8. l'laintiff delivered his damaged vehicle to Fry on or ahout MlIY 5. 1995 and
requested that repair work hegin.
9. On or about May 5, 1995, 1'laintilT 1I1so cndorsed his insurance check over to Fry
in the amount of$2,245.39.
10. Betwcen MlIY of 1995 and Dccembcr of 1997 Plaintiff visited the location and
repeatedly inquired about the status of his vehicle; cach time thc Fry or his agents stated that the
Chevrolet was "next in line" or that he was "very busy" lInd just needed a little longer to
complete the work.
11. Despite numerous requests made by Plaintiff in regular intervals, between May of
1995 and October of 1997, Fry failed to complete the repair work as agrccd.
12. On or about October J, 1997, Plaintiff mailcd the Fry a letter by ccrtilied United
States Mail demanding that the car be complcted within thirty days, or that the insurance check
be returned to Plaintiff. A copy of the letter and Certified Mail Receipt are attached hereto as
Exhibit C.
13. On or about October 31, 1997, the car rcmaincd unlinished outside of the E.P.
Service Center, the deposit had not been refunded and Fry or his agent would not return
telephone calls regarding the repairs,
14. On or about October 31, 11)97, Pl:lintiff liled (I Consumer Complaint \\ith the
oOiee of the Cumberland County Consumer Aflilirs: once (lgain, Defendant litiled to colllplete
the work on the ear or refund the deposit. A copy of the Consumer Complaint is (lllllehed hereto
as Exhibit D.
15. While on the Defendant's lot in the Summer of 1998, thc car was vand.llized, and
incurred additional damages,
16. On July 17, 1998, on the advise of counsel, Plaintiff moved the cllr from E.P.
Service center to have it evaluated.
17. A review of the car revealed that while it appeared to bc approximatcly 75%
complete, the workmanship was so poor and the structural repairs made by Fry were so unsound
that much of the work completed by Fry would have to be torn apart and re-repaired to make the
car safe.
18. Plaintiff received an estimate for correcting the work done by Fry and to restore
the car to roadworthiness in the amount of$3,292.62.

On October 28, 1998, Plaintiff received a Judgement before the District Justice in
the amount of $1,609 .40, which did not fully compensate him for his loss. A copy of the
Judgment is allached hereto as Exhibit E.
