1, Advice of Counsel: The parties hereto acknowledge that each has been
notified of his or her right to consult with counsel of his or her choice, and have been provided a
copy of this agreement with which to consult with counsel. WIFE is represented by James D.
Flower, Jr" Esquire, and HUSBAND, is represented by Marcus A. McKnight, III, Esquire. Each
party acknowledges and accepts that this agreement is, in the circumstances, fair and equitable,
and that it is being entered into freely and voluntarily, after having received such advice and with
such knowledge as each has sought from counsel, and that execution of this agreement is not
the result of any duress or undue influence, and that it is not the result of any improper or illegal
agreement or agreements.
2, Divorce: The parties agree to the entry of a Decree in Divorce, The
parties will execute, on the date of this agreement, Affidavits of Consent and Waivers of Notice
under Section 3301 (c) of the Divorce Code, consenting to the entry of a Decree in Divorce.
3, Personal Property: The parties acknowledge that they have equitably and
satisfactorily divided all of their personal property, and that all personal property shall be the sole
and individual property of the party in whose possession it is as of the date of this agreement.
WIFE will retain her Hyundai Accent and HUSBAND will execute any and all documents to
transfer all his right, tille and interest in said vehicle to WIFE, WIFE will pay the balance of the
loan for the purchase of said vehicle and shall indemnify and hold HUSBAND harmless against
any loss as a result of said loan, HUSBAND will retain the Ford Truck and WIFE will execute
any and all documents to transfer all her right, tille and interest in said vehicle to HUSBAND.

HUSBAND shall pay the outstanding indebtedness on said truck and indemnify and hold WIFE
harmless against any loss on account of said loan,
4, Alimony: The parties waive any claim that they may have one against the
other for alimony or spousal support, The parties acknowledge that each has sufficient assets
with which to maintain themselves after divorce,
5, Marital Debt: The parties may have, ;n their own names, certain credit
card accounts which may include some marital debt. Each party will be respor.sible for the debt
on the credit card accounts in his or her name, Each party will incur no debt for which the other
may be liable, and will indemnify and hold the other harmless for any debt so incurred,
HUSBAND takes full responsibility for the loan to Beneficial Finance. HUSBAND has
represented and WIFE, in fact, believes that this loan has been paid off.
, 6. Custody: The parties are parents of a son, LONNIE McKILLIP. II. born
February 10, 1996, presently 13 years old, Custody of said child is governed by a Court Order
dated February 12, 1999, providing that the parties share legal custody of their son, and that
WIFE has primary physical custody of said child, and HUSBAND has partial custody. WIFE
wishes to move to Indiana where she has better job prospects, HUSBAND has agreed to permit
her to move to Indiana and retain primalY physical custody of their son, The parties agree that
they shall continue to have shared legal custody of their son, that WIFE shall continue to enjoy
primary physical custody of said child, and that HUSBAND shall have periods of temporary
physical custody of the child for one weekend every three months, approXimately one-half of the

Christmas vacation, and ror a period or two months during the summer, The parties shall share
trclnsportation for these periOds of temporary physical custody, This Agreement shall have the
effect of modifying the custody agreement memorialized in the Court Order of February 12,
1999, and either party shall, upon the request of the other party, promptly sign any documents
necessary to formalize this Agreement as a Court Order,
7, Child Support: This Agreement shall not govern child support, which may
be enforced through the office of domestic relations of the Court of Common Pleas of
Cumberland County, Pennsylvania.
8, Modification: No modification, recision, or amendment of this agreement
shall be effective unless in writing signed by each of the parties hereto,

Applicable Law: All acts contemplated by this agreement shall be

construed and enforced under the laws of the Commonwealth of Pennsylvania,
10, Agreement Binding on Parties and Heirs: This agreement, except as
otherwise expressly provided herein, shall bind the parties hereto, and their respective heirs,
executors, administrators, legal representatives, assigns and successors in any interest of the
parties,

11, Agreement Not to be Merged: This agreement shall be incorporated into

the final decree of divorce of the parties hereto for purposes of enforcement only, but otherwise
shall not be merged into said decree, The parties shall have the right to enforce this agreement
under the Divorce Code of 1980, as amended, and in addition, shall retain any remedies in law

are specifically not waived or released,
12, Documents: The parties herelo agree that they will execute and deliver
one to the other any documents necessary to give effect to the terms of this Agreement.
13, Full and Final Settlement: WIFE and HUSBAND each do hereby
mutually remise, release, quitclaim and forever discharge the other and the estate of such other,
for all time to come, and for all purposes whatsoever, of and from any and all rights, titles,
interests or claims in or against the property (including income and gain from property hereafter
accruing, of the other) or against the estate of such other, of whatever nature and wheresoever
situate, which she or he now has or at any time hereafter may have against such other, the
estate of such other or any part thereof, whether arising out of any former acts, contracts,
engagements or liabilities of such other, or by way of dower or curtesy, or claims in the nature of
dower or curtesy of widows' or widowers' rights, family exemption or similar allowance, or under
the intestate laws, or the right to take against the spouse's will; or the right to treat a lifetime
conveyance by the other as testamentary, or all other rights of a surviving spouse to participate
in a deceased spouse's estate, whether arising under the laws of Pennsylvania, any other State,
or any other Country, or any rights which either spouse may have, or at any time hereafter have,
for past, present or future support or maintenance, alimony, alimony pendente lite, counsel fees,
costs or expenses, whether arising as a result of the marital relation or otherwise, except and
only except, all rights and agreements and obligations of whatsoever nature arising or which

may arise under this Agreement or before the breach of a"y thereof, It is the intention of
HUSBAND and WIFE to give to each other by the execution of this Agreement a full, complete
and general release with respect to any and all property of any kind or nature, real, personal or
mixed, which the other now owns or may hereafter acquire, except and only except, all rights
and agreements and obligations of whatsoever nature arising or which may arise under this
Agreement, or for the breach of any thereof, subject, however, to the implementation and
satisfaction of the condition precedent as set forth herein above,

1, The Plaintiff is LINDA SUE McKILLIP, who currently resides at 173 East Penn
Street, 2'" Floor, Carlisle, Cumberland County, Pennsylvania, for a period in excess of one year
prior to the filing of this Complaint.
2, The Defendant is LONNIE L. McKILLIP, who currently resides at 5 Larkin
Lane, Mt. Holly Springs, Cumberland County, Pennsylvania, since November of 1989,
3, The Plaintiff and Defendant both have been bona fide residents in the
Commonwealth of Pennsylvania for at least six months immediately prior to the filing of this
Complaint.
4, The Plaintiff and Defendant were married on August 28, 1985, in Cumberland
County, Pennsylvania,
5, There have been no prior actions of divorce or for annulment between the
parties in this or in any other jurisdiction,
COUNT I . DIVORCE
6, The Plaintiff avers that she is entitled to a divorce on the ground that the
marriage is irretrievably broken and Plaintiff is proceeding under Sections 3301 (c) and/or (d) of
the Divorce Code,
7, Plaintiff has been advised of the availability of marriage counseling and of the
right to request that the Court require the parties to participate in marriage counseling, and does
not request counseling,
WHEREFORE, Plaintiff requests the Court to enter a decree of divorce,

Melissa Paxton, their son, Lucas Paxton and their daughter, Alura Paxton;

Holly Springs, Pennsylvania, with Plaintiff, with Defendant Lonnie L, McKillip, and with

15, The mother of the child is LINDA SUE McKILLIP, currently residing at 173

20, The relationship of the Defendant to the child is that of natural Father. The
Defendant currently resides with no one known to Plaintiff,
21, The Plaintiff has not participated as a party or witness, or in any other
capacity in other litigation concerning the custody of the child in this or another jurisdiction,
22, The Plaintiff has no information of a custody proceeding concerning the
child pending in a Court of this Commonwealth,
23, The Plaintiff does not know of a person not a party to the proceedings who
has physical custody of the child or claims to have custody or visitation rights with respect to the

granting the relief requested because since the date of the separation of the parties, Plaintiff has

1, That a Complaint in Divorce under Section 3301 (c) of the Divorce Code was
filed on November 19, 1989,
2, That my marriage with LINDA SUE McKILLIP, Plaintiff, is irretrievably broken,
3, That I consent to the entry of a Decree in Divorce on the grounds that the
marriage is irretrievably broken,
4, That I understand that I may lose rights concerning alimony, division of
property, counseling fees or expenses if I do not claim them before a divorce is granted,

them jointly and severally) promise to pay, without defalcation, to the order of
Alonzo B. McKillip, 'lhirty-'lhree '!bousard Dollars, with interest thereon at the
rate of zero per cent per anrnnn; said principal bein;J payable in successive
monthly install1nents of $275.00, the first install1nent payable on November 20,
1989, and the remaining install1nents on the same day of each m:mth thereafter.
'!HE UNDERSIGNED HEREBY expressly agree that in case a default shall be made
in the payment of any of the aforesaid installments, or any parts thereof, as and
when the same shall becol,le due and payable, then, and in any such case, all
IUlpaid principal then a=ed thereon shall, at the option of the holder of this
note forthwith become due and payable, without demand and notice.
AND FtlRlllER, the undersigned do hereby authorize and errpower the Prothonotary
or Clerk, or any attorney of any Court of Record of Pennsylvania or elsewhere, to
awear for and to enter judgment against any or all of the un:Iersigned for the
above SlDI\, \1ith costs of suit and fifteen (15) per cent added for attorney's
CXlllection fees, with release of errors, without stay of execution, and also
waive the right of inquisition on any real estate levied on, VOluntarily CXlnderral
the same, and authorize the Prothonotary or Clerk to enter upon the writ of
execution said voluntal.y condemnation, and agree that said real estate may be
sold on a writ of execution, and hereby waive and release all relief fran any and

PROPERTY INSURANCE: J agree to insure the Manufactured Home against physical damage lor the term of the contract at
my expense, The minimum coverage will be Broad Form Comprehensjve, Including flood coverage, in an amount equal to
the lesser 01 the amount financed or the value 01 the Manulactured Home. The insurance policy will contain a loss payable
clause protecting you (as your interest may appear), and provide lor 10 day notice 01 cancellation to you, f have the right to
choose the person through whom the property insurance is obtained. II my Insurance coverage expires or is canceled prior
to payment in full 01 this contract, I must obtain no less than the minimum coverage at my expense. Should flail to maintain
the minimum coverage, you may, bul are not obligated to, obtain the minimum coverage, The minimum coverage may be
purchased to insure your interest only, In such event, you will be acting solely on your own behalf; and, neither you nor any
insurance agent will be acting on my behalf, I acknowledge that slngle,interest insurance does not provide coverage for my
Interest in the collateral. Single-Interest insurance may be more expensive than a policy purchased by the owner of the
collateral. It will, not lulfill the obligation to maintain liability insurance imposed upon Borrower(s) under the financial
responsibility law 01 any state.
I UNDERSTAND THAT ANY INSURANCE PROVIDED BY YOU UNDER THIS CONTRACT WILL
NOT PROVIDE COVERAGE FOR BODILY INJURY AND/OR PROPERTY DAMAGE CAUSED TO
OTHERS.
CREDIT INSURANCE: I acknowledge that the creditor has a financial Interest in the sale of insurance, and may benefit
from the sale 01 such insurance by virtue 01 commission income which it may receive, III purchase it, credit IIle insurance
proceeds will be used to repay my debt to you in the event 01 my death, as described in the insurance certificate. If I
purchase insurance through the creditor, the insurance premium is included in the amount financed under this note,
Individual term iile insurance may be available to me at a lower cost than credit Iile insurance, In the case of death, the

PREPAYMENT: I MAY PREPAY THIS CONTRACT IN FULL OR IN PART AT ANY TIME WITHOUT PENALTY. BUT I
WILL NOT BE ENTITLED TO A REFUND OF THE PREPAID FINANCE CHARGE, IF ANY.
DELINQUENCY AND DEFAULT: Time is of the essence, If a payment is more than 15 days lale, I agree to pay a late
charge of 55,00 or 5% 01 the installment past due, whichever is less, If I fail to make payment when due or otherwise fail
to perform any of my obligations under this contract. I am in default. In the event of my default, you will give me nollce of
the right to cure the default where required by law, I am not, however, entitled to nollce of default more than twice In any
one.year period. Under no circumstances am I entitled to a notice of right to cure the defauU where I have either
abandoned or voluntarily surrendered the Manufactured Home, III have not cured the default Within 30 days alter the
postmark date of the nolice, you may accelerate the maturity of the debt and require me to pay you the entire remaining
balance of the Contract less the refund described in the Prepayment Paragraph above. You may take legal action against
me, and you may foreclose on or repossess the Manufactured Home and any other things covered br the security interest
I have granted, In the event of default, I also agree to pay your expenses for (a) reasonable attorney s fees, not to exceed
15% of my unpaid debt, alter referral to an attorney who is not your salaried employee; (b) court costs and disbursements;
and (c) costs of peacefully repossessing or foreclosing on the Manufactured Home and any other things covered by the
security interest, and such costs may include the costs of storing, reconditioning, and reselling it, subject to the pertinent
provisions of the Uniform CommercIal Code,
PERSONAL PROPERTY: I agree that regardless of how my Manufactured Home is attached to the real property, my
Manufactured Home is and shall remain personal property and shail not become a fixture or part of the real property
unless you elect to recognize it as a fixture to real property.
PERSONAL PROPERY TAXES: I agree to pay any and ail property taxes assessed against the Manufactured Home or
my real estate and agree that failure to pay such taxes shall constitute a default under this contract.
CREDIT INFORMATION: You may investigate my credit history and credit capacity in connection with opening and
collecting my account and share information about me and my account with credit reporting agencies. You mav sell or
otherwise furnish information about me, includina insurance information, to all others who mav lawluilv receive such
information, You mav furnish soecific information about the Manufactured Home and anv insurance Dolicies on the
Manufactured Home to anv insurance aaent to enable such aaent to auote oremiums to me and solicit mv insurance
business.
OTHER TERMS AND CONDITIONS: I agree: (a) not to remove the Manufactured Home from the address shown on this
contract unless I notify you in advance and receive your written consent; (b) not to seilthe Manufactured Home without
first obtaining your written consent; (c) that if the Manufactured Home is a personal property I will not let it become part of
any real estate without your written consent; (d) not to encumber or abandon the Manufactured Home or use it for hire or
illegally; (e) to pay promptly ail taxes and any liens and encumbrances of the Manufactured Home; and (I) to pay with my
monthly installments, if requested to do so by you, the estimated amount necessary to pay yearly taxes, assessments and
insurance premiums that wi:! become due within the nex1 twelve month period,
ASSIGNMENT: You may assign this contract to any person or entity. Ail rights granted to you under this contract shail
apply to any assignee of this contract.
WAIVER AND MODIFICATION: Your waiver of any defauU shall not constitute a waiver of any other default. The
procurement or required property insurance, or the payment of taxes, or other liens, or other charges, by you shail not be a
waiver of your right to accelerate the maturity of this contract and declare a defauU herein, Your ailowance of a
reinstatement upon default will not be a waiver of the right to declare tulure accelerations and any forbearance shail not be
a waiver of other current or future rights of noteholder nor shail preclude the exercise of any such rights or remedies.
ENTIRE AGREEMENT: This contract, any separate written aUernative dispute resolution agreement, any mortgage or
deed of trust that the borrower signs as part of this contract and any separate written warranty constitute the entire
agreement between us. I agree that no representations, oral or written, have been made to me to induce me to enter into
this contract, other than the representations expressly set forth i~ this contract, any separate written aiternative dispute
resolution agreement, and in any separate written warranty.
WARRANTIES: Any warranties relating to a new Manufactured Home have been provided to me by my dealer, or
warranty company, or the manufacturer in a separate writing, receipt of which I hereby acknowledge, Except as provided
in such a writing, if any, there are no warranties, express or implied, including but not limited to warranties of
merchantability or fitness for a particular purpose. I acknowledge that I have examined the Manufactured Home and
that, if it is used, I accept the Manufactured Home "as is," The year of the Manufactured Home as specjfied in this contract
is for identification purposes only. No assignee of this agreement shail be liable, either in tort or contract, for any direct or
indirect damages or for any special, incidental. or consequential damages arising out of or in connection with this contract
or transaction,
VALIDITY: Wherever possible each provision of this contract shall be interpreted in such a manner as to be effective and
valid under applicable law, but if any provision of this contract shail be prohibited by or be invalid under applicable law,
such provision shail be ineffective to the extent of such prohibition or invalidity, without invalidating the remainder of such
provision or the remaining provisions of this contract. This contract shail be of no effect until and unless signed by me and
