HomeMy WebLinkAbout03-1296H S Service Corporation, Trustee, Vo Wheatland Custom Homes, Inc., ) ) NO. g~3 - IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA STIPULATION AGAINST LIENS WHEREAS, H S Service Corporation, Trustee, of Cumberland County, Pennsylvania, is about to execute contemporaneouslyherewith, a contract with Wheatland Custom Homes, Inc. of Lancaster County, Pennsylvania, for the erection of a dwelling upon a lot of land situate as follows: ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland County, Commonwealth of Pennsylvania, known as Lot No.3/,2 on the Final Subdivision Plan of Hampden Hearth - Phase IV-B, recorded in the Cumberland County Courthouse in Plan Book 79, Page 107, and being more particularly bounded and described as set forth in the legal description attached hereto and made a part hereof as Exhibit "A"- NOW, the ~ day of March, 2003, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said H S Service Corporation, Trustee, to the said Wheatland Custom Homes, Inc. to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Wheatland Custom Homes, Inc. and the further consideration of One Dollar, to Wheatland Custom Homes, Inc. paid by H S Service Corporation, Trustee, it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any of the material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. ALL THAT CERTAIN parcel of land situate in Hampden Township, Cumberland County, Commonwealth of Pennsylvania, more particularly bounded and described to wit: BEGINNING at a point on the on the southern right-of-way line of Crofton Court at the common front property comer of Lot No. 311 and Lot No. 312 as shown on the hereinafter mentioned Plan of Lots; thence along said dividing line by a curve having a radius of 60.00 feet and an arc length of 48.79 feet having a chord beating North 06 degrees 07 minutes 02 seconds East, a distance of 47.46 feet to a point; thence continuing by a curve having a radius of 25.00 feet an arc length of 23.55 feet having a chord bearing of North 09 degrees 48 minutes 19 seconds East, a distance of 22.69 feet to a point; thence continuing North 36 degrees 47 minutes 22 seconds East, a distance of 39.96 feet to a point at the dividing line between Lot No. 312 and Lot No. 313; thence along said dividing ling South 53 degrees 12 minutes 38 seconds East, a distance of 128.84 feet to a point; thence South 40 degrees 18 minutes 00 seconds West, a distance of 106.59 feet to a point at the dividing line between Lot No. 311 and Lot No. 312; thence along said dividing line North 49 degrees 42 minutes 00 seconds West, a distance of 87.97 feet to a point, said point being the Place of BEGINNING. THE ABOVE-DESCRIBED TRACT BEING KNOWN AS Lot No. 312 of the Final Subdivision Plan of Hampden Hearth - Phase IV-B recorded in the Cumberland County Courthouse in Plan Book 79, Page 107. The above described tract containing 33,098.42 square feet, more or less. THE ABOVE DESCRIBED-TRACT BEING SUBJECT TO various easements of record as indicated on the above-referenced Subdivision Plan. UNDER AND SUBJECT to Declarations recorded in Miscellaneous Book 340, Page 491, and Miscellaneous Book 433, Page 942, in Cumberland County, Pennsylvania. EXHIBIT "A"
