to commence work on the said building, or purchase materials for the same in consideration of the making of the said

consideration of One Dollar, to Haubert Hares, Inc. paid
by John S. Frankford III and Andrea M. Frankford , it is agreed that no lien shall be filed against the
building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such
liens being expressly waived.

ALL THAT CERTAIN lot of land situate partly in Upper Allen Township and
partly in Monroe Township, County of Cumberland and Commonwealth of
Pennsylvania, bounded and described as follow, in accordance to the Final
Subdivision Plan for Creekstone Manor (formerly known as Trout Run), Phases II
& III, dated January 1, 1996, prepared by Hartman & Associates, Inc., and
recorded in Plan Book 76, Page 133, to wit:
BEGINNING at a point on the southwestern side of Merrimac Avenue at the
southeastern corner of Lot No. 48 on the above mentioned Plan of Lots; thence
along the southern side of Lot No. 48, South 88 degrees 39 minutes 20 seconds West,
a distance of 233.16 feet to a point at the eastern line of lands now or formerly of
Ashcombe Farm Dairy on the above mentioned Plan of Lots; thence along the said
lands of Ashcombe Farm Dairy South 42 degrees 43 minutes 40 seconds East, a
distance of 163.60 feet toga point at the northwestern corner of Lot No. 50 on the
