child from the other pany, injure the opinion or the Child as to the other pany, or which may hamper the free and natural development of the Child's love and affection for the other party. S. Any modification or waiver of any of the pro\'isions of this Agreement on a permanent basis shall be effective only if made in writing, and only if executed with the same formality as this Stipulation and Agreement. 9. The parties desire that this Stipulation and Agreement be made an Order of Court of the Court of Common Pleas of Cumberland County, and further acknowledge that the Court of Common Pleas of Cumberland County does, in fact, have jurisdiction over the issue of custody of the Child, who has resided for an excess of six (6) months in Cumberland County, Pennsylvania. 10, The parties stipulate that in making this Agreement, there has been no fraud, concealment, overreaching, coercion, or other unfair dealing on the part of the other party.
