COMPLAINT
AND NOW, the Plaintiff, Owen Bell, by and through his aUomeys IRA H.
WEINSTOCK. P.C., hereby submits this Complaint against the defendant and in support
thereof avers the following:
1. The Plaintiff, Owen Bell, is an adult individual who resides at 414 E. Washington
Street, Franklin, Kentucky 42135.
2. The Defendant, Flying J., Inc., conducts business under the laws of Pennsylvania
and has a principal place of business at 1501 Harrisburg Pike, Carlisle, Cumberland County,
Pennsylvania.
3, Defendant, Flying J, Inc., (hereinafter "Flying J") is a Utah corporation whose
headquarters is 50 West 990 S., P. O. Box 678, Brigham City, Utah 84302-0678, and whose
Pennsylvania address for service of process is Flying J., Inc., C/O C,T. Corporate System, 1635
Market Street, Philadelphia. 17102
4. On or ahout Novemher 25, 191}(, Plainliffwas an ovcr thc road truck driver
tfllvcling through Pennsylvania on his way to Cllifomia,
5. On thc aforemcntioned datc the Plaintiffstopped at Defendant's f<lcility located at
150 I Harrisburg Pike, Carlisle, Cumberland County, Pennsylvania.
6. After parking in the designated parking area, Plaintiff exited his tractor-trailer and
slipped on a portion of the parking area Ihal was covercd with a black oily substancc.
7. The blaek oily substance was not easily obscrvable to the Plaintiff.
8. As a result of slipping, the Plaintiff fcll and sustained an injury to his right ankle.
9. Plaintiff sustained injury to his right ankle including but not limited to sprained
and/or strained ligaments and swelling.
10. Plaintiff was required to seek medical attention for treatment of his injury.
I J. Plaintiffhas also incurred lost wages as a result of his inability to work.
COUNT I - NEGLIGENCE
12. Paragraphs I through II are ineorporated herein by reference as though set forth
fully herein at length.
13. Defendant, Flying J, Inc" owes Plaintiff, a business invitee, a heightened duty of
care to provide a safe and hazard free premises.
14. The Plaintiff was caused to fall as the direct and proximate result of the
Defendant's negligent, careless and reckless conduct as follows:
,I. Dcfcllllanlncgligently failcd to inspect the parking arca for hazardous
substances;
h. Defendant negligently failed to wam uscrs of the parking area, in
particular this plainlitT, of the dangerous naturc of hazardous substances which were
loeated in the parking area;
c. Dcfendant negligently r.1iled to clear the parking area of hazardous
substances;
d. Defendant breached its duty of care to Plaintiff because the parking area
wherc the Plaintiff was parked, was unsafe and inadequate for its intended use by
business invilees.
15. As a direct and proximate result of the negligence of the Defendant as stated
above, the Plaintiff was caused to fall and sustained severe persona' injuries as set forth herein.
16. As a further direct and proximate result of the negligence, recklessness and
carelessness of the Defendant, the Plaintiff has suffered and continues to suffer great pain of
body and mind.
17. As a further direct and proximatc result of the negligence, recklessness and
carelessness of the Defendant, the Plaintiff has been and continues to be unable to earry on his
normal activitics, and his health and ability to enjoy life have been and continue to be affected.
18. As a further direct and proximate result of the negligence, recklessness and
carelessness of the Defendant, Plaintiff will incur future lost wages and an impairment of his
earning eapacity.

The Defendant. Flying J. Inc., by and through its counsel, Marshall. Dennehey. Warner, Coleman &
Goggin. hereby moves this Honorable Court to cntcr an Order compelling the Plaintiffs attendance at
deposition and in suppOrl thcrcofstates the following:
1. This is a slip and fall action which is allcged 10 havc occurred on Novembcr 25. 1996.
2. The pleadings have closed.

3. Written discovery has been exchanged between the partics, but Plaintiff has failed to appear
for deposition which was scheduled Novembcr 9,2001.
4. A tme and correct copy a statcment on-the-record rclating to the Defendant's vanous

The Dcfendant. Flying J. Inc., by and through its counsel. Marshall, Dcnnehcy, Warner, Coleman &
Goggin, hereby movcs this Honorable Court to enter an Order compelling the Plaintiffs atlcndance at
deposition and in support thercof states the following:
1. This is a slip and fall action which is alleged to havc occurrcd on November 25. 1996.
2. The pleadings have closed.
3. Writlen discovery has been exchangcd betwccn the parties. but Plaintiff has failed to appear
for deposition which was scheduled Novembcr 9, 2001.
4. A true and correct copy a statement on-the-record relating to thc Defendant's various
attempts to take the Plaintiffs deposition, and Plaintiffs failure to appear, is attached hereto as Exhibit "A".
5. Pennsylvania Rule of Civil Procedure 40l9(a) provides that the Court may, on Motion, make
an appropriate Order whcn a party fails to appear for deposition,
