The petition of Dale C. Beavcr Jr, respeelfillly represents:
J ,) Your petitioner. Dale C, Beaver. Jr., is the Executor ofthc Last Will and
Testament of Nancy L. Beaver, having been appointed by the Register of Wills of
Cumberland County on October 7. 1998.
2,} Nancy L Beaver was killed in an automobile accident September 28, 1998,
in Upper Allen Township, Cumberland County, Pennsylvania, when the vehicle operated
by her husband. Dale C. Beaver. Sr.. in which she was a passenger was struck by a
vehicle operated by defendant, Anne P. Casey-Knight.
3,) Nancy L. Bcavcr was survivcd by hcr husband, Dalc C. Bcaver. Sr., with
whom she rcsidcd at 405 Wcst Marble Strcet, Mcehaniesburg, Pcnnsylvania,
4.) Nancy L. Beaver was survivcd by thrce children, viz Dalc C. Beaver, Jr.,

dale of hirth. Fehruary 6. 1957. Mary A. AI-Ilai. date of hirlh July 21. 19511 and Daniel C.
Beaver, dale of hirlh. No\'elllher 21. 1959.
5.) On the date of death all of said children oflhe decedent were enmncipaled.
maintained their OWlI residences and were not dependenl on her Illr supporlor
maintenance.
6.) Defendanl Anne 1'. Casey-Knight was insured hy Allstate Insurance
Company. The policy limits were $500.000,00 per accident and $250.000.00 per person,
7.) Allstate has agreed to pay the policy limit 01'$250.000,00 to plaintilTin this
malleI' subject to approval of the underinsurance carriers.
8.) The vehicle operated by Dale C. Beaver. Sr.. was owned by GEO Technical
Services. Inc. which provided single payment underinsurance covcragc in thc amount of
$1.000,000.00 with Harllord Insuranec Company,
9,) Thc vchicle own cd by Dale C. Beaver, Sr. was insured for underinsurancc
coverage by Allstatc in Ihc amounl of $300,000.00 for each accident, $100,000.00 each
person which covcragc follows thc Ilarlford insurance,
10.) Hartford has not yct conscntcd to thc partial scttlcment. Allstate has
consented.
11.) The underinsurance claim of the plaintiffs has not been resolved to date,
12.) Your petitioner has agrced upon a contingent fee 01'25% of any recovery in
this mallcr.
13.) The following distribution of the procceds of the Allstate Insurance
